(hereinafter collectively called as the “Mortgagors” which term shall


always mean and include his/her respective legal heirs, executors, agents,
administrators, successors-in-office and assigns ) of the ONE PART;

branches at Ahmednagar (hereinafter referred to as “Mortgagee” which
expression shall unless the context otherwise requires include its
successors and assigns) of the OTHER PART

The terms and expressions of MORTGAGOR and the MORTGAGEE,


unless repugnant to the meaning or the context hereof, shall mean and
include them, their respective legal representatives, successors,
administrators, nominees and assigns.
Whereas, the Mortgagor herein, is the sole/joint and absolute owner/s of
immovable property bearing

All that consisting properties (A) S.No. 108/A1/6/1/5, area adm. 376.85
Sq.m. and construction made thereon having built up area 694.96 sq.m.
situated at Chahurana Bk. Tal. & Dist. Ahilyanagar, (B) S.No.
108/A1/6/1/3 Part, adm. 0.07.00 Sq.m. out of that 29.00 Sq.m. situated at
Chahurana Bk. Tal. & Dist. Ahilyanagar

Whereas, the said property was Owned & Possessed by Mr. Sanket Nandu
Agarkar and Heman Bajirao Pokale as per Sale Deed registered at Doc.
No. 1322/2023 on 23/02/2023 at Ahmednagar

WHEREAS, the Mortgagor(s) has/have approached Mortgagee and


requested Mortgagee to advance a loan for development of his/their business
by executing necessary loan agreements/documents and the Mortgagee
acceding to the request of Mortgagor(s) has agreed to advance to the
Mortgagor(s) a loan of Rs. 70,00,000/- (Rupees Seventy Lacks Only)
which the Mortgagee has agreed to do on the Mortgagor executing these
presents with a view to secure the repayment of the above said loan granted /
to be granted by the Mortgagee together with interest(s), costs, other charges
and also for all other liability inclusive of interest etc., whatsoever becoming
due under or in relation to the above said Loan.

NOW THIS DEED WITNESSETH THAT:

1. Pursuant to the said agreement and in consideration of the


sum of Rs. 70,00,000/- (Rupees Seventy Lakh Only) lent and advanced
by the Mortgagee to the Mortgagor on the execution of these presents,
the receipt whereof the Mortgagor hereby acknowledge and confirm
2. The Mortgagor both hereby agree with the Mortgagee
that the Mortgagor will repay the said amount along with interest
(18-6.00 spread)= @12% p.a. And 180 Equated monthly installment
each of Rs. 84,012/-

3. The first of such installment of repayment shall become


due on or before the expiry of one month from the date of disbursement
of loan and subsequently each installment shall be due in each
succeeding month till the entire amount of loan along with interest and
charges are paid in full.

4. The Mortgagor further covenants with the Mortgagee that


in the event of the Mortgagor failing to pay any EMIs, he will be liable to
interest on the said installment in default at the rate of 36% from the date
of default until payment such installment.

5. Without prejudice to the right of the Mortgagee to take


any action on default as herein under provided, and it is agreed and
declared that in the event of Mortgagor committing default in payment of
any EMI or committing breach of any other term of this deed, the whole
amount of principal then due with interest thereon will at the option of
the Mortgagee become payable forthwith as if the said date had expired.

6. And this deed further witness that in consideration


aforesaid, the Mortgagor hereby mortgage the scheduled property
situated at village Chahurana Bk. Tal. & Dist. Ahilyanagar and
described in the schedule here under written as a security for repayment
of the said sum with interest and all other moneys due and payable here
under with a condition that on the Mortgagor repaying the said principal
sum of Rs. 70,00,000/-( Forty Seventy Lakh Only) with all interest
and other moneys due to the Mortgagee (hereinafter referred to as the
Mortgage amount) the Mortgagee will redeem the said scheduled
property from the mortgage security and shall if so required by the
Mortgagor execute a deed of Release but at the costs of the Mortgagor.

7. It is further agreed that during the pendency of the


security hereby created and until repayment of the mortgage amount the
Mortgagor will get insured and keep insured the buildings and structures
standing on the said land against loss and damages due to fire or any
other accident in the sum of at least Nil with an Insurance Company of
repute and pay all premium n the insurance policy as and when it
becomes due and payable in respect thereof to such company and shall
hand over the policy to the Mortgagee duly endorsed in his name as
assignee
8. In the event of the Mortgagor failing to do insure or keep
the property insured or to fails to pay the premium, the Mortgagee will be
entitled to insure the said buildings and structures and/or to pay the
premium thereon and the amount paid by the Mortgagee in respect
thereof will be deemed to form part of the mortgage amount.

9. It is further agreed and declared by the Mortgagor that in


the event of the Mortgagor failing to pay the said principal sum with all
interest and other moneys when the same shall become due and payable
under these presents, the Mortgagee will become entitled to have the said
scheduled property sold through any competent court and to realise and
receive the said mortgage amount out of the net sale proceeds of the said
scheduled property.

10. It is further agreed and declared by the Mortgagor that he


shall also be liable to pay and shall pay all the costs, charges and
expenses that the Mortgagee will incur for the protection of the mortgage
security and or for the realisation of the mortgage amount and the same
shall be deemed to form part of the mortgage amount and the security
therefor as aforesaid.

11. In case the proceeds of sale, together with the amount, if


any, otherwise realized from the mortgagor fall short of the total amount
due to the mortgagee then the mortgagee shall be entitled to recover the
balance from the person and other properties of the mortgagor.

12. It is further agreed that in the event of the said scheduled


property being destroyed or damaged by fire or any accident as
aforesaid, the Mortgagee will be entitled to receive the insurance claim
under such policy to the exclusion of the Mortgagor and to appropriate
the same first towards all arrears of interest and then the principal
amount or as any part thereof as may be sufficient to pay the mortgage
amount due and if any surplus remains the same only will become
payable to Mortgagor.

13. The mortgagor shall allow the mortgagee its servants,


agents and surveyors at all reasonable times to enter the said premises
and view and examine the state and condition thereof
14. The mortgagor hereby convents with the mortgagee that
the mortgaged property is free from all or any encumbrances including
court order or attachment or acquisition proceedings and shall not sell,
gift, exchange, mortgage or alienate in any other manner nor shall assign
his/her/their interest in the said property of whatsoever nature, nor shall
create any charge or encumbrance on the said property during the
subsistence of the mortgage.

15. The mortgagor undertake to pay all the tax, dues cesses
and outgoings in respect of the mortgagor property regularly and
punctually and produce the receipts thereof to the mortgagee for
verification and record.

16. The mortgagor undertake that he/she/they will deposit


with the mortgagee all the original documents of the mortgaged property.

17. The mortgagor undertakes that he/she/they will bear all


expenses such as stamp duty, advocate fees, registration charges and
other incidental expenses in connection with this deed.

18. The mortgagor agrees that if he/she/they commits in


making the payments of installment then the mortgagee shall be entitled
to call back the entire amount of balance with interest then due and in
that case the mortgagor will have to make the payment forthwith and will
not be entitled to claim the benefit of concession of installment or
waiver from payment of additional interest.

19. It is agreed by and between the parties that the said


property/properties is to stand as a continuing security for the credit
limit/loan sanctioned by the mortgagee to the borrower/mortgagor and it
will be enforceable for all monies which may at any time become due
and owing by the borrower/mortgagor to the mortgagee/lender under the
said credit account and/or all other accounts, was after expiry of the
period.
