CALL TO ORDER

Mayor Ervin called the June 12, 2023 regular meeting of Florence City Council to order at 1:00 p.m.

INVOCATION

Mayor Ervin gave the invocation for the meeting. The pledge of allegiance to the American Flag followed
the invocation .

APPROVAL OF MINUTES

Counc,i]woman NeSmith-Jackson made a motion to adopt th e minutP.s of the April 24, 2023 work session
and the May 8, 2023 regular meeting and Councilman Braddock seconded the motion. The minutes were
unanimously adopted.

Bill No. 2023-25 - First Reading


An Ordinance to repeal and replace portions of Sections 3-2, 3-7, and 3-11 of the Code of
Ordinances of the City of Florence entitled "Definitions", "Public Nuisance", "DangerousNicious
Animal Enforcement", and other matters relating thereto.

Resolution No. 2023-34


A Resolution of Recognition for the contributions of Divine Acts of Kindness in the City of
Florence.

There are two addendums to the agenda for Council's consideration . Councilwoman NeSmith-Jackson
made a motion to add Bill No. 2023 -25 and Resolution No. 2023-34 to the June 12, 2023 agenda and
Councilman Braddock seconded the motion.

Council voted unanimously to add Bill No. 2023-25 and Resolution No. 2023-34 to the June 12, 2023
agenda for the regular meeting of City Council.

PUBLIC HEARING

A Public Hearing will be held to receive input on the City of Florence Fiscal Year Budget 2023-
2024.

Mayor Ervi n opened the public hearing at 1 :03pm. Being no one to speak, Mayor Ervin closed the public
hearing at 1:03pm .

APPEARANCES BEFORE COUNCIL

Dr. Yolonda Echols

Dr. Yolonda Echols appeared before Council to introduce the Beacon Of Light Institute for Veterans. The
mission for the Beacon Of Light is to help women and men who have served or are currently serving in
the military and enhancing the quality oflife for veterans. Dr. Echols spoke of an upcoming free
community event to celebrate veterans and first and emergency responders.

Dr. John Bruce and Ms. Jayne Boswell

Dr. John Bruce and Ms. Jayne Boswell appeared before Council to request consideration of a
strengthened dog ordinance to protect against dangerous dogs. Dr. Bruce spoke of an incident that
occurred approximately one year ago in which small dog was killed by large dogs. An investigation was
completed by the police department and the owner of the large dogs was given a verbal warning.
Following this incident, the dogs frequently escaped their yard and ran after adults and children. Every
time this happens, the owner is fined only $100. Dr. Bruce stated the City's laws are too weak and asked
that the Richland County ordinance be looked at. He also said an animal control officer must be given
more power to assist police and asked that the City consider licensing people that breed pets for sale.
Licensing fees could potentially be used to fund a spay and neuter clinic.

Ms. Jayne Boswell said overpopulation of animals has become a state and na•:onal crisis that has resulted
from the lack of licensing and spay/neuter laws and it is an opportune time for Florence to address these
concerns.

Mayor Ervin said many of the concerns shared will be addressed in Bill No. 2023-25 scheduled for first
reading today. While this bill is just being introduced, it will be ongoing and continued to be looked at for
future enhancement.

Pro tern Jebaily asked Ms. Boswell if she has had the opportunity to look at the proposed ordinance, to
which she replied she has not. Pro tern Jebaily asked staff to share the proposed ordinance with Ms.
Boswell, as her review and input would be beneficial. Although first reading is occurring at the meeting
today, amendments can be made prior to second reading.

Mr. Carl Schleg

Mr. Carl Schleg appeared before Council and to request consideration of speed bumps on Park Avenue.
Mr. Schleg said Park Avenue is too dangerous and drivers frequently speed.

Reverend Marvin Hemingway, Chairperson - Pee Dee Youth Initiative

Reverend Hemingway appeared before Council to speak on Pee Dee Youth Day. Reverend Hemingway
announced the first annual Pee Dee Youth Day initiative scheduled July 8, 2023 at the Barnes Street
Activity Center and the City Center Farmers Market. The theme for this year's event is "Focus on your
Future".

Mrs. Mindy Taylor, District Manager - Duke Energy

Mrs. Mindy Taylor appeared before Council to present to the City of Florence the Duke Energy
Emergency Preparedness and Storm Resiliency Grant. The Duke Energy Foundation provided $500,000
of grants to thirty-two organizations across the state to support their emergency preparedness efforts.
Mrs. Taylor presented the City of Florence with a $20,000 grant to help purchase emergency equipment.

ORDINANCES IN POSITION

Bill No. 2023-17 - Second Reading


An Ordinance authorizing the City to extend the lease on the real estate known as 228 West
Darlington Street and designated as Florence County Tax Map Parcel 90086-02-004 to Pee Dee
Regional Transportation Authority under the terms and conditions set out in the written lease
attached as Exhibit A to this Ordinance.

Pro tern Jebaily made a motion to adopt Bill No. 2023 -17 on second reading and Councilwoman Barnes
seconded the motion.

Councilwoman NeSmith-Jackson asked what is in the storage area that is being released to the PDRTA
and Mr. Randy Osterman, City Manager, said nothing. The City is not in need of this storage space and it
would be much better utilized by the PDRTA.

Council voted unanimously (7-0) in favor of the motion . Bill No. 2023-17 was adopted.

Bill No. 2023-18 - Secon~ Reading


An Ordinance to annex and zone 136 Wilson Road, identified as Florence County Tax Map
Number 90097-01-022.

Councilman McCall made a motion to adopt Bil l No. 2023 - 18 on second reading and Pro tern Jebaily
seconded the motion .

Council voted unanimously (7-0) in favor of the motion . Bill No. 2023 - 18 was adopted.

Bill No. 2023-19 - Second Reading


An Ordinance to adopt the City of Florence 2020 Comprehensive Plan and the City of Florence
2020 Downtown Masterplan.

Pro tern Jebaily made a motion to adopt Bill No. 2023-19 on second reading and Councilwoman Barnes
seconded the motion.

Council voted unanimously (7-0) in favor of the motion . Bill No . 2023 - 19 was adopted.

INTRODUCTION OF ORDINANCES

Bill No. 2023-21 - First Reading


An Ordinance to raise revenue and adopt a budget for the City of Florence, South Carolina, for the
Fiscal Year beginning July 1, 2023 and ending June 30, 2024.

Councilwoman NeSmith-Jackson made a motion to pass Bill No. 2023-2 l on first reading and
Councilwoman Barnes seconded the motion .

Mr. Kevin Rawlinson, Chief F inancial Officer, reported the total proposed budget is $115 ,246,530 with
the general fund being the largest. There is a proposed 5 mil increase in the budget which will increase the
current millage of 63 .1 mils to 68. l mils.

Mr. Rawlinson went over revenue and expenditure highlights of the general fund. General fund revenues
total $48,661 ,500 with property taxes and business licenses being approximately 60% of the total
revenues. The budget is balanced so expenditures also total $48,661 ,500.

Pro tern Jebaily made a motion to amend the proposed budget, specifically the community programs
section, in light of the changes made to the Community Development Block Grant (CDBG) budget at last
month ' s meeting and decrease funding for No One Unsheltered (NOU) Homeless Programs by $6,200
(from $75,000 to $68,800), Florence Family Support Center by $5 ,800 (from $8,800 to $3 ,000), and M y
Brother' s Keeper by $10,000 (from $20,000 to $10,000) and utilize these monies to provide funding in
the amount of $15 ,000 for G-Lab, $5 ,800 for the Leathem13n Senior Center, and $1,200 for Helping
Florence F lourish . NOU will receive $25,000 and My Brother' s Keeper will receive $20,000 from the
City' s CDBG budget.

Council voted unanimously (7-0) on the amendment.

Councilwoman NeSmith-Jackson made a motion to pass Bill No. 2023 -21, as amended, on first reading
and Councilwoman Barnes seconded the motion. Council voted unanimously (7-0) in favor of the
motion. Bill No. 2023 -21 was passed on first reading, as amended.

Bill No. 2023-22 - First Reading


An Ordinance to amend Article IV of Chapter 2 specifically Section 2-206 of the City of Florence
Code of Ordinances amending the designated areas to include the East Palmetto Corridor within
municipal limits.

Pro tern Jebaily made a motion to pass Bill No. 2023 -22 on first reading and Councilwoman NeSmith-
Jackson seconded the motion.

Mr. Clint Moore, Ass istant City Manager of Development, reported the proposed Ordinance will create a
mechanism for incentives to faci litate the improvement of the East Palmetto Street corridor. The
boundaries of the corridor will be the parcels abutting the right of way along East Palmetto Street from
South Church Street to Old Mars Bluff Road and are limited to the properties within the City limits. The
grant will only be available for commercial development and the threshold investment established is at
least $5 ,000 and a maximum of $20,000 in which the owner will have to match the funding.

Mayor Pro tern spoke of the importance of all the C ity's gateways and he said he hopes this continues
with all the other gateways into Florence. Councilman McCall also spoke of the importance of the
gateways. He thanked staff for bringing this forward and asked for consideration for other corridors as
well , particularly the Highway 52 corridor.

Co unci l voted unanimously (7-0) in favor of the motion. Bill No. 2023-22 was passed on first reading.

Bill No. 2023-23 - First Reading


An Ordinance to annex Phase IV of The Grove at Ebenezer, identified as a portion of Florence
County Tax Map Number 00075-01-221.

Councilwoman NeSmith-Jackson made a motion to pass Bill No. 2023-23 on first reading and
Counci lwoman Barnes seconded the motion.

Mr. Moore said this annexation is part of the development agreement with the deve loper of The Grove in
which the agreement requires annexation of the property prior to development.

There was discussion regarding the extensivn of the Florence Rail Trail. A sidewalk connector will brihg
the trail to the corner of Ebenezer and Pine Needles. The City is closing on the property to extend the
trail in the next several months, at which point the trail wi ll continue and connect to the Soccer Complex.

Bill No. 2023-24 - First Reading


An Ordinance to amend Section 8-3 of the City of Florence Code of Ordinances to allow fireworks
on private property on July 4-5 and December 31-January 1 in the City of Florence.

Councilwoman NeSmith-Jackson made a motion to pass Bill No. 2023-24 on first reading and
Councilman McCall seconded the motion.

Mr. Scotty Davis, Deputy City Manager, repo1ted the City currently does not allow fireworks in the City
limits. The proposed Ordinance will fireworks on private property from lO:OOam on July 4th to 12:30am
on July 5th and 1O:OOam on December 3 pt to 12:30am on January pt .

Council voted unanimously in favor of the motion. Bill No. 2023-24 was passed on first reading.

Bill No. 2023-25 - First Reading


An Ordinance to repeal and replace portions of Sections 3-2, 3-7, and 3-11 of the Code of
Ordinances of the City of Florence entitled "Definitions", "Public Nuisance", "DangerousNicious
Animal Enforcement", and other matters relating thereto.

Councilwoman NeSmith-Jackson made a motion to pass Bi ll No. 2023-25 on first reading and
Counc ilman Braddock seconded the motion .

Mr. Ben Zeigler, City Attorney, reported the proposed ordinance des ires to address issues surrounding
dangerous dogs and how to balance the concerns of public safety and enforcement w ithout it being
burdensome to own pets. Mr. Zeigler summarized the changes of the proposed ord inance. Section 3-2
defines " dangerous animals" in code and the proposed ordinance will clarify w hat constitutes a dangerous
anim al and lowers the threshold for what declares an animal dangerous. A provision has also been added
to address pack-like behavior among dogs and a new provision that declares a dog as dangero us by
chasing. Section 3-7 addresses " public nuisance" and the proposed ord inance makes c larifications on
impoundment and repeated offenses. Also proposed within this secti on is a strengthened fine structure.
Section 3-11 pertains to "dangerous/v icious animal enforcement" and the proposed ordinance includes
affinnati ve requirements for dangerous animals regarding thei r enclosures and more authority has been
given to animal control and the fin es appli cable to dangerous animals were increased.

Councilman McCal I asked what the difference is between a C lass III officer and the he ighted
respon sibilities for the animal control officer. Mr. Osterman said a C lass Ill Officer has more law
enforcement capability. Current animal control officers have some investigatory authority but not the law
enforcement abi lities. Mr. Ostennan said there has been discussion to move the anima l control officers to
the pol ice department to serve as C lass III officers, but they sti II have to work th rough some logistics.

Counc ilman Smith asked how the proposed fines line up with other municipalities. Mr. Zeig ler said the
fines are on par, but he can do some more research. Whi le other municipa lities may impose larger fines,
admin istrative fines for municipalities are lim ited to $500 by the state.

Pro tem Jebaily inquired on communi cations with th-:- cou nty with this ordinance, as they have also been
working to amend their dog ord inance and it would be ideal for there to be compatibility. Mr. Zeiger said
County Counc ilman Schofi e ld has requested a copy of the ord inance once passed . Coun cilman Braddock
also said they were trying to work through the ordinance with the county ' s conc urrently, but they decided
the city needed to move fo rward instead of waiting for the county ' s ordinance to pass.

INTRODUCTION OF RESOLUTIONS

Resolution No. 2023-31


A Resolution of Recognition for the accomplishments of Jolette Law.

Councilman Smith made a motion to adopt Resolution No. 2023 -31 and Councilwoman Barnes seconded
the motion .

Pro tern Jebaily made a motion to amend the Resolution to name the championship court at the Pearl
Moore Basketball Gymnasium the Jolette Law Championship Court and Councilman McCall seconded
the motion. Council voted unanimously in favor of the amendment.

Councilman Smith presented the Resolution to Ms. Jolette Law. Ms. Law said it gives her great honor to
represent the City of Florence.

Several Council members spoke and congratulated Ms . Law for her many accomplishments.

Council voted unanimously (7-0) to adopt Resolution No. 2023-31 , as amended .

Resolution No. 2023-32


A Resolution to proclaim June 19-25, 2023 as National Pollinator Week in the City of Florence.

Councilman McCall made a motion to adopt Resolution No. 2023 -32 and Pro tern Jebaily seconded the
motion.

Council voted unanimously (7-0) in favor of the motion. Resolution No. 2023-32 was adopted.

Resolution No. 2023-33


A Resolution to proclaim June as Homeownership Month in the City of Florence.

Councilwoman NeSmith-Jackson made a motion to adopt Resolution No. 2023 -33 and Councilwoman
Barnes seconded the motion.

Mayor Ervin presented the Resolution to representatives of the Pee Dee Realtor Association.

Council voted unanimously (7-0) in favor of the motion. Resolution No. 2023-33 was adopted.

Resolution No. 2023-34


A Resolution of Recognition for the contributions of Divine Acts of Kindness in the City of
Florence.

Councilman McCall made a motion to adopt Resolution No. 2023-34 and Councilwoman NeSmith-
_r'.1ckson seconded the motion.

Councilwoman NeSmith-Jackson presented the Resolution to Ms. Gloria CL Jones, founder of Divine
Acts of Kindness and thanked her for her many contributions to the community.

REPORTS TO COUNCIL

Appointments to Boards and Commissions

Mr. Davis presented the packet of appointments to Boards and Com mi ss ions to Counc il.

Florence Center Commission

Councilwoman Barnes deferred her nomination to this board.

Housing Authority

Mayor Ervin deferred her nomination to this board.

Councilman McCall inquired on the status of the recent removal of a member of the Housing Authority .
Mr. Davis said that individual intends to appeal Council 's decision for removal and her seat cannot be
filled until the appeal process has been completed. Mr. Zeigler said the appeal has been filed as a
complaint in circuit cou1t and they are currently researching the best way to respond to the complaint.
Councilwoman NeSmith-Jackson asked if there was a way to expedite the process to which Mr. Zeig ler
responded they will like ly fil e a motion to dispose based on what was presented.

MAYORAL REPORT

Mayor Erv in encouraged the public to visit the C ity of F lorence website as well as the C ity's social medi a
pages to stay up to date with C ity news. She also spoke of the groundbreaking for AESC and
acknowledged the passing of Deacon Swinton.

COMMITTEE REPORTS

Business Development Committee, Chaired by Pro tern Jebaily

Pro tern Jebaily said the Committee took a tour of the Carolina Theater at their last meeting and he spoke
of the impacts thi s project will have on downtown. Pro tern Jebaily asked Mr. Moore to provide an
update of the bid and the renovations of the theater. Mr. Moore said renovations will bring the building
up to date and repair damage that has occurred over the years. Bids were received last week; however, the
estimated cost of construction has increased since the bonds were taken in 2019. Due to the impacts of
increased construction costs, staff will meet with the architectural consultants to come up with a plan to
bring the project back on budget. Pro tern Jebaily said they a lso received an update on water and sewer
utility projects and stormwater projects are ongoing. Project Urban Square is currently underway w ith the
construction of the parking garage.

Councilwoman NeSmith-Jackson spoke of the communication survey the City is conducting and asked
residents to complete the survey. She also spoke of a series of awareness campaigns and a Council
spot Iight series. She gave praise to the recent Yard of the Month winner.

Finance, Audit and Budget Committee, Chaired by Councilman McCall

Councilman McCall said the Committee reviewed the monthly fin ancial statements and discussed the
budget and mileage increase. The City is growing and is robust and that is reflected in the proposed
budget. Councilman McCall said they also discussed the employee cost of liv ing increase of 8% to be
implemented January 1, 2024.

Pro tem Jeba ily reminded everyone that the Local Options Sales Tax almost reduces the net impact of the
mileage increase by almost half.

Mayor Ervin said Council will be entering into Executive Session for a discussion of matters re lated to a
proposed economic development project within an overlay district and a personnel matter.

An Ordinance to raise revenue and adopt a budget for the City of Florence, South Carolina, for the

Councilwoman NeSmith-Jackson made a motion to adopt Bill No. 2023-21 on second reading and
Councilman Braddock seconded the motion.

SPECIAL MEETING - JUNE 20, 2023

Mr. Kevin Rawlinson , Chief Financial Officer, reported the total budget for all funds is unchanged at
$115,246,530. An amendment was made at first reading for the disbursement of community programs.

Pro tem Jebaily said a request came in today from the airport regarding funding and he distributed the
request letter to Council. (A copy of this letter is attached to and made part of these minutes.) Over the
past couple years, the airport has been utilizing CARES funding to embark on a significant marketing
campaign; however, those funds will not be available after December 31, 2023 . The airport has requested
$20,000 to assist in continuing their marketing efforts in 2024. Pro tern Jebaily made a motion to amend
the budget to add an extra $20,000 expenditure to go towards the Pee Dee Regional Airport from the fund
balance to assist the airport in their marketing efforts in their 2024 budget year. Councilwoman Barnes
seconded the motion.

Mayor Ervin expressed concern with this request coming in at this late date post budget considerations.
She asked the airport commission to be mindful of due dates when requesting funding from the City.
Council voted unanimously (7-0) in favor of the amendment.

Bill No. 2023-24 - Second Reading


An Ordinance to amend Section 8-3 of the City of Florence Code of Ordinances to allow fireworks
on private property on July 4-5 and December 31-January 1 in the City of Florence.

Councilman Braddock made a motion to adopt Bill No. 2023-24 on second reading and Councilwoman
NeSmith-Jackson seconded the motion.

Council voted unanimously (7-0) i11 favor of the motion. Bill No. 2023-24 was adopted .

2023 WATER AND SEWER REVENUE BOND WORKSHOP

Mr. Randy Osterman, City Manager, said there has been ongoing discussion regarding the need to
upgrade the water treatment plant, the wastewater treatment plant and other infrastructure. At the
workshop today, these projects and funding mechanisms will be discussed.

Mr. Michael Hemingway, Utility Planning and Economic Development Director, said the City is seeing a
lot of growth and with that growth comes a cost. The City will need to have revenues in place to handle
current capacities in place as well as future growth. In the 10-year, 2020 rate plan, the goals and
objectives were to pay down debt, build cash reserves, tackle the Jeffries Creek Project.and increase
annual operation and maintenance projects within the annual budget. Also included in the 2020 rate plan
was to begin planning an expansion of the surface water plant and the wastewater facility and to
decommission the Timmonsville wastewater plant in 2028. However, the Envi sion/AESC project was
announced in the summer of 2022. The development of AESC has three potential phases of growth. If
all three phases are to occur, AESC will use approximately 3.3 million gallons of water and 2.9 million
gallons of sewer per day. The industrial park which will house AESC is also planned for additional
growth; therefore, the capacity increases for both treatment plants must be able to serve the entire park
buildout and not just AESC . Mr. Hemingway then spoke of general growth in and around the City. The
proposal also includes s:·stem-wide water and sewer upgrades within its service area. The known
permitted development to occur in the near future alone will put the surface water treatment plant over
capacity and the wastewater treatment plant near capacity. The proposed ex pansion will increase the
water treatment plant' s capacity to 20 million gallons per day and allows excess for future growth.

Pro tern Jebaily expressed concern on the timeline. Mr. Hemingway said the City moved forward and
work began on the water treatment plant des ign last year. Presently, the City is half way finished with the
expansion design of the surface water facility. The proposed revenue bonds will be going before Council
for consideration over the next couple months. If approved, the City will then have the financing and
funding in place to move forward with the projects. Construction at surface w~ter will begin next year
and is expected to be completed by December 2026. Mr. Hemingway clarified that the City's cuITent
capacity should be sufficient for the next 4-5 years. The proposed expansions will place the C ity into
excess capacity that will be able to meet the needs of future economic development prospects. The
expansion will increase its capacity to 20 million gallons per day and set up to expand to 30 million
gallons per day. Also proposed is an expansion of the wastewater treatment plant from 22 million gallons
per day to 33 million gallons per day and it is the hopes that this design will be complete by next year as
well.

Councilman Braddock asked if there is anything in the proposed bond to mitigate present issues citizens
are facing regarding sewer and water quality. Mr. Hemingway said the Jefferies Creek sewer project is
ongoing with hopes to finish that design later this year. Mr. Hemingway also spoke of annual
maintenance to the elevated tanks, the water treatment plant and groundwater treatment plants that a ll
assist to improve water quality.

Cou ncilman Smith inquired on the capacities necessary for this area. Mr. Hemingway spoke of
wastewater first. Once the wastewater fac ility reaches 80% capacity, DHEC requires that a performance
engineering report be completed. At 90% capacity, DHEC requires that construction begin to increase
capacity or a moratori um will be placed until capacities get below 90%. He spoke of water production
next, saying the City produces water from both groundwater and surface water and they are utilized based
on the demands of the system. The surface water plant is typica lly producing base line flow and
groundwater is producing peak flow on a daily basis.

Mr. Walter Go ldsm ith and Ms. Amy Vitner with First Tryon Adv isors presented an overview of the water
and sewer revenue bonds to Council. The topics for discussion at this workshop are upcom ing projects,
assumptions for future system operations, proposed rate increases and impacts on financial projections.

Capital needs have grown sign ificantly since the last rate study in 2020. The total cost of al 1 projects is
approx imately $450 million to be paid off over a 30-year tim e span, and it is proposed to phase these
borrowings over several years. The first bond issuance would total $33,500,000 , the second being
$ 183,000,000 and the third being $230,000,000. It is also anticipated that fundin g in the amount of $9 1
million will come from other sources such as the South Carolina Rural Infrastructure Authority (SCRIA),
the Economic Development Administration (EDA), or the State Revolving Fund (SRF).

Mr. Goldsmith went over the proposed rate increases. These proposed increases will allow the City to
meet minimum target metrics that stay in line with rating agency expectations and its peers around the
state. When the 2020 water and sewer rate study was conducted, water rates were expected to increase 2%
and sewer expected to increase 3% per year. The proposed new rates are expected to be a 9-10% increase
each year until 2028, at which point they are anticipated to return to back to the annual increases of 2-3%
once the higher debt levels are absorbed into the budget. Florence's current rates are average among other
cities in South Carolina. Mr. Goldsmith said he expects Florence to remain average even after the new
proposed increases and keeping rates affordable is important when attracting new industries to F lorence .
Mr. Goldsm ith went over the financin g calendar fo r the first issuance of the bonds with the proposed
closing date bei ng September 27, 2023 .

Councilwoman NeSmith-Jackson asked if the C ity will use some of the days cash on hand monies to
lower the interest. Ms. Vitner responded that $50 million of cash is being used to downsize the third
issuance of the bond and they can look at the reserve with the second ; however, there is no plan to utili ze
cash on hand reserves for the first issuance.

Councilman Braddock spoke of bond fati gue and inquired as to whether Counc il wi ll approve all the bond
issuances at once or with each issuance. Mr. Ben Zeigler, C ity Attorney, said they could approve all three
issues at once but they way these bonds are structured it may be best to approve them separately as they
move through the process. Ms. V itner also spoke, saying the first two bond issues were originally
combined, but the chal lenge was not knowing the cost of the surface water treatment plant and not
knowing if the City w ill acquire other funding mechani sms to ass ist in the projects. The two issues were
separated in order to move fo rward with the more immediate projects.

Pro tern Jeba ily asked if the C ity will be in a better pos ition to leverage fo r additiona l grant fund ing once
the first bond issuance is secured. Mr. Osterman spoke, saying he can' t be sure the bond will he lp when it
comes to matching grant monies. However, the bond wi ll secure funding fo r these larger projects which
wi ll allow the City the ability to proceed with some smaller projects through grant or loan agencies. Pro
tern Jebaily also inquired on the revenues that are projected to be generated from AESC and Mr.
Osterman said they are expected to contribute $2 .6 milli on in reven ues ann ua lly whi ch w ill go toward s
the payment of these bonds.

Councilwoman NeSmith-Jackson asked if a feasibility study has been completed. Mr. Goldsmith said as
part of the bond issue the City will conduct a financial feasibility study, which is a third-party analysis
conducted by Willdan Financial Services. Drafts of the feasibility study will be available as first and
second reading of the bond ordinance come before Council. The final feasibility study will be completed
just as the bonds are being sold . The feasibility study being completed will be for the entirety of the
project.

The Pee Dee Regional Airport, DBA Florence Regional Airport, is requesting Twenty Thousand Dollafs
($20,000.00) to assist the Airport with ourr marketing efforts in 2024. I am suire you aire aware that
having an airport with commercial flights has a large economic impact for the City of Florence, and our
entire Pee Dee area. Many companies make dedsions on placement of new lorcations based on
transportation availability. Florence is at the intersection of Interstates 20 and 95, and we have a
comme rcial airport, making Florence an ideal location for new business. However, we need to draw
more people to our ai.rport to continue to have commercial service, and a markreting campaign is thre way
for us to accomplish this goal. In 2022 and 2023 the Airport was able to embark on a significant
marketing campaign using CARIES funding, but those funds will not be available aftieir December 31, 2023.

Considering our ongoing successes with this marketing campaign, we are seeking funding from the City
of Florence and others in anticipation of formulating our 2024 budget, whirch begins on January 1, 2024.

is being made by the property owner, The Grove at Ebenezer, LLC.

II. CURRENT STATUS/PREVIOUS ACTION TAKEN:


( 1) On May 9, 2016, City Council adopted Ordinance 2016-17 entering into a development agreement
(signed by all parties August 23 , 2016) with the developer of "The Grove at Ebenezer" and
established the zoning of the property as PDD, pending annexation. The development agreement
requires annexation of the property prior to development activity.
(2) Public hearings were held on April 12, 2016 and May 9, 2016 regarding the zoning and
development agreement.

III. POINTS TO CONSIDER:


(1) This request is being considered for first reading.
(2) The lot is currently vacant.
(3) The intended development for the tract is 74 single family residential lots.
(4) City water service is currently available; sewer service will be extended by the developer from
the adjacent parcel per the approved development agreement dated August 23, 2016.
(5) The subdivision of the property will be reviewed by the City of Florence Planning Commission
under sketch plan review, followed by development plan review.
(6) City Staff recommends annexation and zoning of the property to (PDD) Planned Development
District.

WHEREAS, a Public Hearing was held in the Council Chambers on April 12, 2016 at 6:00 P.M. before
the City of Florence Planning Commission and notice of said hearing was duly given;

WHEREAS, the second of two Public Hearings was held in the Council Chambers on May 9, 2016 at
1:00 P.M. before the City of Florence City Council and notice of said hearing was duly
given;

WHEREAS, application by The Grove at Ebenezer, LLC, owner ofTMN 00075-01-221, was presented
requesting an amendment to the City of Florence Zoning Atlas that the aforesaid property
be incorporated in the city limits of the City of Florence under the provisions of Section 5-
3-150(3) of the 1976 Code of Laws of South Carolina and adding the zoning district
classification of (PDD) Planned Development District:

The property requesting annexation is shown more specifically on Florence County Tax Map 00075,

WHEREAS, the City of Florence (the "City") has persistent issues with the breeding of
dogs for the purpose of fighting; and

WHEREAS, dogs bred for the purpose of fighting have frequently escaped their owners;
control and formed independent packs that roam public spaces; and

WHEREAS, the City Council of the City ("City Council") enacted an ordinance now
codified in the Code of Ordinances of the City (the "Code") as Sec. 3-2 defining a
"Dangerous/vicious animal"; and

WHEREAS, City Council desires to repeal and replace the definition of


"Dangerous/vicious animal" in Sec. 3-2 in order better to regulate and control packs of dogs from
posing a danger to the residents of the City; and

WHEREAS, City Council desires to repeal and replace Sec. 3-7 in order better to define
"public nuisance" and regulate and control "dangerous/vicious animal" from posing a danger to
the residents of the City;

WHEREAS, City Council enacted an ordinance now codified in the Code in Sec. 3-11 (c)
which specifically addresses dangerous/vicious animal enforcement; and

WHEREAS, City Council desires to repeal and replace Sec. 3-11 (c) and (d) in order better
to regulate and control packs of dogs from posing a danger to the residents of the City.

NOW, THEREFORE, BE IT ORDAINED by the City Council of the City of Florence in


meeting duly assembled that:

a. The definition of "Dangerous/vicious animal" in section 3-2 of the Code is hereby repealed
and replaced with the definition of "Dangerous animal" on the attached Exhibit A.

b. Code Section 3-7 is hereby repealed and replaced with 3-7 on the attached Exhibit B.

c. Code Section 3-11 (c) and (d) are hereby repealed and replaced with 3-11 (c-h) on the
attached Exhibit C.

d. This Ordinance shall become effective upon its approval and adoption by the City Council
of the City of Florence.

EXHIBIT A

Sec. 3-2. - Definitions.

Dangerous animal: Any animal of the canine, feline, or wild animal family:

(1) Which the owner knows or reasonably should know (because of prior complaints,
training, or attacks) has a propensity, tendency, or disposition to attack unprovoked
resulting in bodily injury to a human being or another domestic animal or livestock in
a place other than where the animal is confined; or

(2) Which makes an unprovoked attack that causes bodily injury to a human being or
domestic animal and the attack occurs in a place other than the place where the animal
is confined. For the purposes of this section, "unprovoked" shall mean the victim who
conducted themselves peacefully and lawfully was bitten, approached, or chased in a
menacing fashion, or attacked without provocation of the animal; or

(3) Which engages in pack-like behavior such as roaming unleashed and non-muzzled in
a group consisting of three (3) or more animals.

(4) Which is owned or harbored primarily or in part for the purpose of fighting or which
is trained for fighting.

(5) Which has, when Unprovoked, chased or approached a person on the streets, sidewalks,
or any public place or property in a menacing fashion or reasonably apparent attitude
of attack, provided that such actions are attested to in a sworn statement by one or more
persons and investigated by the ACO.

(6) "dangerous animal" does not include:


a. An animal used exclusively for agricultural purposes; or
b. An animal which attacks a person who is trespassing or who appears to be
trespassing. A trespasser is a person who is not lawfully upon the premises of the
owner.
c. An animal that is leashed, harnessed, or otherwise under the direct control of a
person as a service animal as demonstrated to the satisfaction of the ACO and/or is
protecting its owner as to the satisfaction of the ACO.

EXHIBIT B

Sec. 3-7. - Public nuisance.

(a) Actions of any animal, including cats, dogs, or other nonregulated animal or fowl,
constitute a nuisance when an animal disturbs the rights of, threatens the safety of, or
damages a member of the general public, or interferes with ordinary use and enjoyment of
their property. No person shall own, keep, possess, or maintain an animal in such a manner
so as to constitute a public nuisance. By way of example, and not of limitation, the
following acts or actions by an owner or possessor of any animal are hereby declared to be
a public nuisance and are, therefore, unlawful:

(1) Allowing or permitting an animal to damage the property of anyone other than its
owner.

(2) Maintaining an animal that is diseased and dangerous to the public health.

(3) Maintaining an animal that habitually or repeatedly chases, snaps at, or attacks
pedestrians, bicycles, or vehicles, or any animal whose behavior constitutes a
reasonable risk of injuring a human or other animal.

(4) Any animal that runs at large upon public or private property without permission from
the property owner.

(5) Any animal that defecates on public or private property, other than the property of the
owner, unless the owner immediately removes and properly disposes of the waste.

(6) Failure to remove animal fecal matter such that adjacent property owners or inhabitants
are unable to enjoy the use of his or her property due to the odor or smell.

(7) Any animal(s) which causes unsanitary or dangerous conditions to exist.

(8) Any feral animal.

(9) Allowing or permitting an animal to bark, howl, or whine in an excessive, continuous,


untimely, or unreasonable fashion, or to make other noise in such a manner so as to
result in annoyance or interference with the reasonable use and enjoyment of
neighboring premises.

(b) Upon receipt of a verbal or written complaint by a resident of the city, in addition to, or in
lieu of impounding the animal, the ACO or other law enforcement officer shall investigate
the complaint and may issue to the owner, if known, of such animal, a notice of ordinance
violation. If the owner is not known or cannot be found, the ACO or other law enforcement
officer shall post a copy of the notice at the property where the animal was seized. The
owner shall be charged with an administrative fine and shall pay such fine to the shelter
within seven (7) days from the date of the issuance.

(c) Any animal, which has been determined to be a recurring or continuing public nuisance by
the shelter supervisor or designee, may be impounded and shall not be returned to the owner
until said owner can produce evidence to demonstrate that the situation creating the
nuisance has been abated and until such owner has paid all impoundment, redemption, and
boarding fees. The right to impound such animal shall be a means of enforcing this
ordinance available to the animal shelter supervisor, the ACO or other law enforcement
officer separate and distinct from the administrative fines that may be imposed hereunder.

(d) In cases of multiple violations of this ordinance by different animals owned, harbored, or
under the control of a single individual, family, group, or association, such violations shall
be deemed to have been committed by the same animal for the purposes of the enforcement
of this ordinance.

(e) Any person violating any provision of this section shall be subject to an administrative fine.
Each day's violation of any provision of this section shall constitute a separate offense and
shall be subject to a fine as follows:

(1) First offense: Fifty dollar ($50.00) administrative fine. A first offense is the violation
of this article by any and all dogs owned or harbored by a person and extend for a
period of twelve (12) months. Future violations (second, third, and subsequent
offenses) shall be from the date of the most recent offense violation and extend for a
period of twelve (12) months. At the end of this twelve-month period, if no other
offences to Sec. 3-7 occur, a subsequent offense shall be considered a first offense
violation.

(2) Second offense: Seventy-five ($75.00) administrative fine extend for a period of twelve
(12) months.

(3) Third and subsequent offenses: One hundred ($100.00) administrative fine,
imprisonment not exceeding thirty (30) days, or both; extend for a period of twelve
(12) months.

Sec. 3-11. - Dangerous animal enforcement.

(c) Precautions against animals deemed dangerous animals.

(1) When an animal deemed a dangerous animal by the animal shelter supervisor, ACO,
and or law enforcement officer(s), it shall be unlawful for the owner or harborer to:

(A) Leave such. animal unattended on the owner's real property unless the animal
is confined indoors, in a securely enclosed and locked pen, or in another
structure designed to restrain the animal. Any secure enclosure or locked
pen shall be constructed in such a manner that a dog cannot escape by means
of digging under or jumping over the enclosure or pen, or otherwise becoming
free unless freed by the owner; or

(B) Permit such animal to go beyond the owner's real property unless the animal is
leashed and muzzled or is otherwise securely restrained and muzzled. Voice
command is not recognized as secure restraint under this article.

(2) An animal that is deemed a dangerous animal and subsequently found at large alone or
in a pack or group is subject to immediate impoundment by the animal shelter
supervisor, ACO, and or law enforcement officer(s) and shall be impounded for not
less than five (5) days at the owner's expense. If all reasonable attempts to seize such
animal are unsuccessful, the animal shelter supervisor, ACO, and or police
department may humanely tranquilize and seize the animal, without prior notice to
the owner. The right to impound such animal shall be a means of enforcing this
ordinance available to the animal shelter supervisor, the ACO or other law enforcement
officer separate and distinct from the administrative fines that may be imposed
hereunder.

(3) Any person violating precautions against dangerous animals shall be subject to an
additional administrative fine. Each day's violation of any provision of this section shall
constitute a separate offense and shall be subject to a fine as follows:

(A) First offense: One hundred dollar ($100.00) administrative fine. A first offense is
the violation of this article by any and all dogs owned or harbored by a person and
extend for a period of twelve (12) months. Future violations (second, third, and
subsequent offenses) shall be from the date of the most recent offense violation and
extend for a period or twelve (12) months. At the end of this twelve-month period,
if no other offences to Sec. 3-11 occur, a subsequent offense shall be considered a
first offense violation.

(B) Second offense: Two hundred dollar ($200.00) administrative fine extend for a
period of twelve (12) months. An individual shall be deemed a second offender
regardless of whether the dangerous animal the offender owns or harbors is the
same animal the individual owned or harbored from the first offense.

(C) Third offense and subsequent offenses: Five hundred ($500.00) administrative fine,
imprisonment not exceeding thirty (30) days, or both; extend for a period of twelve
(12) months. An individual shall be deemed a subsequent offender regardless of
whether the dangerous dog the offender owns or harbors is the same animal the
individual owned or harbored from the first, second, third, or other subsequent
offenses.

(d) A dangerous animal may be ordered destroyed when, in the municipal court's
judgment, the dangerous animal represents a continued threat of serious harm to human
beings or domestic animals due to the animal's dangerous qualities of either:

(1) Having a reasonably known propensity, tendency, or disposition by its owner or


harborer to attack unprovoked, cause injury, or otherwise endanger the safety of
human beings or domestic animals; or

(2) Engaging in an unprovoked attack that causes bodily injury to a human being or
domestic animal and the attack occurs in a place other than the place where the
animal is confined; or

(3) Committing unprovoked acts in a place other than the place where the animal is
confined and those acts cause a person to reasonably believe that the animal will
attack and cause bodily injury to a human being; or

(4) Engaging in pack-like behavior such as roaming unleashed and non-muzzled in a


group consisting of three (3) or more animals; or

(5) Being owned or harbored primarily or in part for the purpose of fighting or which
is trained for fighting.

(e) Pursuant to S.C. Code 1976, § 47-3-20, the animal shelter supervisor, ACO, and or law
enforcement officer(s) shall have the authority to enter public or unfenced private
property within the city to take immediate steps to seize an animal deemed a dangerous
animal and to hold the animal pending final court determination.

(f) Pursuant to S.C. Code 1976, § 47-3-20, the animal shelter supervisor, ACO, and or law
enforcement officer(s) shall have the authority to enter fenced private property,
exclusive of buildings when the owner or harborer of a dangerous animal refuses to
surrender such animal, and may take immediate steps to seize the dangerous animal
and to hold the animal pending final court determination.

(g) In cases of multiple violations of this ordinance by different animals owned, harbored,
or under the control of a single individual, family, group, or association, such violations
shall be deemed to have been committed by the same animal for the purposes of the
enforcement of this ordinance.

(h) Nothing in this section shall abrogate any civil remedies available under statutory,
common, or other superior law.

A Series Ordinance making provision for the terms and conditions of an issue of combined
waterworks ~nd sewerage system capital improvement revenue bonds of the City of Florence,
South Carolina, in the aggregate principal amount of not exceeding $35,000,000 as authorized by
a bond ordinance of the City of Florence, South Carolina, adopted October 24, 1989, as amended;
and other matters relating thereto.

II. CURRENT STATUS/PREVIOUS ACTION TAKEN:


1. The City's bond ordinance, adopted on October 24, 1989, provides that upon adoption of a
"Series Ordinance" there may be issued one or more series of Bonds for the purpose of
providing funds for improvements and extensions to the Combine Waterworks and Sewerage
System of the City. ,
2. At the June 12, 2023 regular meeting of Florence City Council, First Tryon Advisors
presented to Counci 1the financing and capital improvement plan to fund a number of major
projects.

III. POINTS TO CONSIDER:


1. This bond is the first of three separate bond issuances that will fund current and future major
projects and will be paid off over a 30-year time span. Each subsequent bond issuance will
follow a reevaluation of needs and costs.
2. The proposed ordinance will allow the City to secure the funding necessary to construct
certain capital improvements to the water and sewer system, to include: the planning and
design of the Surface Water Treatment Plant expansion, the AESC Economic Development
Project, utility system engineering master planning and automated water meters for billing.
3. The issuance of this bond, along with the second and third issuances, will necessitate a
revision to the water and sewer rate schedule adopted August 10, 2020.

STATE OF SOUTH CAROLINA

WHEREAS, the City Council ("City Council") of the City of Florence (the "City") has made
general provision for the issuance of Combined Waterworks and Sewerage System Revenue Bonds
through the means of an ordinance entitled "AN ORDINANCE PROVIDING FOR THE ISSUANCE
AND SALE OF COMBINED WATERWORKS AND SEWERAGE SYSTEM REVENUE BONDS OF
THE CITY OF FLORENCE, SOUTH CAROLINA, AND OTHER MATTERS RELATING
THERETO," adopted on October 24, 1989, as amended (the "Bond Ordinance"); and

WHEREAS, it is provided in and by the Bond Ordinance that, upon adoption of a "Series
Ordinance" there may be issued one or more series of Bonds for the purpose of providing funds for
improvements and extensions to the Combined Waterworks and Sewerage System of the City (the
"System"); and

WHEREAS, the revenues derived from the System are now hypothecated and pledged to the
payment of the following:

a) the outstanding installments of an original issue of $10,428,518 South Carolina


Water Quality Revolving Fund Loan dated April 18, 2013;

b) the outstanding installments of an original issue of $3 ,817,7 41 South Carolina


Water Quality Revolving Fund Loan dated September 23, 2013;

c) the outstanding installments of an original issue of $6, 111,310.18 Waterworks


and Sewerage System Junior Lien Revenue Bond dated March 10, 2014;

d) the outstanding installments of an original issue of not exceeding $1,750,566 plus


capitalized interest, if any, South Carolina Water Quality Revolving Fund Loan dated
September 11, 2014;

e) the outstanding installments of an original issue of $2,702,347.56 Combined


Waterworks and Sewerage System Refunding Revenue Bond, Series 2015, dated July 15, 2015;

f) the outstanding installments of an original issue of $14,405,000 Combined

Waterworks and Sewerage System Refunding and Capital Improvement Revenue Bonds, Series
2019, dated October 3, 2019; and

1) the outstanding installments of an original issue of $15,252,000 Combined


Waterworks and Sewerage System Refunding Improvement Revenue Bond, Series 2020, dated
May 15, 2020.

WHEREAS, the obligations described at (a), (b), (d) through (f), and (i) through (1) are
hereinafter referred to as the "Parity Bonds;" and

WHEREAS, the City has further determined that it is necessary to construct certain capital
improvements to the System, specifically, a portion of the cost of expanding the City's Surface Water
Treatment Plant, the cost of infrastructure serving AESC battery plant east of the City, a portion of the
cost of comprehensive system engineering and master planning, and the cost of automation of System
water meters for billing (the "Projects"); and

WHEREAS, the City finds that the Series 2023 Bonds (as defined below) may be issued on a
parity with the Parity Bonds pursuant to Section 4.02(A)(6) of the Master Ordinance; and

WHEREAS, it has been determined that not exceeding $35,000,000 may be required in order to
provide funds for (i) defraying the cost of the Projects; and (ii) costs related to the financing and
providing necessary reserves; and

WHEREAS, by reason of the foregoing, it has been determined to adopt this ordinance as a
"Series Ordinance" in accordance with the terms and provisions of the Bond Ordinance.

NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF


FLORENCE, IN MEETING DULY ASSEMBLED:

ARTICLE I

DEFINITIONS AND AUTHORITY

Section 1.01. Definitions.

All terms which are defined in Section 2.02 of the Bond Ordinance shall have the same meanings
in this Series Ordinance as such terms are prescribed to have in the Bond Ordinance.

Section 1.02. Authority for Series Ordinance.

This Series Ordinance is adopted pursuant to the provisions of the Bond Ordinance.

ARTICLE II

AUTHORIZATION AND TERMS OF THE SERIES OF BONDS

Section 2.01. Conditions Precedent to Issuance of Series of Bonds.

The Bond Ordinance provides that a Series Ordinance shall be adopted with respect to each
Series of Bonds which Series Ordinance shall express the approval of City Council to the issuance of a
Series of Bonds and City Council's agreement to abide by the terms, provisions and agreements set forth
in the Bond Ordinance and shall specify and determine:

1) As prescribed by Section 6-1 7-60 of the Enabling Act, the then period of usefulness of
the System;

2) The Date or Dates oflssue of such Series of Bonds;

3) The precise principal amount of the Series of Bonds;

4) The specific purposes for which the proceeds of such Series will be used;

5) The title and designation of the Bonds of such Series and manner of numbering and
lettering, and the denomination or denominations of the Bonds of such Series;

6) The date or dates of maturity and the amounts thereof;

7) The interest rate or rates, or the manner of determining such rate or rates, of the Bonds of
such Series;

8) The time for the payment of interest on the Bonds in such Series and the Record Date;

9) The redemption price or redemption prices and the redemption date or redemption dates
and other terms of redemption (if any) applicable to any of the Bonds of such Series for such payments;

I 0) The Registrar for such Bonds if other than the Trustee;

11) The portion of such Series that are serial Bonds and that are term Bonds, if any, including
the amount and date of each mandatory redemption or sinking fund installment, if any, required by such
Series Ordinance to be paid for the retirement of any such Bonds;

12) The portion of such Series that are Capital Appreciation Bonds, if any, including the time
for payment of such Capital Appreciation Bonds in order to address the information requested in
paragraphs (7) and (8) above.

13) Any other applicable redemption requirement for the Bonds of such Series and the
method of satisfying the same;

14) The manner in which Bonds of such Series are to be sold and provisions for the sale
thereof;

15) The form or forms for the Bonds of each Series;

16) That the then applicable Reserve Requirement has been or will be met;

17) The disposition of the proceeds of the sale of the Bonds of such Series and the manner of
their application; and

18) Any other provisions deemed advisable by the City not in conflict with or in substitution
for the provisions of the Bond Ordinance and the Series Ordinance relating to the Bonds of such Series.

Section 2.02. Findings, Determinations, Agreements and Covenants.

Pursuant to the provisions of the Bond Ordinance described in Section 2.01 above, it is hereby
found and determined that, and the City hereby covenants and agrees, as applicable:

1) The useful life of the System is found to be 40 years.

2) The Date of Issue of the Bonds whose issuance is provided for herein (the "Series 2023
Bonds") is to be the date of delivery of the Series 2023 Bonds.

3) The Series 2023 Bonds shall be in the original principal amount of not exceeding
$35,000,000. The final principal amount and maturity schedule shall be set forth in a certificate to be
signed by the Mayor and included with this Ordinance in the records of City Council.

4) The proceeds of the Series 2023 Bonds shall be used, subject to the provlSlons of
paragraphs 6 and 12 below, to provide moneys which will be sufficient (i) to defray the cost of the
Projects; and (ii) to pay certain costs and expenses relating to the issuance of the Series 2023 Bonds and
providing necessary reserves, if any.

5) The Series 2023 Bonds shall be designated City of Florence, South Carolina, Combined
Waterworks and Sewerage System Capital Improvement Revenue Bonds, Series 2023 (or such other
designation as shall be set forth in a certificate to be signed by the Mayor) and shall be issued in
registered form. The Series 2023 Bonds shall be numbered and lettered in such way as to maintain a
proper record thereof and will be issued in the form of a single bond per each maturity.

6) The Mayor of the City is hereby authorized and empowered to determine the aggregate
principal amount of the Series 2023 Bonds, the principal amount of each maturity of the Series 2023
Bonds, the interest rates for the Series 2023 Bonds, the Series 2023 Bonds to be subject to mandatory and
optional redemption and the redemption prices of the Series 2023 Bonds subject to optional redemption,
any such other information as may be necessary to effect the issuance of the Series 2023 Bonds and shall
be set forth in a certificate to be signed by the Mayor and included with this Ordinance in the records of
City Council.

7) Interest on the Series 2023 Bonds shall be payable as set forth in a certificate to be signed
by the Mayor and included with this Ordinance in the records of City Council.

8) Such of the Series 2023 Bonds as the Mayor shall determine pursuant to paragraph (6)
above shall be subject to mandatory redemption at the redemption price equal to the principal amount of
the Series 2023 Bonds to be redeemed, together with interest accrued from the date of redemption, in the

years and in the amounts determined by the Mayor and shall be set forth in a certificate to be signed by
the Mayor and included with this Ordinance in the records of City Council.

9) The Registrar for the Series 2023 Bonds shall be the Trustee under the Bond Ordinance.

I 0) The Series 2023 Bonds shall be sold, upon consultation with First Tryon Advisors as
Financial Advisor, at competitive sale; provided, however, that the Series 2023 Bonds may be sold by
negotiated sale if the Mayor, in consultation with First Tryon Advisors, determines that market conditions
are such that a negotiated sale will be more in the City's best interests than a competitive sale. City
Council hereby authorizes the Mayor to approve the Preliminary Official Statement and to ratify the use
of such Preliminary Official Statement by the successful purchaser of the Series 2023 Bonds in
connection with the offering of any Series of Bonds by the successful purchaser. City Council hereby
authorizes the preparation and distribution of the Official Statement with respect to such Series of Bonds.
The Final Official Statement shall be approved on behalf of the City by the Mayor.

11) The Series 2023 Bonds shall be substantially in the form attached hereto as Exhibit A.

12) The proceeds of the Series 2023 Bonds shall be applied as set forth in a certificate to be
signed by the Mayor and included with this Ordinance in the records of City Council.

13) City Council hereby authorizes the issuance of the Series 2023 Bonds and agrees to abide
by all of the terms, provisions and agreements set forth in the Bond Ordinance.

14) City Council hereby approves the issuance of the Series 2023 Bonds in substantially the
form attached hereto as Exhibit A, with such changes as shall be appropriate following the sale of the
Series 2023 Bonds.

15) The City finds that the provisions of Section 4.02(A) and (B) of the Bond Ordinance may
be satisfied permitting the Series 2023 Bonds to be issued on a parity with the outstanding Parity Bonds.

16) City Council hereby authorizes the Mayor to take such further action as may be necessary
to effect the issuance of the Series 2023 Bonds.

place or places where amounts due upon such redemption will be payable and, if less than all of the
Bonds are to be redeemed, the numbers of such Bonds so to be redeemed, and, in the case of Bonds to be
redeemed in part only, such notice will also specify the respective portions of the principal amount
thereof to be redeemed. Such notice will be given by mailing a copy of the redemption notice by first
class mail at least 30 days prior to the date fixed for redemption to the Holder of each Bond to be
redeemed, at the address shown on the registration books; provided, however, that the failure to give such
notice by mail, or any defect in the notice mailed to the Holder of any Bond, shall not affect the validity
of the proceedings for the redemption of any other Bond. Provided funds for their redemption are on

"Enabling Act"), an ordinance duly adopted by the City Council of the City of Florence ("Council") on
October 24, 1989, as amended by series ordinances duly adopted by Council on April 12, 2010 and
December 12, 2011 (collectively, the "Bond Ordinance"), as supplemented by an ordinance (the "Series
Ordinance") duly adopted by Council on , 2023 (the Bond Ordinance and the Series
Ordinance are hereinafter collectively referred to as the "Ordinances") for the purpose of providing
funds for certain capital improvements to the System secured by a pledge of System revenues.

Certain capitalized terms used herein and not otherwise defined shall have the meanings ascribed
thereto in the Ordinances. Certified copies of the Ordinances are on file in the office of the Trustee and in
the office of the Clerk of Court for Florence County, South Carolina.

The Bond will be issued on a parity with the City's outstanding Parity Bonds (as defined in the
Series Ordinance) and any Additional Bonds hereafter issued.

The City has covenanted to continuously operate and maintain the System and fix and maintain
such rates for the services and facilities furnished by the System as shall at all times be sufficient (a) to
provide for the payment of the expenses of the administration and operation and such expenses for
maintenance of the System as may be necessary to preserve the same in good repair and working order,
(b) to provide for the punctual payment of the principal of and interest on the Bonds and all Junior Lien
Bonds, ( c) to maintain the Debt Service Fund and thus provide for the punctual payment of the principal
of and interest on the Bonds, (d) to maintain each Debt Service Reserve Fund in the manner prescribed in
the Ordinances, (e) to build and maintain a reserve for depreciation of the System, for contingencies and
for improvements, betterments and extensions to the System other than those necessary to maintain the
same in good repair and working order, and (f) to discharge all obligations imposed by the Enabling Act
and the Ordinances.

For the payment of the principal of and interest on the Bonds, there are hereby irrevocably
pledged the Net Earnings of the System; and a lien upon such Net Earnings has been granted to the
Holders of the Bonds.

This Bond and the interest hereon are exempt from all State, county, municipal, school district,
and all other taxes or assessments imposed within the State, direct or indirect, general or special, whether

imposed for the purpose of general revenue or otherwise, except inheritance, estate, transfer or certain
franchise taxes.

This Bond is transferable, as provided in the Bond Ordinance, only upon the registration books of
the City kept for that purpose by the Trustee or other registrar, by the Holder hereof in person or by his
duly authorized attorney, upon (a) surrender of this Bond and an assignment with a written instrument of
transfer satisfactory to the Trustee duly executed by the Holder hereof or his duly authorized attorney and
(b) payment of the charges, if any, prescribed in the Bond Ordinance. Thereupon a new Bond or Bonds
of the same aggregate principal amount, maturity and interest rate shall be issued to the transferee in
exchange therefor as provided in the Bond Ordinance. The City, the Trustee and any Registrar may deem
and treat the person in whose name this Bond is registered as the absolute owner hereof for the purpose of
receiving payment of or on account of the principal or redemption price hereof and interest due hereon
and for all other purposes.

For every exchange or transfer of the Bonds, the City or the Trustee or Registrar, as the case may
be, may make a charge sufficient to reimburse it for any tax, fee or other governmental charge required to
be paid with respect to such exchange or transfer.

It is hereby certified and recited that all conditions, acts and things required by the Constitution
and statutes of the State to exist, be performed or happen precedent to or in the issuance of this Bond,
exist, have been performed and have happened, and that the amount of this Bond, together with all other
indebtedness of the City, does not exceed any limit prescribed by such Constitution or statutes.

1. The City engineers and pub! ic utilities staff have identified necessary upgrades to the water
and sewer utility system (the System) that will allow for continued residential, commercial
and industrial growth in the Florence area.
2. The identified upgrades are necessary to keep with the growing demands due to the
construction of the AESC faci lity and its three possible expansions, the service manufacture rs
that are anticipated to locate near the facility and continued residential growth within the
service areas of the System.
3. The upgrades necessitate the issuance of bonds. To service the bonds and protect the
financial stability of the System, the 10-year Water and Sewer Rate Schedule adopted by
Ordinance No. 2020-2 1 on August 10, 2020 will require revision.

IV. STAFF RECOMMENDATION


Approve and adopt the proposed ordinance.

AN ORDINANCE REVISING THE WATER AND SEWER RA TE SCHEDULE FOR


THE CITY OF FLORENCE, SOUTH CAROLINA

WHEREAS, continued use and expansion of the combined water and sewer system (the
"System") of the City of Florence (the "City") is important and necessary for the health, welfare,
and public good of the citizens; and

WHEREAS, the City has recognized that the current surface water treatment plant, wastewater
treatment plant, and related infrastructure is limited and inadequate to support future growth and
development in the Florence area; and

WHEREAS, a comprehensive water and sewer utility rate study for the City was last conducted
in 2020, and based on the recommendations in that study, a ten-year rate schedule was
implemented by Ordinance of City Council dated August 10, 2020 (the "2020 Rate Schedule");
and

WHEREAS, the City has been advised by its independent engineering consultants to expand its
surface water treatment plant and wastewater treatment capacity to support regional growth and
maintain compliance regulations with the South Carolina Department of Health and Environmental
Control; and

WHEREAS, the City has concluded, following an extensive examination of combined water and
sewer system capital improvements needs by staff and the City's independent financial advisor,
that a revision of the water and sewer utility rates set forth in the 2020 Rate Schedule is necessary
to allocate costs equitably and produce sufficient revenues to improve the System and generate the
required funding levels to System capital improvements required for the public good; and

NOW, THEREFORE, BE IT ORDAINED, by the Mayor and Council of the City of Florence,
South Carolina, that the following sections or noted subsections of said sections of the City of
Florence Code of Ordinances are revised and are hereby amended to read as stated below. Existing
subsections not specifically identified in the sections below shall remain unchanged and as set
forth in the 2020 Rate Schedule.

Sec. 12-87.1. Monthly rates for ordinary service.

(g) The schedule for sanitary sewer rates inside the City limits of the City of Florence and
inside the Town limits of the Town of Timmonsville based on subsections (a) through (f), shall be
set for a period of seven years consecutive fiscal years and thereafter, unless amended, as follows:
FY 2024, FY 2025, FY 2026, FY 2027, FY 2028, FY 2029, and FY 2030. The rates for FY 2024
will be effective September 1, 2023 through June 30, 2024. Rates for FY 2025 through FY 2030
will be effective from July 1 through June 30 of each fiscal year. The rates for fiscal year 2030
shall remain in effect as set forth in the 2020 Rate Schedule for subsequent years unless amended.

II. CURRENT ST ATVS/PREVIOUS ACTION TAKEN:


(1) This issue is before City Council for first reading.
(2) Planning Commission will hear the matter at its July 11th, 2023 meeting.

III. POINTS TO CONSIDER:


( 1) Request is being considered for first reading.
(2) In the effort to expedite the abandonment at the request of the property owner for the sale of
the property, this matter will be heard at both the Planning Commission meeting and City
Council meeting this month.
(3) The 8" gravity sewer line (approximately 140 linear feet) provides sanitary sewer service to
multiple properties.
(4) The property owner developed a residential structure over the existing sewer line and
installed a new sewer main to meet the specifications and standards of the utility system.
(5) The associated 20' easement (10 ' each side of pipe) will also be abandoned by the City.
(6) A new easement has been established with the construction of the new section of sewer main.
(7) Should City Council approve the abandonment of interest in this sewer line and easement, the
easement will be removed from the property.

LOCATED ON PRIVATE PROPERTY AT 1411 GOLF TERRACE BOULEVARD,
IDENTIFIED AS FLORENCE COUNTY TAX MAP NUMBER 00101-01-470.

WHEREAS, a request has been made for the City to abandon its interest in a portion of the sewer
easement interior to Florence County Tax Parcel 00101-01-470 illustrated on Attachment 5; and

WHEREAS, Section 2-26 of the Code of Ordinances states Council shall act by ordinance in all
matters required by law to be done by ordinance, including the conveyance of any lands of the
City; and

WHEREAS, The following City of Florence departments were contacted regarding the
abandonment of the easement: Fire; Police; Public Works; Utilities; and Planning, Research, and
Development. None of the aforementioned departments found any reason to maintain the City's
interest in this easement.

NOW, THEREFORE BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF


FLORENCE IN MEETING DULY ASSEMBLED AND BY THE AUTHORITY
THEREOF:
1. That the City of Florence abandons its interest in a portion of sewer easement which will
then revert to the parcel's property owner after the necessary legal documents have been
properly executed.

2. That this Ordinance shall become effective seven days upon its approval and adoption by
the City Council of the City of Florence.

also be interested in other areas of improvement with my science education and experience. I hold a BSc
in Environmental Science. Focus: Conservation of Natural Resouces. I also have a very good
