Freedom of movement

We live in an age of movement. More than at any other time in history , people and things move longer distances, more frequently, and faster than ever before. All that was solid melted into air long ago and is now in full circulation around the world like dandelion seeds adrift on turbulent winds. We find ourselves, in the early twenty-first century, in a world where every major domain of human activity has become increasingly defined by motion. 1 We have entered a new historical era defined in large part by movement and mobility and are now in need of a new historical on-tology appropriate to our time. The observation that the end of the twentieth century and the beginning of the twenty-first was marked by an increasingly " liquid " and " mobile modernity " is now something widely recognized in the scholarly literature at the turn of the century. 2 Today, however, our orientation to this event is quite different. Almost twenty years into the twenty-first century we now find ourselves situated on the other side of this heralded transition. The question that confronts us today is thus a new one: how to fold all that has melted back up into new solids. 3

L’articolo rileva, infine, come le premesse da cui muove la Commissione Europea debbano fare i conti con la libertà contrattuale e di impresa garantita dall’art. 16 della Carta di Nizza agli operatori europei, cui va assicurata la libertà di elaborare proprie strategie territoriali di distribuzione, in un difficile equilibrio col principio di non discriminazione.

On May 25th 2016, the European Commission presented a proposal for a
regulation on addressing geo-blocking and other forms of discrimination
based on territoriality. The article clarifies the foundation and the aims of
the proposal, focusing on the scope and the legal framework of the access to online interface, to goods and services and to non-discrimination for reasons related to payment.
However, the promising basis that lead the European Commission have
to deal with the freedom of contract and the freedom of enterprise, as well as the opportunity for companies to develop distribution strategies based on location.
Will the E.U. be able to find a balance between companies’ needs and non-discrimination principle?

которых представлена связь человеческого тела со спортивными
практиками. Одни фотографии были инструментом для научного
изучения движений тела, другие служили репрезентативным целям
и характеризовали роль спорта в европейской культуре, в частности
как одного из инструментов экспансии европейского образа жизни
на колониальных территориях. Анализ снимков спортсменов
позволил сделать выводы о том, что предпочтение в видах
спорта было также связано с представлениями о соотнесенности
пластических особенностей тела с социальным положением человекав обществе. Автор отмечает неразделимость популяризации
спорта, исследований движения микрочастиц и экспериментов
в области хронофотографии – все эти процессы сформировали
в конце XIX – начале XX в. то представление о движении, которое
было необходимо впоследствии для развития кинематографа. / The article analyzes the photos of the second half of
the 19th century, which present the relationship of
the human body with sports practices. Some photos
were an instrument for the scientific study of body
movements. Others served representative purposes and
characterized the role of sport in European culture,
in particular as one of the tools for the expansion
of the European lifestyle in the colonial territories.
The analysis of pictures of athletes, allowed to
draw conclusions that preference in sports was also
connected with ideas of correlation of plastic features
of a body with social position of the person in society.
The author notes the inseparability of promoting sports,
motion studies of microparticles and experiments in
the field of chronophotography–all of these processes
have formed in the late 19th–early 20th centuries
the vision of the movement, which was necessary
in consequence for the development of cinema.

If Social Justice can be construed as helping people to become more fully human by being offered opportunities of financial progress, freedom, and privilege, then entrepreneurship can certainly contribute towards this, the more that it is practiced in ways which bring these opportunities for workers, ‘customers’, the community and society at large.

This chapter discusses alternatives to current globalisation. It argues that a regulatory global governance is unlikely because of conflicting material interests and ideologies. Sub-global internationalism is more viable politically; a global left rather than global government. The chapter outlines alternatives to existing globalisation at the levels of national and local government and in local civil society. It argues that alternative globalisation can be pursued at a global level in the free movement of people. This is defended on philosophical and principled grounds and in terms of its economic and social benefits. With BJP arrival to power, secular face of India has received severe criticism in international community. Latest report of the American. Nationalistic patriotism with some other factors like relative development differences, discrimination at social and economic level, continuous discrimination by the ruling elite, lack of political representation and voicing out grievances have become the root cause of ethnic violence in India which can push to the generation of parochialism. Cultural genocide and deliberate unequal economic development have caused major loss of Muslim lives and property and generate issues including demographic reshaping and political disenfranchisement which has further severe implications for Muslims. This paper will try to highlight the ethnic violence on Muslims in India, analyze the reasons behind the ethnic conflict and its manifestation through primordial and instrumental theoretical framework and finally provide road maps to solution.

This paper attempts to theorize the leadership qualities of both Muhammad Ali Jinnah and Jawaharlal Nehru by making a discourse analysis of their official correspondence, in which almost seventeen letters were exchanged from 18 January 1938 to 16 December 1939, in the era of struggle for decolonization. This correspondence has already been discussed by many historians at micro-level and we have discussed it for the first time at macro-level. Much has been written on the charismatic personalities of both the prominent leaders of the freedom movement in the Colonial period but the proposed area of research has not gained its deserved attention. After the Elections of 1937 and formation of the Congress Ministries, all the efforts of Jinnah to form a coalition government were spurned by the Congress. During his speech at Calcutta, Jinnah proposed to Jawaharlal Nehru for the negotiation on the Communal issue. Nehru immediately responded and the first round of their correspondence was started. Unfortunately, Nehru was not fully aware of the gravity of the situation regarding the political concerns of Muslim with the Communal Question; and the points of disputes with Muslim League. During this correspondence, Nehru formulated the Fourteen Points, 1938, by drawing on Jinnah's letters. These points couldn't get a nod by Jinnah, because Nehru had mapped them out without actually consulting Jinnah. The condescending attitude of Nehru was disapproved of by Jinnah. Based on an experience of a novice primary stage physical education (PE) teacher that starts to work as a psychomotrician in the early childhood education (ECE) stage, this chapter describes the possibilities of free and spontaneous play as a PE tool in 0 to 6 year olds education period. What is street art? This paper offers a definition of street art as an art kind or art form based on its essential value: its subversiveness. It argues that street art is essentially subversive partly in virtue of using public space as a technical resource. By hijacking a portion of the urban landscape with its colorful forms and witty designs, street art challenges familiar ways of practicing the city, while creating ‘temporary autonomous zone’ of free expression. There, corporate control over the city’s visible surfaces is ridiculed and people reclaim their right to use the city. In this sense, street art functions as a carnivalesque tactic of social resistance, favoring the emergence of alternative ways to imagine our urban life and our uses of public space. By considering its subversiveness, one can also explain how street art, one the one hand, significantly differs from official public art while, on the other, including graffiti as its original and most radical style.

Freedom of movement refers to the right of people to circulate without restrictions across the surface of the world. This may concern either internal or international mobility. In the first case, the issue is whether states allow their citizens to move freely throughout their territory. The second case derives from the Westphalian organization of the world into separate nation-states, which raises the question of the rights and duties of states toward noncitizens and, correspondingly, of the rights and entitlements of human beings who wish or happen to be outside their state. In its very much awaited Pancharevo case (Case C-490/20) the ECJ held that Article 4(2) TEU, Articles 20 and 21 TFEU and Articles 7, 24 and 45 of the Charter of Fundamental Rights of the European Union, read in conjunction with Article 4(3) of Directive 2004/38/EC, must be interpreted as meaning that, in the case of a minor, who is a Union citizen and whose birth certificate, issued by the competent authorities of the host Member State, designates two persons of the same sex as the child's parents, the Member State of which that child is a national is obliged (i) to issue that child an identity card or a passport without requiring a birth certificate to be drawn up beforehand by its national authorities, and (ii) to recognise, as is any other Member State, the document from the host Member State that permits that child to exercise, with each of those two persons, the child’s right to move and reside freely within the territory of the Member States.
This comment considers the ECJ decision as a predictable response to the rights of EU citizens, in this case minors, to move and reside freely within the territory of the Member States.
Despite this, the author thinks that there are some differences between the grounds of the judgment, which are more demanding with the interpretation of EU Law, and the operative part of the judgment.
It is interesting to note that, although the paragraphs of the judgment impose the obligation to issue an identity card or a passport stating the child's Bulgarian nationality and her surname as it appears on the birth certificate drawn up by the host Member State, this statement has not been part of the operative part of the judgment.
Something similar happens whit the obligation to recognize the child's two mothers "as parents". Instead of that, the Court (merely) focuses its answer on the right for the child to be accompanied by them when her right to move and reside freely within the territory of the Member States is being exercised. But do they accompany her as mothers or merely as persons entitled to do it?
The author also considers that it is a Solomonic decision to (merely) impose on Bulgaria (Member State of origin) the obligation to provide an identity document or a passport for the Bulgarian child and not the obligation to issue her or her parents a document which mentions them as being persons entitled to move with and accompany that child. The Court considers that this obligation is on the authorities of the host Member State (the best placed to draw up such a document, in ECJ' opinion).
Although these remarks can be seen as excessive (they do not actually affect to the operative part of the judgment), they show that the ECJ sought to minimize interference in a very sensitive issue not only for Bulgaria but for others Member States.

The medical evidence from all parts of the world is clear: for the vast majority of the population, even the elderly, C19 produces no symptoms or mild symptoms. Local healthcare collapses and excess mortality have psychological and political reasons first and foremost.

Anybody showing exponential „case curves“ is deceiving or has been deceived: while the number of tests increases exponentially, the test-positive ratio remains relatively constant in all countries examined, irrespective of measures taken.

„C19 deaths“ are defined and reported in a nonsensical and obviously exaggerating way. Doing the same with herpes simplex would yield a 90% mortality. In reality, it is 0%.

Politicians claiming to protect or liberate a people while having other things in mind is nothing new; nor is a media instilling fear and panic into the population, even by using manipulations. Edward Snowden has already voiced his warning of current developments.

This is what world renowned virology Professor John Oxford has to say about the current situation: „I would say the best advice is to spend less time watching TV news which is sensational and not very good. I view this Covid outbreak as akin to a bad winter influenza epidemic. We are suffering from a media epidemic!“

Lucretius was the first philosopher of immanence. It is he and not Democritus or Epicurus who holds this title. If we want to understand the historical emergence of the concept of immanence, we should start by distinguishing its precursors in Greek atomism from its first complete incarnation in Lucretius. This way, we can see exactly what first defined and distinguished immanence from its past. Therefore in what follows I would like to make three, perhaps controversial, claims about the emergence of philosophical immanence. 1) Lucretius was not an atomist, 2) Greek atomism reintroduced transcendence, and 3) It is the primacy of motion in Lucretius that defines his philosophical immanence. Lucretius was not an atomist This thesis is as counterintuitive as it is straightforward. The first major difference between Lucretius and the earlier Greek atomists is precisely that—the atom. For Leucippus, Democritus, and Epicurus atoms are always in motion, but the atom itself remained fundamentally unchanged, indivisible, and thus internally static—even as it moved. Thus instead of positing discrete atoms as ontologically primary as both ancient Greek and later modern theories do, one of Lucretius's greatest novelties was to posit the movement or flow of matter as primary. Lucretius did not simply " translate Epicurus, " as the Greco-centric story goes; rather, he introduced the first immanent kinetic materialism in the West. For example, although the Latin word atomus (smallest particle) was available to Lucretius to use in his poem, he intentionally did not use it, nor did he use the Latin word particula or particle to describe matter. The English translations of " atom, " " particle, " and others have all been added to the text in translation based on a certain historical interpretation of it. The idea that Lucretius subscribed to a world of discrete particles called atoms is therefore both a projection of Epicureanism, who used the Greek word atomos, and a retroaction of modern scientific mechanism of the fifteenth century onto De Rerum Natura. Lucretius rejected entirely the notion that things emerged from discrete particles. To believe otherwise is to distort the original meanings of the Latin text as well as the absolutely enormous poetic apparatus he summoned to describe the flowing, swirling, folding, and weaving of the flux of matter. Although Lucretius rejected the term atomus, he remained absolutely true to one aspect of the original Greek meaning of the word, τομος (átomos, " indivisible "), from-(a-, " not ") + τέμνω (témnō, " I cut "). Being is not cut up into discrete particles, but is composed of continuous flows, folds, and weaves. Discrete " things " (rerum) are composed of corporeal flows (corpora) that move together (conflux) and fold over themselves (nexus) in a woven knot work (contextum). For Lucretius, things only emerge and have their being within and immanent to the flow and flux of matter in motion. Discreteness is an apparent product of continuous folded matter, uncut, undivided, and in motion and not the other way around.
