AN ACT ORGANIZING THE BARANGAY ECOLOGICAL SOLID WASTE


MANAGEMENT COMMITTEE (BESWMC) OF BARANGAY NAMAYAN

WHEREAS, Section 389 (b) (9) provides that, for efficient, effective and
economical governance, the purpose of which is the general welfare of the Barangay
and its inhabitants pursuant to Section 16 of the Local Government Code of 1991, the
Punong Barangay shall enforce laws and regulations relating to pollution control and
protection of the environment;

WHEREAS, Section 6 and 7 of IRR of RA 9003 provide the creation of Barangay


Solid Waste Management Committee and its functions and responsibilities;

WHEREAS, Section 10 of RA 9003 stipulates that segregation and collection of


solid waste shall be conducted at the barangay level specifically for biodegradable,
compostable and reusable wastes;

WHEREAS, DILG Memorandum Circular No. 1996-119 dated June 27, 1996
enjoining all Provinces, cities, Municipalities and Barangays to adopt a comprehensive
Solid Waste Management System;

WHEREAS, DILG Memorandum Circular No. 2000-117 dated August 2000


provides the implementation of Zero-waste Management;

WHEREAS, DILG Memorandum Circular No. 2001-38 dated April 10, 2011
provides the creation of Ecological Solid Waste Management Committee (ESWMC) at
the barangay level;

WHEREAS, DILG Memorandum Circular No. 2009-168 dated October 27, 2009
provides the strict implementation of Section 17(H) and 32 of RA 9003 knows as the
Solid Waste Management Act of 2000;

WHEREAS, for the implementation and enforcement of the provisions of the RA


9003 will be achieved through the creation of the BESWMC and to update them on their
duties and functions to RA 9003, and other related policies, laws and issuances.

NOW THEREFORE, in view of the foregoing, WE, the members of the Namayan
Barangay Council, by the powers vested in us as elected officials of Barangay
Namayan, hereby promulgates Resolution no. _____, as follows:

I. Creation of the Barangay Ecological Solid Waste Management Committee


(BEWSMC)

The Barangay Ecological Solid Waste Management Committee (BESWMC-


Namayan) is hereby established. It shall guide, control and regulate the
generation of solid wastes within the Barangay and promote an orderly and
sanitary system for the same.

II. Composition of the BESWMC-Namayan

III. Functions of the BESWMC-Namayan

1. Formulate a community solid waste management program consistent with that of


the municipality;

2. Be responsible for the segregation and collection of solid waste specifically for
biodegradable, compostable and usable waste;

3. Establish within the barangay or cluster of this barangay a Material Recovery


Facility (MRF), a redemption eco centers in the barangay owned or leased land
or any suitable open space to be determined by the Sangguniang Barangay;

4. Allocate funds for the barangay ecological solid waste management program, approved
by the Sangguniang Barangay;

5. Organize a Core Area/ Street Coordinators to assist BESWMC in the implementation of


their programs and activities;

6. Conduct trainings for barangay residents on segregating, composting, recycling and
livelihood opportunities from use of recyclable waste and to monitor their
implementation;

7. Integrate the Ecological Solid Waste Management Program in the Barangay


Development Plan (BDP) and/or Annual Investment Plan (AIP);

8. Find alternative sources of funds other than the regular barangay budget; and

9. Submit a monthly report to the Municipal ESMC on the progress of the program, copy
furnished local DILG office.

All resolutions or parts thereof that are inconsistent herewith are hereby modified or
repealed accordingly.

The guidelines set in this resolution shall take effect immediately.
