WHEREAS, Section 3 of Rule XVII of the IRR of R.A. No. 9003 provides that, “The
Barangay may impose fees for collection and segregation of biodegradable, compostable
and reusable wastes from households, commerce, other sources of domestic wastes, and for
the use of Barangay MRFs. The computation of the fees shall be established by the
respective SWM boards. The manner of collection of the fees shall be dependent on the
style of administration of respective Barangay Councils. However, all transactions shall
follow the Commission on Audit rules on collection of fees
WHEREAS, Section 1 of Rule XI of the IRR of R.A No. 9003 Barangays shall be
responsible for the collection, segregation, recycling of biodegradable, recyclable,
compostable and reusable wastes. MRFs will be established in every barangay or cluster of
barangays.
WHEREAS, Section I of Rule II Paragraph (d) of the IRR of R.A 9003 Ensure the
proper segregation, collection, transport, storage, treatment and disposal of solid waste
through the formulation and adoption of the best environmental practices in ecological
waste management excluding incineration;
WHEREAS, Section 4 of Rule VI of the IRR of R.A 9003 LGUs may assist the
barangay either financially, technically or in any other manner deemed necessary in order
to achieve the waste diversion goal of section 20 of the Act. Provided that within 45261
days of the effectivity of the IRRs, the Liga Ng Mga Barangay shall assess and thereby
determine, those barangays requiring assistance from their respective LGUs. The LNB
shall subsequently inform the respective LSWMBs of its findings.
WHEREAS, The 1987 constitution provides that, “The State shall protect and
advance the right of the people to a balanced and healthful ecology in accord with the
rhythm and harmony of nature”
Section 1. Title -
Section 2. Coverage - The ordinance shall apply to all residential houses, commercial
and industrial establishments, institutions, like schools, churches, public and private
offices, other establishment of any kind and agricultural areas within Barangay Poblacion.
Section 4. Mandatory Segregation of Solid Waste – The segregation of solid waste shall
be mandatory. Segregation shall primarily be conducted at the source to include
household, institutional, industrial, commercial and agricultural sources.
Section 6. Categories of Solid Waste – Solid waste shall be segregated into the following
categories:
a) Compostable or Biodegradable
b) Recyclable
c) Residual
d) Special Waste
Section 7. Requirements for Segregation and Storage of Solid Waste– The sources of
solid waste as listed above shall have separate receptacles or containers (i.e. sacks, bins,
boxes, cans, bags, etc.) for each type of solid waste. Solid waste shall be properly marked or
identified for on-site collection as “compostable”, “recyclable”, “residual” or “special waste”
and properly sealed or tied for easy handling and collection. The receptacles shall be
properly covered, secured or protected to prevent spillage or scattering of the waste and to
ensure its containment.
Section 8. Guidelines -The minimum requirements prescribed in RA 9003 and its IRR
shall likewise be complied with. Waste generators from the households, institutions,
commercial and industrial areas shall ensure that segregated solid wastes are brought out
in front of their gates/doors and or along the collection route of the collection vehicle
during the designated schedule for collection of the particular type of solid waste. The
information on collection of solid waste such as the schedule, types of waste to be
collected and other relevant information shall be disseminated by the Solid Waste
Management Committee (assigned)
Section 10. Storage - All wastes for collection must be stored in properly sealed/tied
receptacles and brought outside households, institutions, commercial and industrial
establishments and other sources during collection time only. Otherwise, the presence of
these wastes outside of the scheduled collection time will be considered as a violation of
the anti-littering provision of this Ordinance.
Section 11. Transport - The collected biodegradable and recyclable wastes shall be
dropped off at the Barangay MRF. Only the residual and special waste shall be brought to
the disposal site.
Section 12. Collection Vehicles - Only collection vehicles covered with nets, tarpaulins or
other similar material shall be allowed to transport solid waste from the collection area to
the disposal facility. To ensure proper maintenance and to avoid unnecessary breakdowns
that eventually disrupt the collection system, collection trucks shall undergo regular
cleaning and maintenance.
Section 13 Training and Equipment - All personnel directly involved with the collection
of solid waste shall be provided with the necessary training to ensure proper handling and
management of waste. Personal protective equipment and paraphernalia such us gloves,
masks and safety boots shall also be provided to protect them from health hazards posed
by handling solid wastes
Section 15. Incineration or open burning of solid waste shall be strictly prohibited.
Section 17. Collection of Solid waste fees - The solid waste fees shall be paid to the
barangay kagawad or barangay treasurer, as the case may be, immediately upon collection
of the garbage/solid waste by the Barangay Tanod in-charge.
Section 18. Payment first policy – Failure to pay the amount provided for in section __
immediately disentitles a person from availing the garbage collection service.
Section 19. Solid Waste fee – The amount of 10 pesos shall be collected for every sack
of garbage gathered, regardless of the size and volume of the sack.
