SYNOPSIS

A. Petitioner is the owner in possession and enjoyment of 56.65 Ares of

dry land in Re Sy. 222/2, 16.19 Ares, 14.38 and 20.63 Ares in Sy. No

222/1 in Resurvey Block No 219 in Thandepper 14623 in Thiruvalla

VIllage; and are lying adjacent to the Main Central Road in Thjruvalla

municipal town, vide Exhibit P1, P2, P3 and P4 Sale Deeds. During

1999, the petitioner and other nearby land owners had given a portion
of their land in consensus with the government /Exhibit P6) for the

development of Thiruvalla bypass on condition that they will be

permitted to fill the property up to the road level. On the basis Of


Exhibit P6, the 3rd respondent had permitted the petitioner to use the

property for the purpose other than paddy oultivatfon and to fill the
land referred in Exhibit Pl to P5, up to the then proposed bypass road
level, by using red earth and municipal waste in the year of 2001 itself.

8. The 3rd respondent RDO vide ExhiELP7 submitted a report to the


District Collector wherein recommending to grand permission to

develop the land belongs to the people including the petitioner, and

District Collector submitted Exhibit P8 report to the government

recommending such permission. Thereafter, during 2014, petitioner

had submitted Exhibit P9 to get corrections in the Basic Tax Register

and also Exhibit Plo under dause 6 of the KLU order to the 3rd
respondent. But the same were not considered by the respondents and
thus aggrieved he had filed WP© No 3262 of 2015 and this Hon'ble

Court Exhibit Pllordered that the Exhibit Plo has to be considered on


the basis of the legal principles laid down by this Honourable Court in

various judgments. Thereafter the petitioner had submitted Exhibit P12


representation before RDO, who in turn conducted a hearing and
assured the petitioner that he will issue orders on Exhibit P 9 and 10

after availing the report from the 5th respondent.

C. Thereafter the 3rd respondent had obtained Exhibit P14 report from the
5th respondent that certifying the property is rot a paddy or wet land
as per records of the Exhibit P13 Data Bank ratification and also on

the basis of their local level inspection. The petitioner was highly

aggrieved on the non consideration of his applications by the statutory


officers of the state and the petitioner had again approached this
Honourable Court through a Writ Petition WP© No 34997 of 2019. But

the respondents were not filed any counter affidavit and the petitioner
had submitted the application under Right to Information Act and

obtained the rote file and the orders passed by the 3rd respondent on

previous applications Exhibit P9 and Plo. Hence it is revealed that the


3rd respondent had passed Exhibit P15 order dated 18/04/2015 and the
same was against the factual status of the fend and also the legal

position declared by this Hon Court.

D. It is clearly evidentfrom Exhibit P13 Draft DATA BANK, P14 report and

P20 KSREC report that the property comprised in Exhibit Pl to P4 are


`Converted land' prior to enactment of Kerala Conservation of Paddy

land and wet land Act 2008. But the 3rd respondent has failed to

consider the factual and legal issues and issued the Exhibit P15. The

petitioner had preferred the statutory Revision Petition before the lst
respondent as per Exhibit P25. These all facts were observed by this
Honourable Court in Exhibit P29 and directed the lst respondent to

consider and pass appropriate orders in the pending Revision Petition

Exhibit P25 against the Exhibit P15. But the lst respondent had not

considered the contentions from the petitioner and the 7th respondent
had rejected the Exhibit 25 statutory Revision Petition submitted before
the lst respondent State Government under Rule 14 of the Kerala Land
Utilization Order and issued the Exhibit P31 order without considering

the facts and also as well as the legal dictums laid down by the

Honourable Supreme Court of India as well as this Honourable Court.

The lst respondent had purposefully ignored the specific directions


issued by this Honourable Court in Exhibit Pll, P26, P28 and also in

Exhibit P30. Hence aggrieved this Memorandum of Writ Petition (Civil)

is filed.

House, Podiyadi P.O., Thiruvalla Thaluk, Pathanamthitta District; do
hereby solemnly affirm and state as follows:

1. I am the petitioner in the above writ petition (Civil) and I am

conversant with the fads of the case.

I an the absolute owner of 233 cents (94.25 ares)of land comprised in Re sy
® no.222/1 and 222/2 of Thiruvalla Village which was purchased by me as per

sale deed no.1526/2011,1527/20ll,1444/2010 and 2033/97 of SRO

Thiruvalla. The copy of the sale deed are produced herewith.

Though as per the village records the land is shown as "nilam" the nature of

the land was garden land in the year 1990 itself to which the provision of

Kerala Conservation of Paddy Land and Wet land Act 2008 is not applicable.

I have earlier made an application to know about the nature of my land in the

Data Bank entry and to issue me a certiricate regarding the same. I have come

0 to -understand that the village officer has conducted an inspection and I

understand that he has submitted an report stating that my land is not flt for

agricultural cultivation and that the adjacent land is also a garden land . The

copy of the letter by the ofrice of agricultural field office, Thiruvalla to prove

that the aforesaid land are garderi land is also produced herewith. When I

applied for possession certificate with the village office, I had been given a

digitally signed possession certiricate bearing no.9574054 dated 26,12`2014

I am the registered holder of properties having an extent of 56.65 Ares in Sy.


No. 222/2, 16.19 Ares, 14.38 Ares, and 20.63 Ares respectively in Sy No.

222/I of Thiruvalla Village. As per the Data Bank prepared by the Revenue
Department the above lands were shown as reclaimed nilam with year of
reclamation as 25 years back. The above lands are in no way comes within

the purview of Act, 28 of 2008. Moreover the land was reclaimed 25 years

back and continues to be purayidam. By virtue of the decision reported in

Praveen Vs Land Revenue Commissioner reported in 2010(2) KLT 617, the

following principles were laid down by the Hon'ble High Court at para 15
" 15. It is true that if it is a paddy land or wet land, the provisions contained in

the Land Utilization Order has no application after the coming into force of

the Kerala Conservation of Paddy Land and Wet Land Act, 2008, namely,
with effect from 12.8.2008. But still it is open to dispute as to whether a

particular land is a paddy land or wet land or whether it is a land cultivated


with other food crops. Therefore, if an application is made under the Land

Utilization Order on the plea that the land in question is not a paddy land or
wet land, but cultivated with other food crops, necessarily before non suiting
the applicant, a fmding has to be entered as to whether the application is

sustainable under the Land Utilization Order and it will be depending upon

that, finding ,a§ to whether the land in question ill respec`t of which an
application has been made for permission is a land cultivated with food crops ..
other than paddy, or it is a wet land. If the authority before whom the

application made is satisfied on due enquiry and based on materials on record


that the land is one cultivated with food crops other than paddy or a wet land,
such application has to be processed in terms of the pi.ovisions contained in

the Land ullization Order. On the other hand, if the authority finds that it is
a paddy land or wet land, the application has to be rejected whereupon it is

for the party aggrieved to challenge the same in appropriate proceedings. Or,
on the other`hand, if he accepts the finding, then it is still open to him to
submit an application under the Kerala Conservation of Paddy Land and Wet
®
Land Act, 2008 for necessary permission before appropriate auriority in

0 wh'ich event, the said application will be processed in terms of the provisions
contained therein. The question as to whether it is a paddy land or wet land is
to be adjudged based on materials ctn record including the revenue record, if

any. It is true` that mere description of the property on the revenue record by

itself may not be conclusive and may not estopp a party from producing
materials to show otherwise. This being an assessment of the factual position
regarding the nature of the land, necessarily, it involves adjudication by the
concerned authority on the given set of facts and materials produced and one
or other factor by itself may not lbe conclusive; but a decision has to be

rendered taking into consideration the materials available on record.

Therefore, if an application is made under the Kerala Land Utilization Order,


the sane is not liable to be dismissed before an enquiry is held by the
concerned authority under the Act and a finding is entered that the land in
respect of whieh the application is made is a paddy land or a wet land. What
ousts the jurisdiction of the authority under the Land Utilization Order is
based on the finding as to whether it is a paddy land or wet land. If it is a

paddy land or wet land, necessarily, it stands outside the jurisdiction of that
authority in processing the application further or in granting any permission

sought for: On the other hand, if it is held that it is not a paddy land or wet
land, but cultivated with crops other than paddy, necessarily, the authority
`under the Land Utilization Order will have to process the application in terms

of the provisions contained therein and dispose of the sane."

JUDGMENT

The petitioner is stated as owner of the properties having an

extent of 56.65 Ares in Sy No.222/2,16,19 Ares,14.38 Ares and

20.63 Ares in Sy. No.222/1 of Thiruvalla Village. According to the

petitioner, the said lands are 'i,either 'paddy lands', nor 'wet

lands' as defined under Section 2 (xii) or 2 (xviii) of Act 28 of

2008, though they have been described as 'Nilam' in the revenue

records. It is stated that in the Draft Data Bank published by the

respondents, the properties of the petitioner are not included as

paddy lands or wet lands. Though the petitioner has approached

the first respondent by filing Ext.P7 representation under Clause

6 of the Kerala Land Utilization Order,. seeking permission to use

® the lands for other purposes than agricultural purpose, the same

is still to be considered, which made the petitioner to approach

this Court by filing the present writ petition.

3. The law has been declared as per the decision rendered

in JafarKhan Vs. K.A. Kochumarakkar & Ors. [2012 (1) KHC

523] that the provisions of the Conservation of Kerala paddy

land and Wet land Act are applicable only in respect of the land

which were lying as 'paddy land' or 'wet land' as on the date of

commencement of the 'Act'. It has been further asserted by

another learned Judge of this Ct)urt in Asharaf K.K. And Ors

Vs. Eramala Grama Panchayath and Ors (2012 (3) KLT

323) that if the land is not included in the Data Bank Register

prepared under the Act, it cannot be classified as 'paddy land' or


'wet land'. It has been declared by a Division Bench of this Court

in Praveen Vs. Land Revenue Commissioner (2010 (2) l{LT

617) that, if the property conc'`=rned is not a paddy land or wet

land, the application if any preferred, is to be considered under

the relevant provisions of the Kerala Land Utilization Order, so as

® to enable the party concerned t:o make use of the property for

other appropriate purpose, It has been further made clear by a

Division Bench of this Court in Suni[ Vs. Killimangalam

Panchal 5th Ward Nellulpadaka Samooham (2012 (4) KLT

to the petitioner, at the earliest, at any rate, within 'two months'

The survey plots 222/I. 222/2. 222/42 and 222;'44 in Thiruvalla village. Thinivalla

taluk ot. Pathanamthitta district was vectorised and located in the Survey. of India Toposheet

number 58C/I I of 1967 in I :50.000 scale. using Ground Control Points. The survey. plot lies

between 9°2±'45.485"N to 9°22'50.808"N latitude and 76°34'33.402"E to 76°34'41.115"E

longitude.

DATA USED FOR CHANGE ANALYSIS

The location of the survey plot maps provided is identified in all available data sets

using Remote Sensing (RS) and Geographical Information system (GIS). The boundaries of

the survey plot mentioned in the. request were draun from the cadastral shects pertaining to

the area.

Thc` following data sets were used for the analysis. The month and year of the satellite data

used is mentioned in the respective maps provided for the survey number.

AN.ALYSIS

High resolution ortho­rei`tified Indian Remote sensing satellite data products were

used for geo­ret`erencing the cadastral maps pertaining to the survey plot and change
detection in land use and land cover ot` the site. Figure 2 shows the cadastral map ot` the plot

super imposed over Indian Remote Sensing satellite data­Cartosat­I. Figures is the plot

map superimposed / geo­referenccd with LISS IV MX of IRS data. These imageries show the

spatial reference of plots in ground.

As per the toposheet ol` 1967. the survey plots 222/I and 222/2 were observed under

padd}` land. The plots bordered by a road in west side were observed as fallow land with
vegetation and scattered trees in the data of 14/11/2011 (Fig.4). The same landuse practices

were continued in the data of 22/12/2013 (Fig: 5}. The data of 01/01/2016 (Fig. 6) and

21 `03/2021 (Fig: 7) shows a new road in east side of the plots .

under padd} land. The plots were obser`'ed as I.allow land with vegetation in the data of

14,;11/2011 (Fig.4). The same landuse practl­ces were continued in the data of 22/12/2013

(Fig: 5) and 01/01/2016 (Fig. 6). The 21/03/2021 (Fig: 7) dan show.s a linear feature

represents road/construction in north­south direction.

LIMITATIONS

This repor( is prepared based on the observations from the available satellite data of
ditT.erent }'ears without physical veriflcation. Particularly the data of 2008 was not a` ailable.

OBSERVATIONS & CONCLUSION

The anal}'sis has been carried out from all available data sets of toposheet (1967) and

di ft`erent satellite data sets of 2011. 2013` 2016 and 2021 for the sur`'ey plots.

As per the toposheet o+.1967. the sur`'ey plots 222r'l and 222/2 were obscr`.ed under

paddy land. The plots bordered by a road in u­est side \`,­as observed as fallow land with
\'egetation and scattered trees in 2011 data. The same landuse practices were conlinued in the

data ot`2013. The data of 2016 and 2021 shows a new road in east side of the plots .

3. It is submitted that this petitioner has filed writ petition


No.3262/2015 before this Hon'ble Court and this Hon'ble Court disposed the
writ petition with a direction to the Revenue Divisional Officer, Thiruvalla to
consider and pass orders under Clause 6 of the Kerala Land Utilisation Order,
after obtaining report from the Agricultural Officer and after giving an
opportunity of hearing to the petitioner on the representation filed by the

petitioner within two months from the date of receipt of copy of the judgment.
This Hon.ble Court in para 3 and 4 of the judgment dated 04.02.2015 has held
as follows;

3. The law has been declared as per the decision rendered in Jafar
Khan Vs. K A Kochumarakkar & Ors. [2012 (1) KHQ 523] that the

provisions Of the Conservation of Kerala paddy land and Wet land


Act are applicable only in respect of the land which were lying as
'paddy land' or 'wet land' as on the date of commencement of the
'Acr. It has been further asserted by another leamed Judge of this

Court in Asharaf K.K. And Ors Vs. Eramala Grama Panchayath and
Ors (2012 (3) KLT 323) that if the land is not included in the Data
Bank Register prepared under the Act, it cannot be classified as
'paddy land' or 'wet land'. It has been declared by a Division Bench

of this Court in Praveen Vs. Land Revenue Commissioner (2010 (2)


KLT 617) that. if the property concerned is not a paddy land or wet
land. the application if any preferred, is to be considered under the
relevant provisions of the Kerala Land Utilization Order, so as to
enable the party concerned to make use of the property for other
appropriate purpose. It has been further made clear by a Division
Bench of this Court .In Sunil Vs. Kjlllimangalam Panchal 5u'Ward

Nellulpadaka Samooham (2012 (4) KLT 511) that the land

4. Accordingly, the Revenue Divisional officer, ThiruvaHa heard the

petjtjoner on 12.03.2015 and recorded his statement. In the hearing, the


petltlonersubmitsthatthelandwaspartlaHyreclaimedandhewasnotwilling
tousethelandforcultivation.Thepetltioneralsosubmitsthathegathered
informationthat,thelandsofthepetitlonerwoujdbeacquiredforBypass
constructionhencehenotusedthelandforcultwatlon.

5. It js submitted that as per the directlons Issued by this Hon.ble


Court by Judgment dated 04 022015, the Revenue Divisional Officer,
ThiruvallahassoughtreportfromtheAgriculturalFieldOfficer,Thjruvallaand

6. It is respectfully submitted that in the report of the Village

Officer, Thiruvalla dated 09.04.2015, the property of the petitioner in question

is recorded as 'Paddy Lands' in the Revenue Records and js incliided in the

Draft Data Bank as .Nilam'. The Draft Data Bank for the said area ls ready for

Gazette Notification. It is also reported by the Village Officer that the land was

kept fallow for years and there ls water logging during rainy season.

7. It is submitted that there was clear contradiction in the reports

submitted by the Village Officer and the Agricultural Field Officer regarding the

entry of the land in question in the Draft Data Bank. On verification of the

connected records and the site inspection conducted by the Revenue


Divisional Officer, it is found that the land in question is a paddy land and

hence, the application filed by the petitioner under Section 6(2) of the Kerala

Land Utilisation Order is rejected on 18.04.2015,

8. It is contended by the petitioners that the land jn question is dry

land and have 30 year old plantations of various trees situated therein. This

claim is false. According to the site enquiry report submitted by the Village

Officer, Thiruvalla dated 30.01,2020, there are only two acacia trees having

around 5 years of growth in the land. The land has been kept fallow and is

covered in small bushes. Hence. this cannot be considered as plantations.

9. It is submitted that the petitioner claimed the present status of

the land comprised in Resurvey Nos.222/1 and 222/2 was "partially filled" to

the Revenue Divisional Officer dliring the hearing held on 12.03.2015. This is

incorrect. The Village Officer, Thlrwalla reported that a Stop Memo was

issued on 07.04.2016 under the Kerala Land Utilization Order and the Kera|a

Conservation of Paddy Land and Wet Land Act, 2008, when the petitioner

tried to illegally fill the 37.6 Ares in Resurvey No.222/1 and the 56.65 Ares in

Resurvey NO.222/2 by depositing around 2o loads of sand. Hence, jt is Clear

that the land remained unfiiied till 2oi6 much after the enactment Of the Act.

` T°` lt is Submitted that as perthe minutes of the meeting held on

09.11.1999 to discuss on the reiinquishment of land required for Thiruvalla

Bypass, the land owners unanimously put forth a condition that they Will

Surrender the pc>rtion coming in the alignment for 15meter wide road, if the

remaining portion of the land after surrender will not be acquired by the

Government or Housing Board or Municipality for any future development.

Further, the land owners will permit earth filling up to a width of 24meters, to

allow suitable embankment slope. Ownership of the land beyond 15 meters

will vest with the respective land owners. Accordingly, some of the land

owners filled their land fully and some filled partially. The Bypass construction

was started after the commencement of the Kerala Conservation of Paddy


Land and Wet Land Act, 2008. Since, majority of the paddy lands were

acquired and filled for the construction of Bypass, the remaining lands were

kept fallow by the land owners and no cultivation is undertaken by them, it is

better to fill up the sides of the Bypass.

Hence, there is no merit in the contentions raised by the petitioner in

the writ petition and is liable to be dismissed with cost.

All the facts stated above are true to the best of my knowledge, belief

and information.

The petitioner owns more than 1 Acre of land in

Thiruvalla Village of Thiruvalla Taluk in Pathanamthitta District.

A portion of the property of the petitioner was acquired for

constructing Bypass of the Main Central Road in Thiruvalla

Town. The petitioner would submit that while acquiring the

land, permission was granted to develop the adjacent land.

2. It is the case of the petitioner that the Municipal

Authorities dumped municipal waste in the lands adjoining the

Bypass in order to strengthen and secure the road.

Thereafter, no cultivation was conducted in the properties

adjoining the Bypass. The applications submitted by other

land owners in the area, under Section 27A of the Kerala

Conservation of Paddy Land and Wetland Act, 2008 were

allowed.

3. However, to the predicament of the petitioner, the

application submitted by the petitioner under the provisions of

the Kerala Land Utilisation Order,1967 for using the land for

non-agricultural purposes, was rejected.

4. The petitioner pointed out that in Ext.P6 Minutes,

his land was decided to be acquired on conditions. In Ext.P7,

the Revenue Divisional Officer has pointed out that the lands

acquired for construction of the Bypass are filled up and are

left fallow for long years. The petitioner further pointed out

that in Ext.P8 communication issued by the District Collector

to the Municipal Secretary of Revenue (8) Department, it was

specifically pointed out that the petitioner and similarly

situated persons have surrendered their property for the Mini

Bypass and the remaining lands are uncultivable as on date.

In view of the above, the rejection of the petitioner's

application is unsustainable, contended the counsel for the

petitioner.

5. Government Pleader entered appearance and

resisted the writ petition on behalf of the respondents. A

counter affidavit has been filed on behalf of the 3rd

respondent-Revenue Divisional Officer. The counter affidavit

justified Ext.P15 order. However, it has been stated in the

counter affidavit that some of the land owners filled their land

fully and some filled partially. The Bypass construction was

started after the commencement of the Kerala Conservation

of Paddy Land and Wetland Act, 2008. Since majority of the

paddy lands were acquired and filled for construction of

Bypass, the remaining lands were kept fallow by the land

owners and no cultivation is undertaken by them, as it is

better to fill up the sides of the Bypass.

6. I have heard the learned counsel forthe petitioner

and the learned Government Pleader representing the

respondents.

7. From the pleadings and arguments in the writ

petition, it is evident that the petitioner has surrendered a

substantial portion of his land for the development of the

Bypass. The Municipal Authorities used the adjoining lands

owned by the petitioner and the similarly situated persons for

dumping municipal waste. It appears that the authorities also

found it good to fill up the land adjoining the Bypass so as to

strengthen the Bypass Road.

8. The contention of the petitioner is that section 27A

applications submitted by other owners in the nearby areas for

changing the nature of the land in Revenue records, have

been allowed. The petitioner invoked his remedy under the

Kerala Land Utilisation Order,1967. However, the petitioner's

application stands rejected as per Ext.P15 order of the

Revenue Divisional Officer.

9. After hearing the counsel for the petitioner and the

Government Pleader, this Court finds that the petitioner has

already invoked his revisional remedy under Clause 14 of the

Kerala Land Utilisation Order,1967. Ext.P25 is the revision

petition. As the petitioner has invoked his statutory remedy, it

is just and proper that the revisional authority is directed to

consider the application in the light of Exts.P6 to P8.

The writ petition is therefore disposed of directing the

6th respondent to consider Ext.P25 revision petition filed by

appropriate orders thereon, within a period of two months.

I, Chandra Mohan, aged 65 years, S/o Krishna Pillai, Chandrima House,

Podiyadi PO, Tr.1i-uvallaThaluk, Pathanamthitta District; do hereby solemnly

affirm and state as follows:

1. I am the petitioiier in the above writ petition (Civil) No 16203 of 2020

and I am conversant with the facts of the case. As per the judgment
dated 25/10,/2022, the writ petition has been disposed of directing the 6th

respondent to cons;`1er Ext.P25 revision petition filed by the petitioner in

the light of Exts.P6 to P8 and to pass approiiriate orders thereon, within

a period of two months and the time limit is all-eady over on 25/12/2022.

It is submitted that a h =aring was conducted by the office of the Principal

Secretary to Departmei I of Agriculture at 2.30 pin on 29/03/2023 before

Smt V L Beena, Deputy .jecretary, Department of Agriculture, as per the

NOTICE NO 287/NCA 2/.`.020/AGRICULTURE Di\TED 20/03/2023 and the

petitioner had already su].mitted the facts befoi e the said authority.

Here I am authorising my advocate Mr Varghese M Easo, Advocate, High

Court of Kerala to place arguments on behalf of me before this

Honourable statutory authority.

Honourable High Court of Kerala as per the Judgment dated 25/10/2022

in WP (c) No 16203 of 2020 is clirectecl to consider the Exhibit P25

revision Petition in the light of Exhibit P6 to P8 docunnents.At the outset it

is humble submitted that the pleadings and the documents marked as

Exhibit Pl to P24 in WP (c) No 16203 of 2020 ancl also the report related

!Qm}Lproperty obtained by the agriculture officer from the KSREC are


very relevant for the proper adjudication of my petition, hence the same

mav be considered as the Dart and Darcel of this affidavit.

It may be considered the evidence from the Exhibit P6 to P8 that in the

year of 1999, the land owners of the locality including the petitioner had
surrendered their land in consensus with the government for the
development of Thiruvalla bypass on condition that they will be permitted

to fill the property up to the road level.

6. In the year of 2015 RDO Thiruvalla had submitted Exhibit p7 report to

the District Collector as per letter No 8/3152/2015 dated 01/06/2015,

recommended to grand permission to develop the land belongs to the

people including the petitioner. On the basis Exhibit P7, the District
collector had submitted the Exhibit P8 report No C2 -912/14 dated

04/06/2015 to the Government wherein recommended to grand

permission to develop the land belongs to the people including the

petitioner.
It mav be noted that the Detitioner herein had submitted the Exhibit P9

and Plo aDDlications under clause 6 of the KLU order Drior to the

enactment of amendments in the 2008 Act. The fended properties belong

to the petitioner were developed before the year of 2000 itself and there
are so many people of the locality had obtained building permit and

occupancy certificate for their building constructed in the neighboring

properties situated adjacent to the proposed project of Thiruvalla Bypass.


8. This Honourable Authority may kindly consider that the finding of the sub

Collector in Exhibit P15 is against the factual position of the property. The

same office of the Sub Collector had considered the case of a similar

property situated very near to the petitionerwas excluded from the DATA
BANK and passed the Exhibit P21 and P22 orders to regularize the BTR

documents as converted land related to the property and under Section

27A of the Paddy land Act.

9. It is humbly submitted that as per the order dated 24/08/2020 in the

above Writ Petition, the Honourable High Court directed the learned

Government Pleader to get instruction as to the basis on which the 3rd

respondent Revenue Divisional Officer has proceeded on the premise in

Exhibit P15 as if subject property is one which has been included in the

land data bank as Nilam/Paddy land. that an adjacent similarly placed

property has been given the benefit of Rule 6 (2) of the KLU order as per
Exhibit P21, but with condition to pay amount as per Section 27 A (3) etc.

The sub collector is bound to answer how the findings Exhibit P15 can

be sustained in light of Exhibit P15 and P21. Moreover it is evident from

the Exhibit P17 statement of the convenor of the LLMC that the
finding in Exhibit P15 related to the petitioner's property is discriminatory,

erroneous and arbitrary and liable to be set-aside by this Honourable

Authority.

10. This Honourable Authority may be noted that the Act, 2008 is not

intended for environmental protection as a whole. Sustaining the

ecological system contemplated by the Act, 2008 is for the purpose of

sustaining paddy land and wetland. The preamble itself permits the

restrictive coi'``version of paddy land and wet land. In the afore context,

when the competent authority considers my application, the predominant

factor for consideration should be whether the land which is sought to be

excluded from Data Bank is one where paddy cultivation is possible and

feasible. In the case of lands having any extent, the factor whether there

are proper irrigation facilities making the land suitable for paddy

cultivation would be important. Even if the land is of a comparatively

larger extent, if there are no irrigation and other requisite facilities, it

cannot be said that the land is suitable for paddy cultivation, merely

because it was once cultivated with paddy and it is described as paddy

land in revenue records.

11. This Honourable authority may considerthat, in thejudgment in salim

C.K. and another v. State of Kerala and others [2017 (1) KLT 392],

Honourable High Court held that the Data Bank that was contemplated

under the provisions of the Act, was to contain details only of cultivable

paddy land and wetland within the area of jurisdiction of the Local Level
Monitoring Committee concerned, and not intended to contain details of

any other category of land.

12. Honourable High court of Kerala in the case of Lalu p.S. v. State of

Kerala and others [2020 (5) KLT 712] considered the statutory procedure

for preparation of Data Bank contained in the Kerala Conservation of

Paddy Land and Wetland Rules and held that the Data Bank to be

prepared under the Act, 2008 is Data Bank of cultivable paddy lands
existing as on the coming into force of the Rules. The Village Officer has

to provide the Agricultural Officer particulars of the cultivable paddy lands

in the V"age in terms of the Revenue records and the Agricultural Officer

has to ins,. act those lands thereupon to ascertain whether they are

cultivable. Ir`i this case Honourable High Court further held that when the

LLMC has the ;,ower to prepare the Data Bank including the cultivable

paddy lands, c!3finitely it would have the power to look at whether the
same is suitable for cultivation and whether prospective cultivation is

feasible and whetl!er such proposition is financially viable. But in my

case the above principles were not considered by the Sub Collector.

13. Honourable High court in Joy K.K. v. Revenue Divisional officer/ Sub

Collector, Emakulam and others [2021 (1) KLT 433] held that it is not the

capabilfty of using the land that matters to treat one land as a paddy land

or not. It is only the character and fitness of the land as available on

12.08.2008 that matters, to indude or exclude a land for the Data Bank.

16. Again, in the judgment in Arthasasthra Ventures (India) LLP v. State

of Kerala and others [2022 (4) KLT Online 1222], High Court of Kerafa

held that the most relevant aspect while considering application for

excluding the property from the DATA BANK is whether the land in

question was a paddy land or a wetland when the Act, 2008 came into
force and whether the land is fit for paddy cultivation.

14. It is submitted that the properties converted mush prior to the enactment

of Kerala Conservation of Paddy Land and Wetland Act, 2008 and the

applications under KLU order 1967 were submitted before the

amendment in the said Act. But row the respondents are insisting the

petitioner to submit the application under Section 27A of Paddy land Act
which is against the legal principle laid dovvn by the Honourable High

Court in `Geo Peter Vs RDO Muvattupuzha and others', {2019 (4) KHC

400} and also in Thasildar, Thodupuzha Taluk and another v. Renjith

George [2020 (1) KHC 865 (DB)].

15. The properties comprised in survey Numbers 219-222 in Thiruvalla

VIllage are included in the COMMERCIAL ZONE marked in Blue colour in

the map of Thiruvalla Township and the same is ANNEXED HERE \/VITH.

The Annexed map is already published in the gazette and also in the

website of the Thiruvalla Municipality. Hence the petitioner has all the

rights to use his ow, landed properties for commercial cum residential

purpose as provided b\,/ the Kerala Land Utilieat.Ion order 1967. Hence this
Honourable authority may consider that the Exhibit P15 order issued by

the Sub Collector, Thiruvallais illegal, ultravires and unenforceable and

liable to be set-aside as it is against legal dictum laid down by the

Honourable High Court Kerala as well as the Honourable Supreme Court

of India, in various cases.

16. It may be noted thatthe KSREc reportwould also indicate thatthe land

was found under plantation/vegetation in the data of the year 2007. The

Revenue DMsional Officer rejected the application of the petitioner

stating that if the land is converted, it would affect paddy cultivation in

the nearby area. The Revenue DMsional Officer has accepted the said

contention of the Agricultural Field Officer in spite of the fact that there is

ample evidence to establish that the land was converted prior to the year

2008. It is evident from the Exhibit P17 statement from the convenor of

LLMC, Neither the LLMC nor the Agricultural Officer has stated that these

water chals are connected to the nearby paddy fields or that the water

chals in the petitioner's property is indispensable for irrigation of paddy

fields in the nearby area. In short, a decision has been taken by the RDO

to reject the application of the petitioner without a finding that it is

feasible and viable to cultivate the land of the petitioner with paddy. The

RDO has passed the order withiout any cogent evidence to conclude that

the water chals found in the petitioner's land are indispensable for paddy

cultivation in the nearby areas.

17. In the light of the pleadings an i document submitted before this

Honourable authority and also the legal principles laid down by the

Honourable Supreme Court of :idia and also the High Court of Kerala,

the Revision Petmon may be a Owed and may issue an order to call for

the records related to Exhibit J9 and P 10 applications submitted by the

petitioner under KLU and the ame may be allowed and issue directions
to correct the entr\/ of `wet la r'' as `dry land' in the Basic Tax Register

maintained by the l'`d responi ant related to the Exhloit Pl to P4

properties without insisting o comply the provisions of 2018


amendment in the Kerala Cor servation of Paddy land and wet land Act.

ORDER
WP(c) No.16203/2020 has been filed by Shri Chandra Mohan before the Hon'ble High
Court of Kerala. The Petitioner states that he is having 56.65 Ares of land comprising in
Re Survey No 222/2,16.19 Ares,14.38 and 20.63 Ares in Survey No 222/1 in Resurvey
Block No 219 in Thandapper 14623 in Thiruvalla VIllage of Pathananthitta district and
tlie properties are lying adjacent to the proposed bypass of the Main Central Road in
Thiruvalla municipal tour. In the year 1999 the land owners of the locality including the
petitioner had sun.endered the portion coming in the alignment for a 15 meter wide road
on the condition that the landouner will be permitted earth filling up to a width of 24
meters to allow embankment slope. This bas been recorded in the minutes of the meeting
held by the then RD0 with the landholders on 09.11.1999. The Distriet collector,
Pathanamthitta had submitted the report No. C2 -912/14 dated 04/06/2015 (Ext P8) to the
Government requesting to allow permission to develop the land belongs to the people
including the petitioner on the basis of the Kerala Paddy & Wetland Act, 2008.
2. The petitioner is now planning to construct a commercial building within his
property and applied for a possession certificate. But the present village officer stating
that the he cannot issue the possession certificate as .dry land' because of the existing
entries stated in the register related to the property as 'wet land'. The petitioner submitted
review petition dated 14.12.2020 (Ext P25) to issue directions to correct the entry of `wet
land' as `dry land' in the Basic Tax
Register without insisting to comply the provisions of 2018 amendment in the Ki`rala
Conservation of paddy land and wet land Act.
3. The Hon'ble High Cout in the judgment dated 25.10.2022 in WP(c) No.
16203/2020 filed by Shri Chandra Mohan has directed the 6th respondent Viz. Secretary,
Revenue to consider Ext.P25 revision petition filed by the petitioner in the light of Ext.P6
to P8 and pass appropriate orders thereon, within a period
of two months.
4. As authorized by the Principal Secretary, the Under Secrettry heard the petitioner
on 14. I i.2023. Based on the hearing, the District Collector was requested to furnish the
fo I lowing documents/details.

h. Whether the land held by them is reclaimed land. If so, to confirm whcthcr lhc
reclamation is being done before the introduction of the Kerala Paddy & Wetland Act,
2008.

5. The District Collector in the letter dated 07.12.2023 has informed that an extent of
52.10 Ares of land in Sy No. 222/1 and 70.80 Ares of land in Sy No. 222/2 of Thiruvalla
Village is in possession of Shri Chnadramohan. Out of this an extent of 14.50 Ares of land
in Sy No. 222/1 and 14.15 Ares of land in Sy No. 222/2 of Thiruvalla Village was
acquired for the construction of Thirvalla Bypass. The land was acquired by invoking the
provisions contained in LA Act,1894 and 4(i) Notification published in Kerala Gazette
dated 18.06.2005. The BVR was published in 11.12.2006. The land `Jaluc has been fixed
@ Rs. 29,666/- per Are. After executing sale deed the land \`'as purchased bv KSTP ii`
2007. The District Collector reported that none of the landholders has relinquished their
land for the construction of bypass and the land for the project has been acquired through
Direct Purchase by executing sale deed.
6. The District Collector in the letter dated 31.01.2024 has informed that the land
for constructing embankment slope for supporting the road has been acquired through
direct purchase by KSTP. The land in possession of the petitioner, where he js planning to
now planning to construct a commercial building is included in the data bank. Stop Memo
lias been issued by the Village Officer, Thiruvalla on 20.04.2022 for the action of the
petitioner in having dumped 20 loads of sand in his land in Sy No. 222/I. The petitioners
land in Sy No. 222/42, 222/I,2 is included in the data bank. The LLMC met on
10.03.2023 has decided to retain the petitioner land in the data bank.
7. The Hearing Officer noticed that as per sub-Section (3) of Section 5, it is clear
that the benefit of conversion of paddy land is given for the construction of residential
buildings for the owner of the paddy land alone. Section 9 of the Act. 2008 deals w'ith the
constitution of the District Level Authorized Committee. Sub-Section ( 1 ) thereto specifies
that notwithstanding anything contained in Section 3, each Collector shall constitute in the
District, a District Level Authorized Committee for considering the applications for
reclamation of paddy land for the construction of residential building to the owner of
paddy land and for taking suitable decision. However, the proviso thereto also restricts
the power of the District Level Authorized Committee that, it shall not take any decision
granting pemission for the filling up of paddy land for the construction of residential
building exceeding an extent of 4.04 Ares in a panchayat and an extent of 2.02 Ares in a
Municipality/Corporation, as the case may be.
8. The request placed by the petitioners to construct a commercial building, is
included in the data bank. By virtue of Section 9 of the Act, 2008, there will be a total
prohibition for the construction of commercial building.

been fixed @ Rs. 29,666/- per Are. After executing sale deed the land \vas purchased by
KSTP in 2007. .There was no relinquishment done and the land has beeii taken bv
payment of coinpensation to the landholder.
10. Govt` have examined the matter in detail and the Ext.P25 revision petition
(I.eview petition dated 14.12.2020) to correct the entry of `wet land' as `dry land' in the
Basic Tax Register without insisting to comply the provisions of 2018 amendment in the
Kerala Conservation of Paddy land and wet land Act) is rejected on the following
grounds:
a. The argument that in the year 1999 the land o\vners of the locality including the
petitioner had surrendered the portion coming in the alignment for a 15 meter wide road
on the condition that the landowner will be perritted earth filling up to a width of 24
meters to allow embankment slope, which is recorded in the minutes of the meeting held
by the then RDO with the landholders on 09.11.19q9, is totally false. There was no
relinquishment done and the land has been taken by payment of compensation to the
landholder.
b. The request placed by the petitioners to construct a commercial building, is
inclndcd in tile data `oank. By virtue of Section 9 of the Act, 2008` there will be a total
prohit)ition for the construction of commercial building.
c. The land in possession of the petitioner, where he is plarming to construct a
commercial building is included in the data bank. Stop Memo has been issued by the
Village Officer, Thiruvalla on 20.04.2022 for the action of the petitioner in having
dumped 20 loads of sand in his land in Sy No. 222/1.
d. The LLMC met on 10.03.2023 has decided to retain the petitioner land in the
data bank.
I I. The judgment dated 25/10/2022 of the Hon'ble High Court in WP(c) No.
16203/2020 filed by Shri Chandra Mohan is hereby complied with.
