Анотація
В статті розглядається проблема юрисдикції Міжнародного Суду ООН щодо позову, який готується Україною проти Російської Федерації у зв’язку з подіями 2014 року. Докладно досліджуються можливості встановлення юрисдикції ratione materiae, ratione personae, ratione loci та ratione temporis. На підставі аналізу практики Міжнародного Суду ООН робиться висновок про можливість доведення наявності юрисдикції Суду у спорі.

Аннотация
В статье рассматривается проблема юрисдикции Международного Суда ООН относительно иска, который готовится Украиной против Российской Федерации в связи с событиями 2014 года. Детально исследуются возможности установления юрисдикции ratione materiae, ratione personae, ratione loci и ratione temporis. На основании анализа практики Международного Суда ООН делается вывод о возможности доказывания существования юрисдикции Суда в споре.

Annotation
The article considers the problem of jurisdiction of the International Court of Justice concerning an application prepared by Ukraine against the Russian Federation with regards to the 2014 events. It includes a detailed analysis of jurisdiction ratione materiae, ratione personae, ratione loci and ratione temporis. Based on the practice of the ICJ, the author concludes that jurisdiction of the Court can be established in the case.

La conducta procesal de las partes ha sido un tema de importancia fundamental en los estudios del Derecho procesal. Establecer cuál conducta es la adecuada dentro de un debate no es tarea fácil y los ordenamientos jurídicos, la doctrina y la jurisprudencia  se preocupan por descubrir la línea divisoria que existe entre la conducta permitida y aquella que no lo es.
El libro que el lector tiene en sus manos desarrolla este complejo tema, con propuestas de solución. Un análisis histórico y comparado permitirá entender los problemas que las normas sobre buena fe procesal, lealtad y probidad, cooperación procesal y/o abuso procesal, comportan, avanzando ideas para un mejor entendimiento, aplicación y – por qué no – posibles reformas de normas procesales.
El lector se dará cuenta que la expresión que se utiliza para desarrollar el tema es “corrección procesal”, con intenciones de redefinir el fenómeno de la conducta procesal de las partes. Según afirmamos: “…hacemos referencia a la expresión “corrección procesal” para describir el fenómeno de la conducta adecuada de los sujetos procesales, y que preferimos frente a otras expresiones como buena fe, moralidad procesal, cooperación procesal, lealtad y probidad, pues aquella –que consideramos no tiene cargas emotivas ni transplanta valoraciones axiológicas– nos parece una expresión neutra y adecuada para una redefinición, mientras que las últimas consideramos, generan perplejidades, tanto lingüísticas como pragmáticas”.
La identificación y aplicación de la moralidad/buena fe/abuso del derecho está condicionada por los contextos normativos de aplicación. En cuanto respecta al proceso - principio de corrección procesal – podemos encontrar pautas o variables necesarias para su empleo racional y coherente, en miras a la no afectación de derechos y garantías procesales de las partes, pero a su vez cuidando los recursos que insume el proceso, así como su eficacia y celeridad, o el respeto entre los sujetos procesales que debe prevalecer en este método que llamamos proceso, pero además no permitiendo que el instrumento que sirve para resolver conflictos intersubjetivos de intereses se emplee para causar daños injustos.
Siguiendo el consejo de J. M.ª MARTÍNEZ VAL “vivamos el pleito como lo que es: una batalla por un derecho concreto, en que las fintas distraen, pero no resuelven; vivámoslo con vigilancia a la forma y la más profunda atención al fondo y al objetivo final, que es lo que importa”.

It can often be heard that international judiciary is insufficiently developed, and more importantly, that it is not mandatory, but optional. In this regard it could be pointed out that the international community doesn`t have centralized judicial system; that countries could become subjects of international court`s jurisdiction, only if they explicitly agree to it, etc.
However, time in which we live is the time of accelarated, general globalization, and it led to significant changes in all spheres of life, including this one. Generally speaking, even nowdays the international judiciary is optional, although in the meantime certain major changes have happened.
That is quite understandable bearing in mind the fact that there is a growing number of main subjects of the international law-countries and international oragnizations; that some new subjects of the international law were made, and they led to certain new kind of international disputes etc.
Large number and diversity of international courts suggests that it would be advisable to make certain divisions and place them into appropriate categories in order to understand them better. At the same time it is an opportunity to present not only the most important but also some less known but for some reason particularly interesting international courts.
Accordingly, the paper represents an attempt to point out some of the most interesting divisions or kinds of international courts (universal and regional; courts for the settlement of disputes and ( penalty) criminal courts; courts of general jurisdiction and specialized courts; courts for states and others; institunationalized international courts and selected courts  (arbitrations); permanent and temporary courts; international courts in the right sense of the word and mixed courts, etc. Within these, further divisions were made.
Bearing in mind that international courts have developed incredibly both by the number and the type, in organizational sense and in connection with the role they have in the international community, author in the concluding discussion points out some specific problems and perspectives of international judiciary.
