    Reorganization of the Tamil Nadu Electricity Board as per the provisions of the

    ORDER:-

    In the Government order first read above, Government have notified the
    provisional Transfer Scheme, transferring the assets, liabilities and personnel of
    erstwhile Tamil Nadu Electricity Board with the effective date of implementation as
    01.11.2010, as per the provisions of the Electricity Act, 2003 (Central Act 36 of 2003).
    (2) In the Government order second read above, the Government have extended
    time up to 31.10.2014 for final transfer of personnel to successor entities and erstwhile
    Tamil Nadu Electricity Board.
    (3) Now, the Chairman and Managing Director, Tamil Nadu Generation and
    Distribution Corporation Limited has stated that the signing of Tripartite agreement and
    taking over of TANTRANSCO assets such as 66kV SS and above from TANGEDCO
    are the prime activities to be done prior to the employee transfer to successor
    companies. The draft Tripartite agreement has already been submitted to GoTN for
    approval and the clarification on certain clauses in the draft Tripartite agreement are yet
    to be finalized. The activity of taking over of TANTRANSCO assets from TANGEDCO
    needs more than a year since the TANTRANSCO is giving focus for developing the
    more transmission infrastructure.
    (4) The Chairman and Managing Director, Tamil Nadu Generation and
    Distribution Corporation Limited has therefore requested the Government to extend the
    provisional period upto 30.10.2015 for final transfer of personnel by issuing necessary
    amendment.
    (5) The Government after careful examination accept the proposal of Chairman
    and Managing Director, Tamil Nadu Generation and Distribution Corporation Limited
    and extend the provisional period for final transfer of personnel upto 31.10.2015.
    (6) The Notification appended to this order will be published in the Tamil Nadu
    Government Gazette, Extraordinary, dated 13.08.2015.

    APPENDIX.

    NOTIFICATION.

    In exercise of the powers conferred by sections 131 and 133 of the Electricity
    Act, 2003 (Central Act 36 of 2003), read with clauses 9 and 12 of the Tamil Nadu
    Electricity (Reorganisation and Reforms) Transfer Scheme, 2010, the Governor of
    Tamil Nadu hereby makes the following amendment to the said Scheme:-

    2. The amendment hereby made shall be deemed to have come into force on
    the 1st November 2014.

    AMENDMENT.

    In the said Scheme, in clause 9, in sub-clause (1), for the expression “All transfer
    of personnel from the Board to TANGEDCO under clause 6 shall be provisional for a
    period of four years from the date of transfer”, the expression “All transfer of personnel
    from the Board to TANGEDCO under clause 6 shall be provisional for a period of five
    years from the date of transfer” shall be substituted.
