We’ll look into this. I don’t think our GAC discrimination statute at RCW 48.43.0128 differs between minors and adults. Has Kaiser issued a denial of the
surgery? If so, the parents should submit an appeal just to keep the request alive. We can reach out to the attorney to get more information if needed.

Hi Molly,
Any thought on where to start to look into the situation below? I believe the Insurance Commissioner has been informed, but not entirely
sure on that point. Any assistance you can provide on this would be helpful. Thanks.

I have a trans client who is 13 and seeking gender affirming surgery through Kaiser, his parents' insurer. This client spent a year in
pre-operative care: counseling, medical preparations, and countless appointments. Last year, his pre-op surgery arrived, and he
and his parents went to that appointment ready to proceed with the surgery. Little did they know that at that meeting, Kaiser would
inform them that they were canceling the surgery just days before it should have occurred.
Since then, Kaiser has informed my client that he will not be able to get care until he turns 14, meaning he will spend the first
portion of the 2023-24 school year in recovery instead of in class. Not only will Kaiser unlawfully delay his gender affirming care in
violation of Washington Law, but they will also deprive him of his constitutionally-protected right to an education.
Kaiser has begun condescending to my client: claiming that meeting with him to discuss his care is a "favor" and he should be
"grateful." Kaiser claims they plan to end gender- affirming care for all people under the age of 18. My client is frustrated and
terrified.
I will take care of my client's legal needs, but it is time for State leaders to help him. I'd like to discuss this with you and any other
leaders you think I should contact. I look forward to discussing this with you as soon as possible.
