Personnel Security

 this is as important as physical security.


 starts even before the hiring of an employee and remains to be maintained for as long as
the person is employed.

Purpose:

 To insure, that a firm hires those employees best suited to assist the firm in achieving its
goals.
 Once hired, assist in providing the necessary security to them.

Functions of Personnel Security:

 Screening device
 BI
 Security Awareness
 Ensure the protection of employees from discriminatory hiring or termination as well as
unfounded allegations of illegal or unethical activities and conduct.

Personnel Security Investigation

An inquiry into the character, reputation, integrity, discretion, morals, and loyalty of
an individual in order to determine a person’s suitability for appointment
Red Flag Indicators

 Application form not signed


 Gaps in employment history
 Inability to remember names of former colleagues
 Inadequate references
 Lack of job stability
 Indications of over-qualifications
 Declining salary history
 Criminal record left blank

Background Investigation

 To verify information
 Ascertain past employment experiences
 Obtain other information pertinent to the decision to employ

Positive Vetting

A personal interview challenging the applicant on the basis of any false statements in order
to observe the applicant’s behavior under stress and to open areas for exploration
Guard Force Management

Private Security Agency (PSA)

shall mean any person association, partnership, firm, or private corporation, who contracts,
recruits, trains, furnishes or posts any security guard, to perform its functions or solicit individuals,
businesses, firms, or private, public, or government-owned or controlled corporations to engage
his/its service or those of his/its security guards.

Private Detective Agency (PDA) –

shall mean any person association, partnership, firm, or private corporation, who contracts,
recruits, trains, furnishes, or posts any private detective, to perform its functions or solicit
individuals, businesses, firms, or private, public, or government-owned or controlled corporations
to engage his/its service or those of his/its detectives.

Company Guard Force (CGF)

a security force maintained and operated by any private company/corporation utilizing any
of its employees to watch, secure or guard its business establishment premises, compound, or
properties.

Government Guard Unit (GGU)

a security unit maintained and operated by any government entity other than the military
or police, which is established and maintained for the purpose of securing the office or compound
and/or extension of a such government entity.

Who may organize and maintain a PSA and PDA?

 100% owned and controlled by a Filipino Citizen (Sec. 1, Rule IV)


 The manager or operator of the agency shall be:
 FC
 25 y/o
 College graduate and/or retired AFP/PNP commission officer
 Has taken the ISM course and has experience in the security business
 Good moral character
 Must have a capital of 1 million and a bank deposit of 500 thousand.
 Must have an updated License to Operate
 Must have security personnel-employee benefits
 Has a mandatory insurance coverage program

License to Operate (LTO)


a License Certificate document, issued by the Chief PNP or his duly authorized
representative, authorizing a person to engage in employing a security guard or detective, or a
juridical person to establish, engage, direct, manage or operate an individual or a private detective
agency or private security agency/company security.
Status and Validity of License to Operate
Regular LTO
 issued to PSA having obtained and maintained in its employ at least 200 security personnel
 issued to CGF and PDA having obtained and maintained in its employ at least 30 security
personnel respectively.
 renewed every after 2 years (IRR 5487)
Temporary LTO
 initial and conditional issuance to new PSA and to PSAs holding regular LTO not able to
maintain the minimum number of security personnel
 such issuance shall not be renewable nor be extendible
 automatically canceled upon the expiration
Application for License to Operate (LTO)

 Filed with C, PNP thru (SAGSD-CSG)

 Affidavit that PSA will have at least 200 guards
Renewal of License to Operate
 All applications for renewal of License to Operate shall be filed at least 60 days before the
expiry date of LTO
 Failure to file for renewal within 60 days after the expiry date SHALL AUTOMATICALLY
BE CANCELLED.
Approval, Cancellation, and Suspension of LTO (Sec. 12, Rule IV)
Unless revoked or modified by the Chief, PNP, the authority to approve, cancel or suspend
the license to operate shall be exercised by the following:
 Approval of New Regular LTO CPNP
 Cancellation of Regular LTO CPNP
 Re-instatement of Regular LTO CPNP
 Suspension of Regular LTO CPNP
 Renewal of Regular LTO DCSG
 Approval of Temporary LTO DCSG
 Reversion of Regular to Temporary LTO DCSG
 Cancellation of Temporary LTO DCSG
 Suspension of Temporary LTO DCSG

Security Guard/Personnel
Private Security Guard (SG)
Sometimes called watchman shall include any person who offers or renders personal
service to watch or secure either a residence, business establishment, or buildings, compounds,
areas, or property, inspects/monitors bodily checks/searches individuals and/or baggage and other
forms of security inspection.
Private Detective (PD)
shall mean any person who does detective work for hire, reward, or commission
Qualifications of SG or Watchman/SG
 Filipino citizen;
 High school graduate;
 Physically and mentally fit;
 Not less than eighteen (18) years of age nor more than fifty (50) years of age
 Has undergone a pre-licensing training course or its equivalent.
Qualifications for Security Officer/SO
 Filipino citizen;
 Holder of a Baccalaureate Degree;
 Physically and mentally fit;
 Has graduated from a Security Officer Training Course or its equivalent.
Qualifications of Security Consultants
 Filipino citizen;
 Physically and mentally fit;
 Holder of a Master’s degree in either Criminology, Public Administration, MNSA,
Industrial Security Administration, or Law;
 Must have at least ten (10) years of experience in the operation and management of the
security business.
Qualifications of a Private Detective
 Filipino citizen;
 Physical and mentally fit;
 Holder of a baccalaureate degree preferably a Bachelor of laws or Bachelor of Science in
Criminology; Graduate of a Criminal Investigation Course offered by the Philippine
National Police or the National Bureau of Investigation or any police training school, or a
detective training in any authorized/recognized training center;
 Advance ROTC graduate or its equivalent.
License to Exercise Profession
shall mean any document issued by the Chief, PNP, or his duly authorized representative
recognizing a person to be qualified to perform his duties as private security or training personnel.
Uniform, Equipment, and Paraphernalia of Security Guards
Uniform
 Private Security Guard
 Fast navy blue, short sleeves, shoulder straps, two breast pockets with cover
flaps, and navy blue front buttons, tucked in.
 Company Security Force
 It shall be sewn in the same manner as prescribed for private security agencies
except that the color is light gray
 Government Security Unit
 It shall be sewn in the same manner as prescribed for private security agency
except that the color is white

Use of Firearms

Requirements and Limitations under RA 5487

 Ratio: 1 FA= 2 SG
 In the actual performance of duty and in uniform
 GR: Only within the compound of the establishment
 Exceptions:
a. escorting big cash
b. hot-pursuit
 With Duty Detail Order
General Rule:

 Restricted to possess high-powered firearms

Exception:

 Entities who are operating in areas where there is an upsurge of lawlessness and
criminality, provided:

 At the expense of PSA


 Be registered
 Total no. of HPF not exceed 10 % of the total guards of a PSA
 Adequate training

Duty Detail Order


is a written order/schedule issued by a superior officer usually the private security
agency/branch manager or operations officer assigning the performance of private
security/detective services duties.
A document issued to a person authorizing the latter to carry firearm:
 Not more than 30 days – post duties
 Not more than 24 hrs. – transport or replacement of licensed FA’s from agency to post
or post to agency
RA 5487, Justification for Confiscation of FA’s:

 About, actually or has just been used in the commission of a crime


 No license

Powers and Duties of Security Guards

Territorial power

 A security guard shall watch and secure the property of the establishment with whom he or
his agency has a contract for security services.

 Such service shall not, however, extend beyond the property or compound of said
establishment except when required by the latter in accordance with the terms of their
contract to escort, or in hot pursuit of criminal offenders.

Duty of security guard making arrest

 Any security guard making an arrest:

 shall immediately turn over the person arrested to the nearest police station
 or he may without necessary delay and within the time prescribed in Article 125 of the
Revised Penal Code, as amended, take the person arrested, to the proper Court of Law
or judge for such action as they may deem proper to take.
Eleven General Orders
 To take charge of the post
 To walk in an alert manner and observe

SOME IMPORTANT TERMS
 PADPAO

refers to the Philippines Association of Detective and Protective Agency Operators, Inc., which
is an association of all licensed security agencies and company security forces.

 KABIT SYSTEM

No licensed security agency shall operate, promote and enter into an agreement of “merger“
(kabit system) with any person or a group of persons for the purpose of organizing a branch unit
or subsidiary under separate control and ownership.

mandated to administer and supervise the organization, operation, training, business and
activities of all stakeholders of the private security industry in the country.

 SAGSD- Security Agencies and Guards Supervision Division

provide services and general supervision and management and operation of all organized
private security, detectives, watchman, guards, agencies, and company security forces.
