    AFFIDAVIT OF ADVERSE CLAIM

    We,

    MARIA LUISA ANESLAGON DUENAS, of legal age, Pilipino, married


    and residence of Basak, Lapulapu City;

    ROBERT S. ANESLAGON of legal age, Pilipino and residence of


    Campanga Barili Cebu;

    CAYETANO ANESLAGON, of legal age, Pilipino and residence of


    Lower Bicutan,Taguig, Manila;

    ALLAN ANESLAGON , of legal age, Pilipino and residence of Basak,


    Lapulapu city; and

    LUVISMINDA ANESLAGON BERCES of legal age, Pilipino and


    residence of Balud San Fernando, Cebu,

    after having been sworn to in accordance with law, depose and say:

    1. That we are the children of the late LUIS ANESLAGON SR. who
    died in Panama City, state of Florida, U.S.A., on April 18, 1979;

    2. That lately we found out that our late father, LUIS ANESLAGON
    SR. at the time of his death left a real property situated in Tayud,
    Consolacion Cebu containing an area of SIX HUNDRED NINETY ONE
    (691)SQUARE METERS bounded by NORTH: LOT 72; by EAST: LOT 67;
    SOUTH: BRGY ROAD and WEST: BRGY ROAD covered with Tax Dec. no.
    GR -12-18-24845.

    3. That at first we are not aware that our late father owned the said
    described property since nobody told us about it, until one day somebody
    informed us about the said property.
    4. That LUVISMINDA ANESLAGON BERCES who is one of our sister
    went to the office of municipal assessor of Consolacion Cebu to inquire
    about the status of the said property;

    5. That it was found out that the above described property really
    owned by our late father LUIS ANESLAGON SR., declared in his name,
    hereto attached is the copy of tax dec. no. GR -12-18-24845. Marked as
    Annex A.

    6. That however the said property was illegally transferred thru


    fraud using falsified EXTRA JUDICIAL SETTLEMENT AND SALE to certain
    CATALINO M. BASAKA AND ISABEL BASAKA, hereto attached is the copy
    of the new Tax dec. no. 34885.

    7. That the basis of illegal transfer of the ownership of said lot to


    CATALINO M. BASAKA is the alleged EXTRA JUDICIAL SETTLEMENT AND
    SALE dated May 31st 1978;

    8. That the said EXTRA JUDICIAL SETTLEMENT AND SALE is a


    falsified, fraudulent, and manufactured documents, because we did not
    signed the said EXTRA JUDICIAL SETTLEMENT AND SALE, hence all the
    signatures in the said documents are all forgeries or falsified.

    9. In fact the name of our sister LUVISMINDA ANESLAGON is not


    included in the said document as heirs of our late father, what was
    included is certain MINDA S. ANESLAGON.

    10. That the name of CAYETANO ANESLAGON who is our brother


    also not included in the said documents

    11. That because of the illegal act of CATALINO BASAKA who


    successfully transfer the said property to his name, we are deprive to
    what is due to us, as the legitimate heirs of the late LUIS ANESLAGON SR.

    11. That in order to protect our right , we are now requesting for
    the annotation of this adverse claim over the lot 1402 with OCT-OP 41333
    with tax dec. no. 19-0011-20103.
    12. That we are executing this Affidavit in support of my request for
    the annotation of an adverse claim over the parcel of land described
    herein.

    FURTHER AFFIANT SAYETH NAUGHT.
