Re: Your Employment as Environment Officer (EO)

We are pleased to inform you that you have been successful in your application for the

position of Environment Officer (EO) to be based in Sarawak. We are pleased

therefore to offer you the said position subject to the terms and conditions hereinafter

mentioned. This offer of employment is valid for acceptance within Seven (7) days from

the date of this letter.

TERMS AND CONDITIONS

1. NATURE OF CONTRACT& SCOPE OF WORK

i. Your Employment is on CONTRACT BASIS, which is for the Company’s


project. Your Employment shall be automatically terminated upon
completion of the project SIMILAJAU TO BUNUT 500kV
TRANSMISSION LINE PROJECT CONTRACT REF. NO.: PLS-160130.

ii. Scope of work: ____________

1. Conduct Environmental Inspection on monthly basis.


2. Ensure the construction works comply with the EIA
requirements.

3. To attend monthly HSE Committee Meeting and Monthly
Progress Meeting.
4. Oversee the EMR is being carried out accordingly.
5. Conduct inspection at site.
6. Represent the company during EIA monitoring.
7. Conduct environmental training.
8. Full time at site Requirements
9. Any other related project work instructed by
Project/Construction Manager

2. EMPLOYMENT PERIOD:

i. You are required to serve a probationary period of _SIX (6) (1ST APRIL 2023
to 30TH SEPTEMBER 2023) months after which your service will be
confirmed subject to satisfactory performance. The probationary period may
be extended or shortened at the absolute discretion of the Company. During
the probationary period, your Employment may be terminated by either party
giving one (1) month notice in writing to the other party or on payment of
one (1) month salary in lieu of notice

ii. Subject to paragraph 2 (i) and in the event you passed the probation period,
you shall start to serve the Company on 1ST OCTORBER 2023 – 30TH
SEPTEMBER 2024. Renewal of your Employment is subject to your job
performance and it shall be the Company’s full discretion.

3. REMUNERATION

i. Your monthly basic gross salary will be Ringgit Malaysia 7100 (SEVEN
Thousand and ONE Hundred) and it will be paid to you at the end day of
every calendar month.

ii. Salaries of all confirmed staff should be reviewed upon completion of one-
year service with the Company.

4. BENEFIT & ENTITLEMENT

i. Annual Leave, Sick Leave and Public Holidays in accordance with Sarawak
Labour Ordinance

a) Annual leave
You are entitled to an amount of paid leave with 8 DAYS in accordance
with Sarawak Labour Ordinance for each full year of completed
employment with the Company. This will be pro-rated if your

Employment with the Company is terminated for any reason before the
end of such full year. All leave is to be taken at such time or times as may
be approved by us. You are encouraged to consume all your leave each
year or latest, within the year immediately following thereafter or it will
be forfeited at the Company's discretion;
b) Sick Leave;
c) Public Holiday Leave (according to Sarawak Labour Ordinance and
Company rules and regulation)
d) Maternity Leave (if applicable).

ii. EMPLOYEE PROVIDENT FUND


EPF shall be paid by the employer according to the Laws of Malaysia.

iii. SOCSO
SOCSO shall be paid by the employer according to the Laws of
Malaysia.

iv. The Company shall not bear the cost of the following:

a) Surgical or other appliances including dentures, spectacles and contact


lenses.
b)Dental charges.
c)Other specialist treatment
d)Any expenses in respect of pregnancy, confinement or miscarriage.
e) Any expenses arising out of self-inflicted injury or illness or disease
caused by misconduct.
f) Any expenses for treatment in mental cases that have been certified.
g) Any expenses incurred in respect of illness or disablement arising from
attempted suicide, the performance of an unlawful act, and exposure to
any unjustifiable hazards except when endeavoring to save human life,
provoked assault, the use of drugs or any breach of the peace of
disorderly conduct.
v. Others : the company will provide basic accommodation for site work staff,
and the company will provide work car to perform your duty.

5. USE OF PERSONAL HANDPHONE

You shall use your own hand phone device to make any calls with RM 100 monthly
telephone allowance;

6. Meal Allowance

You shall be entitled to have RM 300 for monthly meal allowance.

7. TRANSFER

You are subject to transfer to any place (within the state of Sarawak) when required
in the course of performing your duties.

8. WORKING HOURS & OVERTIME

i. You will be required to observe at all times the Company’s working hours on
which are at present as follows:-

Mondays to Saturdays: 8:00 am –5:00 pm (lunch time _12:00-13:00

ii. And you are fully acknowledged and noted that the work time will be
flexible from time to time, and you are consent that you will not claim any
overtime work due to flexible work time.

9. MEDICAL EXAMINATION

i. You will be required to undergo a medical examination by government or


private hospital or clinic. This offer of employment is subject to the result of
the said medical examination, which proves that you are physically fit in all
respect for employment with the company.

10. PATENTS, INVENTIONS AND DESIGNS

i. All inventions and registrable designs, connected with the Company’s


business, made by you while in the Company’s service shall be the property
of the Company and you shall make full disclosure thereof exclusively to the
Company and shall at the cost of the Company do all such things as may be
necessary to enable the Company to obtain such letters patents of design
registration therefore as it may require.

ii. You shall disclose to the Company any interest acquired from any other
person before entering or while in the Company’s service in any letters patent
or design registrations or application therefore for an invention or design
connected with the Company’s business. You shall not dispose of the said
interest without first offering to sell the same to the Company at a price equal
to the best price obtainable from a third party. If the Company shall reject the

offer you shall be free to sell the said interest to a third party at a price not
less than the price at which it was offered to the Company.

11. SECRECY AND PROTECTION OF INFORMATION

i. You shall maintain utmost secrecy in respect of project documents,


commercial offers, design documents, project costs & estimation, technology
and other confidential data in relation to the project and/or the Company.

ii. It is further understood that during your Employment period or at any time
thereafter (save as required by law), you will not divulge any information of
confidential nature which your acquire in performing your duties in the
Company.

iii. You shall not, without authority to disclose any information concerning the
business or affairs of the Company and you shall be bound at all times by the
rules and regulations of the Company, any unauthorized disclosures of the
serious nature may also lead to instant dismissal and suit for damages or
losses incurred.

12. TERMINATION OF EMPLOYMENT

i. The Company shall be at the liberty to terminate your Employment


forthwith by giving you ONE (1) month written notice to that effect:

a) In the event of your failure to observe or perform the lawful and proper
instructions of the Company, or
b) If you commit any improper conduct, which in the opinion of the
Company is prejudicial to its interest.
c) If you are incapacitated due to illness or accident for a period of 90 days.

ii. Otherwise your employment may be terminated by either party giving ONE
(1) months’ notice in writing to that effect or ONE (1) months’ salary in lieu
of notice.

13. DISPUTE RESOLUTION

i. Should a dispute between you and the Company arises, the Laws of Malaysia
shall apply and the forum for resolution of the disputes shall be the Malaysian
courts.
ii. Except as otherwise expressly provided in this letter, if any dispute, questions
or difference arises between the parties as to the meaning, operation or effect
of this letter or any of the provisions hereunder or as to their rights or
liabilities under this contract, such dispute, question or difference shall be
dealt with in the first instance by negotiation between you and the Company
prior any commencing any legal actions.

14. RETIRING AGE

The retiring age for employee shall be in accordance with the relevant Laws of Malaysia
but an employee may be continued in employment beyond that age at the sole discretion
of the Company and with the consent of the employee SUBJECT TO the relevant Laws
of Malaysia.

15. STATUTORY REGULATIONS/CONTRIBUTION

The employee and the Company shall be governed by any other statutory regulations
or contribution as may be imposed by the Malaysian Government from time to time.

If you find the above terms and conditions are favorable and acceptable, please indicate
your acceptance within 7 days from the date of this letter. This offer will lapse and no
longer be accepted if we do not hear from you within the stipulated time. We look forward
to welcoming you as a member of our Company and wish you every success in your
career with us.
