Rule 6 Investigation Operation

6.1 Conduct of Crime Scene Investigation


-The CSI starts from the arrival of the PNP First Responders (FRs) to the arrival of the Duty
Investigator/ IOC and the SOCO-LS Team until the lifting of the security cordon and release of
the crime scene. (Standard Operating Procedure No. ODIDM-2011-008 “Conduct of Crime
Scene Investigation”)

First Responder
-They assess whether the situation still poses imminent danger and call for backup if necessary.

Investigation on Case (IOC)


-Assume full control and responsibility over the crime scene and conduct inquiry into the
incident. If necessary, the IOC may extend the search outside the crime scene and they are the
one to make a through assessment of the crime based on the briefing of the FR.

SOCO
-They respond only upon the request through the operation center and after the IOC has already
the proper assessment of the crime scene.

Legal Officer
-Go to the crime scene involving Sensational Crime and Serious ERI and ensure
that the applicable laws, rules and regulations during the CSI are observed.
-Provide the necessary legal assistance in the preparation of complaint, affidavits
and other pleadings that will be filed before the prosecutor’s office.

Two types of Police Blotter


Blue Blotter
- Contains the daily registry of all crime incident reports, official summaries of
arrest, and other significant events reported in a Police Station/Unit; and
Pink Blotter
-Contains the daily registry of all crime incident reports involving Violence
Against Women and Children, Trafficking in Person, and other Gender-Based Violence
such as those provided for in PNP policies and Philippine laws.
Judicial Affidavit Rule (A.M. No. 12-8-8-SC)
-This Rule shall apply to all actions, proceedings, and incidents requiring the reception of
evidence before the court in place of the direct testimonies of witnesses in order to reduce the
time needed for completing their testimonies.

RULES ON LABOR DISPUTES


-The involvement of PNP personnel during strikes, lockouts and labor disputes in
general shall be limited to the maintenance of peace and order, enforcement of
laws, and implementation of legal orders of the duly constituted authorities.
-The PNP shall only render assistance to labor disputes upon written request
addressed to the Regional Director/ District Director concerned. In case of actual
violence, the police can respond without the written request.

Rules on Labor Disputes


-The PNP shall be LIMIED to the maintenance of peace and order, enforcement of laws, and
implementation of legal orders of the duly constituted authorities.
-They shall exercise maximum tolerance.

Applicable Legal Parameters


-The pertinent provisions of the Public Assembly Act of 1985 (Batas Pambansa Bilang
880), the Labor Code of the Philippines, as amended and other applicable laws, shall be
observed during rallies, strikes, demonstrations or other public assemblies.
-Exercise maximum tolerance.

RALLIES AND DEMONSTRATIONS


-The PNP adheres to the Code of Conduct for Law Enforcement Officials adopted
by the General Assembly of the United Nations which requires law enforcement officials to
respect and protect human dignity, maintain and uphold the human
rights of all persons, and limit the use of force to situations where it is strictly
necessary and to the extent required for the performance of their duty.
-Public assemblies held in freedom parks or on private property do not need a
permit for the activity. Public assembly with permit or one held in a freedom park
or private property shall not be dispersed as long as it remains peaceful and no
incidence of violence occurs.

CIVIL DISTURBANCE MANAGEMENT OPERATIONS


-The PNP units tasked to maintain peace and order shall not interfere with the holding
of public assembly. To ensure public safety, a Civil Disturbance Management (CDM)
contingent under the command of a Police Commissioned Officer (PCO) with the rank of
Police Senior Inspector or higher shall be detailed and stationed at least 100 meters away
from the place where the public assembly is being held. In the absence of any permit from
the LGU concerned, the PCO in command should exert effort in persuading the
demonstrators to disperse peacefully and vacate the public place.
Permit when required and when not required
-A written permit shall be required for any person or persons to organize and hold a public
assembly in a public place.
No permit shall be required if the public assembly shall be done or made in a freedom park duly
established by law or ordinance or in private property, or in the campus of a government-owned
and operated educational institution.

Police Planning

Planning
- Is defined as thinking about the future, thinking about what we want the future to be, and
thinking about what we need to do now to achieve it. Planning involves linking present actions to
future conditions. It is also defined as a management function concerned with visualizing future
situations, making estimates concerning them, identifying the issues, needs and potential dangers
points, analyzing and evaluating the alternative ways and means for reaching desired goals
according to a certain schedule, estimating the necessary funds and resources to do the work, and
initiating action in time to prepare what may be needed to cope with changing conditions and
contingent events.
-Is the process of deciding in advance what is to be done and how it is to be done. Instead of
accepting the future, managers, by intellectual planning, process may be that able is to strongly
affect that influenced future. It is essentially an intellectual process that is strongly influenced
how a manager thinks about his organization.

Analytical Approach involves taking the system apart/ trying to understand each part, then
using this knowledge to understand the whole system.
Synthetical Approach considers all the organizational processes together to try to understand
how they relate to one another and to the environment in which the system functions.

Ideal Linking is often done through free association in trying to allocate anticipated are
encouraged to identify any ideas. Without limitations or inhibitions that might relate to the
problem or plan at hand.
Police Planning is an attempt by police administrators in trying to allocate anticipated resources
to meet anticipated service demands.

Operational Planning is the use of rational design or pattern for all departmental undertaking
rather than relying on change in an operational environment.

Police Operational Planning is the act of determining policies and guidelines for police
activities and operations and providing controls and safeguards for such activities and operations
in the department.

Objectives are a specific commitment to achieve a measurable result within a specific period of
time. Goals are general statement of intention and typically with time horizon, or it is an
achievable end state that can be measured and observed.
