Facility keys must be picked up from MCM, LLC at 1900 E. Warner Ave. #1P, Santa Ana,
CA 24 hours before for each event and must be returned no later than 48 hours following
the event.
I acknowledge and agree, on behalf of myself and my family, that the use of the Seagate Colony
recreational and designated facilities and landscape areas located in Aliso Viejo and operated by
Seagate Colony Homeowners Association, including but not limited to, exercise room, rose
garden, parking facilities and landscape areas, involve a potential risk of serious physical injury
to a person undertaking activities or using these athletic and recreational facilities. I fully
understand that athletic activity, by its very own nature, can be hazardous and that it can lead to
injury to me or damage to my property.
I understand that by signing this form, my family and I agree to assume the inherent risks of
potential injury to which I am voluntarily exposing my family and myself by participation in
athletic and recreational activities on the facilities of Seagate Colony.
On behalf of myself, family and guest, I release from liability and hold harmless Seagate Colony
as a result of such activities and waive my claims that I or my family may otherwise have or
acquire against Seagate Colony, its officers and directors, agents, or employees, for any injury
occurring to me or my family, or to my property, as a result of any use of Seagate Colony
property or my family’s participation in athletic or recreational activities on the facilities and
grounds of Seagate Colony located at Aliso Viejo, CA.
I have read the Policies and Guidelines and this rental agreement. I accept the liability for
damage to persons admitted to facilities while rental is reserved.

1. The Seagate Colony Clubhouse is for the use of Seagate Colony residents and their
guests. The use of the clubhouse by Seagate Colony residents may be restricted by the
Board of Directors for delinquent Association dues, violations of Seagate Colony policies
and Guidelines or deliberate abuses of the clubhouse and/or recreational facilities,
designated facilities or landscape areas.
2. The Seagate Colony Clubhouse may not be used for commercial purposes without prior
approval of the Board of Directors. Products may not be sold at the Seagate Colony
Clubhouse facility or at any Seagate Colony recreational or designated facility for the
profit of any individual or commercial enterprise other than the snack bar facility.
3. Furniture may not be removed from the interior of the clubhouse.
4. Furniture may be moved within the clubhouse; however, the renter will incur a $25.00
service charge if the furniture is not returned to its original position at the close of the
event.
5. Classes (such as book review, needlework, etc.) may be offered in the clubhouse
provided the class is desired by the residents of Seagate Colony, open to all residents, and
attended only by residents or their invited guest. One resident must be responsible for
clean up and reserving the clubhouse.
6. Exercise classes are not permitted in the clubhouse.
7. In accordance with California State Law, no one under the age of 21 shall be served an
alcoholic beverage while on the premises. If alcoholic beverages are served at the rental
function, no minors are to be present without a consenting parent or guardian.
8. The reserved function shall last no later than 11:00 p.m. Events lasting past 11:00 p.m.
must have the prior written consent of the Board of Directors or the renter may lose
clubhouse privileges.
9. The renter shall arrange for all pick-ups and deliveries to be made the day of the event.
10. Seagate Colony is not responsible for lost or stolen items.
11. All kitchen equipment, bar, banquet tables, podiums, electrical and sound equipment are
to be provided by the renter.
12. The renter shall be completely responsible for his/her own set-up and clean up. A
minimum cleaning fee of $100.00 will be automatically deducted from the $300.00
security deposit for an additional cleaning required after a homeowner’s event.
13. No more than 73 persons may be in attendance at the rental function.

CLUBHOUSE RULES & REGULATIONS
1. The clubhouse facilities are for the use of members/owners who are current with
assessment dues. The Board of Directors may restrict the use of the clubhouse facilities
for violation of the rules and regulations, delinquent assessments, or deliberate abuse of
the recreational facilities or common areas. Tenants are not permitted to reserve the
facilities. If an owner so desires, they may reserve the facility in their name for use by a
tenant. THE OWNER IS THE RESPONSIBLE PARTY AND SHALL BE HELD
LIABLE FOR ANY DAMAGE TO THE FACILITIES.
If the Board of Directors receives two written letters of complaint from homeowners in
the community regarding lewd, offensive, aggressive, and/or outrageous behavior, then
the person responsible for renting the clubhouse may be fined according to the Seagate
Colony fine schedule.
2. The reservation of the clubhouse facility is restricted to members for personal and private
parties. Use of the clubhouse facility by outside organizations, whether or not requested
by a member, is not permitted.
4. Reservations of the clubhouse facility do not include the pool facilities. The pools and
spas may be used, but other homeowners and guests may not be excluded from the pool
areas.
5. The clubhouse facilities may not be used for commercial purposes other than those
endorsed or approved by the Board of Directors. Also, facility usage is approved free of
charge for endorsed activities (i.e., HOA meetings, HOA-sponsored holiday parties).
6. Regularly scheduled events have precedence over non-scheduled (reserved) events in any
facility.
7. In accordance with law in the State of California, no one under the age of 21 shall be
served an alcoholic beverage while on the premises. If alcoholic beverages are served at
a function in the clubhouse facilities, no minors are to be present without parental
permission.

8. Reservations cannot be accepted the day of a Holiday. However, they can be accepted the
day prior to or after the Holiday.
10. The clubhouse may be reserved 48 hours in advance although at least a week’s notice is
advised. Reservations may not be made further than 90 days in advance.
11. Any damage, breakage, or theft that occurs during a private function will be reimbursed
to the Association out of the security deposit, or if this amount is insufficient, the owner
who reserved the facilities will be charged and will be held liable for the full amount and
value of such damage, breakage, or theft. Full payment will be demanded within 30 days
or appropriate legal action will be taken immediately.
12. It is expected that the homeowner will leave the clubhouse facility in a clean, neat, and
orderly fashion. A minimum cleaning fee of $100.00 will be automatically deducted from
the $300.00 security deposit for any additional cleaning that is required after a
homeowner’s event.
13. Facility hours are 8:00 a.m. to 11 p.m. This means that the premises must be vacated by
11:00 p.m. All requests to hold functions beyond 11:00 p.m. will be considered by the
board of Directors on a case-by-case basis. Approval from the Board must be obtained in
order to conduct any activity in the clubhouse beyond 11:00 p.m. In addition, signatures
must be obtained of the homeowners located in the model phase building, 9-35
Whippoorwill, who would most be affected by a late-night event.
14. Use of ALCOHOLIC BEVERAGES must be stated in your application. Use of glass
containers is prohibited. Illegal use of liquor or drugs will cause immediate dismissal of
the event, automatic forfeiture of your deposit, and loss of future privileges for use of the
facilities. Offending sponsor will be held responsible for all resulting legal fees and fines
assessed. It is solely the homeowner’s responsibly to monitor the dispensing of alcohol to
remain within legal limits as well as to ensure the safe driving conduct of their family
and guest. In accordance with California State Law, no one under the age of 21 shall be
served an alcoholic beverage while on the premises; no minor is allowed to be on
premises without the presence of parental supervision.
15. Loud and boisterous conduct shall not be permitted and at the discretion of either the
adult resident sponsor or Board of Director, the function may be stopped, guests asked to
leave, and any deposits may be forfeited. Live bands are prohibited.
16. Teenage parties are discouraged and must be authorized in order to reserve the date. A
security guard will be required to be hired at the expense of the homeowner. A legally
responsible adult resident must be present at all times.

17. Youth activities are to include one adult per 10 minors for age 12 and under. Two on
premises chaperones must accompany activities for ages 13 through 20.
18. The clubhouse and common area may not be used for commercial purposes. Products
may not be sold in the clubhouse or any recreational facility for the profit of any
individual or commercial enterprise unless otherwise approved by the Board of Directors.
19. Classes (such as book review, needlework) may be offered in the clubhouse as
determined by the Board of Directors, open to all members and attended only by
members or their invited guests.
20. No more than 73 people may be in attendance within the clubhouse. In order to comply
with fire codes, all doors must remain unlocked while the function is in progress.
21. Seagate Colony Homeowners Association is not responsible for lost or stolen personal
items.

Santa Ana, CA 24 hours before for each event and must be returned no later than
48 hours following the event.
23. No pins, tacks, or nails are permitted when decorating. Double-sided tape or similar
products that will not damage wood, paint or plaster are permitted.
24. Make sure all facilities are turned to “off” position. Turn off all lights and security lock
all doors and gates before you leave. Garbage and other refuse must not be left in or near
the clubhouse. It is the responsibility of the homeowner to properly dispose of their
refuse.
25. The Board of Directors reserves the right to amend or review on a case-by-case request
these regulations at any time.
26. The pool facilities may not be included in the rental of the clubhouse. Food and drinks
may not be placed in the pool area. The rental of the clubhouse is limited to the
clubhouse only.

1. The fees for reserving the clubhouse must be paid to Seagate Colony Homeowners
Association at the time of the reservation and include the following:
