Environmental Migrant

ABSTRACT This paper analyses, and responds to, one aspect of perceived failures of social and environmental accounting to make societies more sustainable. First, we argue that Charles Taylor’s concept of moral sources can articulate part of the ‘motivational gap’ between social and environmental accounts and sustainability. A moral source is an ideal that inspires people to enact their beliefs. Without a compelling moral source, social and environmental accounts may increase people’s knowledge of sustainability issues without changing their behaviour. Second, we use religion to illustrate the type of moral source that social accounting might mobilise. Drawing on Pope Francis’ encyclical Laudato Si': On Care for Our Common Home (2015), we outline how moral sources can clarify what sustainable action requires and help commit people to these actions. Third, we apply this religious moral source to social and environmental accounting research into climate change-induced migration. Our paper does not argue that religion in general, or Catholic texts in particular, are the only moral sources accounting research could use. Rather, we use this religious discourse to illustrate the potential value of more directly linking social and environmental accounting to ‘moral sources’ that perform a comparable role in motivating sustainable social practice.

The thesis examines the phenomenon of environmental migration, which has been representing a moot issue worldwide since the second half of the last century. In fact, climate change has progressively become a source of serious concern, involving, among the push factors that provoke the displacement, natural catastrophes, desertification, glacier zone retreating, sea-level raise, etc, due both to human activity and natural action. In this light, future numerical predictions amount to 150 millions of climate-related migrants in 2050, fleeing from Africa, America, Asia, and Pacific Islands. Since an agreed definition of “environmental migrants” is still missing, and fundamental human rights, such as the right to life, health, food, water, self-determination, and housing, are jeopardised, there is evidence of a lack of protection. In order to fill it, this work analyses the existing legal instruments, aimed to cover similar categories of persons through a comparison between theories that support the inclusion of climatic migrants under the universal 1951 Geneva Convention relating to the Status of Refugees, regional refugee instruments, or the Guiding Principles on Internal Displacement, and theories that exclude it. Moreover, the dissertation considers the hypothesis of a recognition under the UNHCR mandate, the creation of a new ad hoc Convention, or principles. The conclusions highlight the exclusion of environmental migrants under existing legal instruments, the relevance of a coordination between universal and local approach, as well as the effectiveness of the response entailing the creation of a new specific Convention. However, in the current international context, it is likely that States would only agree on a mere soft law instrument.

Environmental refugees" are non-conventional refugees and forced migrants, internally or internationally, temporarily or permanently, in a situation of vulnerability, and that are forced to leave their homes for environmental reasons, of slow or rapid onset, caused by natural or anthropogenic reasons, or a combination of both. Although there is no specific recognition and protection to these migrants under international law on a global scale, some regional legal instruments and national laws recognize and protect them. The main argument of this doctoral thesis is that "environmental refugees" are under general protection in certain areas of international law and that the current and future possibilities for specific protection can be found in the primary sources of international law, referred to in Article 38(1) of the Statute of the International Court of Justice. Seven protective pathways for "environmental refugees" were identified in international law and in domestic law: by means of (i) humanitarian action, (ii) complementary protection, (iii) national law, (iv) climate justice, (v) shared responsibility, (vi) judicialization of "environmental asylum", and (vii) the international treaty. It is also suggested that a comprehensive global environmental migration governance be established, based on international regimes and by action of actors at local, national, regional and international levels, for the implementation of the forms of protection and to meet the needs of "environmental refugees" worldwide.

The increasingly felt results of climate change have sparked concerns about the lacking legal protection of persons fleeing environmental degradation or natural disasters. Based on the assumption that such “environmental refugees” exist and deserve protection, the present study identifies the gaps in the existing legal framework and examines the merits of proposed protection regimes. In the light the features of existing law and relevant state practice, it will become clear that the internal aspect of environmental displacement should be addressed separately from its cross-border dimension. Furthermore, this analysis shows that many legal and not only practical reasons militate against an extension of the Refugee Convention. Among other interesting proposals based on human rights or environmental law, a multilateral temporary protection regime would be the most effective response to the collective flight of high numbers of environmentally displaced persons. Such a regime would be flexible enough to provide durable solutions and to negotiate an equitable burden sharing, while representing an attractive option for States, who are likely to refuse unforeseeable legal commitments.

Abgesehen davon wird das Denken als eine äußerst private und individuelle Angelegenheit betrachtet. »Die Gedanken sind frei«, das ist ein Diktum, das in diesem Sinne verstanden wird. Niemand hat Zugriff auf meine Gedanken, es sei nicht möglich, die Gedanken anderer zu lesen etc. Das wird häufig vorgebracht, außer in jenen Shows, die geradezu den besten Gedankenleser küren wollen. Aber selbst dort wird von der Voraussetzung ausgegangen, dass das Prozedere des Denkens oder die Gedankenproduktion, wenn man so will, zunächst von isolierten Subjekten vollzogen wird. Es ist dann nur die Frage, wie es sich mit der Unzugänglichkeit bzw. angeblichen Zugänglichkeit verhält. Für unsere Zwecke geht es nun nicht darum, die Kontexte zu konstruieren, in welchen es sinnvoll und angebracht sein kann, sich der erwähnten Ausdrucksweisen zu bedienen. Und das ist zugleich auch ein erster wichtiger Punkt bei Wittgenstein. Er macht uns nämlich darauf aufmerksam, dass es Situationen geben kann, bei welchen es nicht erklärungsbedürftig ist, zu sagen, dass der Ort des Denkens in unserem Kopf sei. Es käme aber darauf an, die

nach dem Prinzip der Einzelbefunddokumentation vorgenommen. Die gesamte Grabungsstelle wurde flächig nach anthropogenen Schichten abgearbeitet. Diese Ausgrabungs-und Dokumentationsmethode wird in Berlin und Brandenburg im Hinblick auf die Klärung der für die mittelalterliche Siedlungsgenese relevanten Fragen und bezüglich ihres Potentials bei der Erfassung archäologischer Befundzusammenhänge deutlich unterschätzt. Bei dieser Methode führen nicht Zufallsfunde zu Ergebnissen, sondern die flächendeckende, systematische Erschließung der vorhandenen Stratigraphie. Wenn Spuren im Boden hinterlassen wurden, wird man sie mit dieser Methode auch detektieren. Und Spuren gibt es zuhauf, sie sind häufig nur nicht umgehend lesbar. Alle Befunde am Petriplatz wurden in ihrer relativen Chronologie zueinander erfasst. Diese relativchronologische Abfolge der Ereignisse wurde in einer Harris-Matrix graphisch dargestellt. Alle geborgenen Funde und Kleinfunde, alle dendrochronologischen Datierungen und weitere Probenergebnisse können in die Harris-Matrix eingepflegt werden, um sie bezüglich ihrer relativchronologischen Aussage zu plazieren. Die Harris-Matrix wurde auch für die gezielte Einreichung von Laborproben genutzt. Für die frühesten Siedlungsbefunde vom Petriplatz wurden die Ergebnisse der Keramik-und Kleinfunddatierungen in die relative Chronologie eingearbeitet. Dabei zeigte es sich, dass einige Befunde ohne Funde oder mit sehr geringem Fundaufkommen stratigraphische Schlüsselpositionen einnahmen. Da für diese Befunde mit Hilfe der Funde keine oder keine zuverlässige Datierung zu erzielen war, wurden Laboruntersuchungen ( 14 C bzw. AMS) veranlasst, um auf diesem Wege eine absolut chronologische Einordnung zu erzielen. Da am Petriplatz aus jedem relevanten Befund eine Bodenprobe entnommen wurde, steht ein umfangreiches Probenarchiv zur Verfügung, welches für diese Zwecke ausgebeutet werden kann. Für die Forschung zur frühen Siedlung Cölln sind vor allem die Befunde der ersten Besiedlungsphase und der älteste Friedhof der St.-Petri-Kirche relevant. A critical evaluation of the contribution of interviews to the study of climate and environmental migrations in Northern Africa. (LSE MSc: MY405/MY505: Research Methods for Evaluation in Health, Development and Public Policy Assessed Essay Example)

Cette présentation a pour objectif de montrer que la recherche qualitative en science politique permet de donner la parole aux communautés impactées par les changements climatiques anthropiques. En particulier, nous constatons une incohérence entre les discours de migrations institutionnalisées et promues comme accroissant la résilience des communautés, et les réalités vécues dans des contextes de déplacements circulaires et économiques. L'exemple de la République de Kiribati et ses partenariats avec l'Australie et la Nouvelle-Zélande illustre les insuffisances des programmes de migrations, soutenus par les institutions internationales, créés pour importer de la main d'oeuvre dans des secteurs ruraux inadaptés et basés sur des rapports de force inégaux entre états et entre communautés. Identifier les réalités des communautés soumises à ces migrations peut informer de nouvelles politiques de protection adaptées et contextualisées aux besoins spécifiques des communautés vulnérables et illuminer les déficiences institutionnelles de leur protection.

This article examines the relationship between rainfall-related events and trends, livelihood and food security and migration in rural upland communities in Thailand. This study was conducted as one of eight case studies within the framework of the 'Where the Rain Falls' Project. This article is based on empirical research in four villages in the Province Lamphun, Northern Thailand. The households' livelihood in the research area is characterized by a high level of on and off-farm diversification and integration into national and global market structures. Migration-internal as well as international-is widespread. Based on the data gathered in a multi-method field-based research design, the study observed that while households are exposed to various rainfall related stressors, such as the extreme rainfall in 2011 which resulted in heavy floods in the Central Plains of Thailand, migration is not considered as a primary coping and risk mitigation strategy. Environmental factors are furthermore not the primary explanatory factor for pattern of mobility. The study highlights the complex relationship between environmental factors including rainfall and migration beyond determinism notions of environmental migration. This study points out that while migration might not be caused by rainfall-related events and trends, through migration induced translocal connectedness, the social resilience of exposed households and communities can be strengthened.

In The International Legal Status and Protection of Environmentally-Displaced Persons: A European Perspective, Hélène Ragheboom addresses the topical issue of displacement caused by environmental factors and analyses in particular whether affected persons, who are unable or unwilling to return to their country of origin due to the severe degradation of their living environment, could or, in the negative, should receive some form of international protection within the European Union. The author provides a detailed analysis of relevant instruments of refugee law and international human rights law, and explores possible future approaches to addressing the phenomenon of environmental displacement, ranging from constructive interpretations of existing norms to the allegedly preferable creation of a multidisciplinary sui generis framework.
