HOMEOWNERS ASSOCIATION
RESOLUTION NO. ___ SERIES OF 20XX
NON-LIFTING OF BOOM BARRIER
FOR DELINQUENT HOMEOWNERS
WHEREAS, Section 7 of Republic Act No. 9904, otherwise known as the
“Magna Carta for Homeowners and Homeowners’ Associations” provides that an association member has full rights, among others, to avail of and enjoy all basic community services and the use of common areas and facilities;
WHEREAS, however, Section 8 of the same law provides that such rights entail corresponding obligations, one of which is the payment of monthly dues;
WHEREAS, Section 13, Rule 3, of the Implementing Rules and
Regulations of R.A. No. 9904 provides that “unless otherwise provided in the bylaws, a member who has failed to pay three (3) cumulative monthly dues or membership fees, or other charges/assessment despite demands by the association, or has repeatedly violated the association’s bylaws and/or declared policies, may be declared delinquent by the Board of Directors.”
WHEREAS, Sections 15 and 16 of the said IRR provides that the
declaration of delinquency by the Board will result in suspension of the rights and privileges of the concerned member, and other sanctions as may be provided in the bylaws of the association;
WHEREAS, in view of these, all delinquent homeowners, upon entry into
or exit from the subdivision, shall not be assisted by the guard/s on duty in raising the boom barrier installed at the gate of the subdivision until they pay in full their unpaid monthly dues.
NOW, THEREFORE, BE IT RESOLVED, AS IT IS HEREBY
RESOLVED, that all delinquent homeowners shall not be assisted by the guard/s on duty in raising the boom barrier installed at the gate of the subdivision until they pay in full their unpaid monthly dues to the Association.
