A woman who miscarried has to spend more time in jail than a rapist. Fuck this world.

Wait, y’all really believe Oklahoma would send a woman to jail for simply “experiencing a miscarriage” and do zero further research into what the actual crime was that she was prosecuted for?

The law in Oklahoma is weird and backwards, but it doesn’t say miscarriages are illegal.

What it does say, interestingly, is that preborn children are people who can be victims of homicide, but OK also has legal abortion.

Under Oklahoma law, if your baby dies from legal abortion or as the result of normal medical testing or medical care (such as amniocentesis, a process used to test for disabilities that carries a risk of miscarriage), you’re fine.

However, the law says that if you commit a crime, and your baby dies as a result of that crime, you are responsible for the death of your baby.

This woman, Brittney Poolaw, had a miscarriage after taking meth, and an autopsy of her baby tested positive for the drugs she took.

So she’s being charged not for having the miscarriage, but for potentially causing the miscarriage through illegal drug use.

Now, I’m not a fan of how this law is set up, because it doesn’t actually protect babies and only penalizes mothers, in this case a mother who probably has an addiction problem and needs treatment, not jail.

The solution here should be to change how Oklahoma approaches drug use. There’s also the problem that the prosecution didn’t actually prove that the drug use caused the miscarriage, because the baby had other health and genetic issues. So that should be grounds for appeal.

This is a symptom of the drug war, not pro-life policies.

But it is definitely misleading and fearmongering to make the headline “woman goes to jail for miscarriage.”

You mean to tell me that journalists just go and make up headlines that sound totally implaussible to gin up controversy and like? Lie!??  No, obviously a bunch of people in Oklahoma sat down and said any woman who has a miscarriage should go to jail. This was a law that was passed by elected officials. Obviously. 

Correction, the state of Oklahoma made their case based on the assumption that the miscarriage was due to meth use but the coroner did not give a cause of death during the autopsy, even though meth was found in the brain and liver of the fetus, and there were other important factors as well that this article goes over.

However, I do agree that the mother should be getting addiction therapy and not jail time.
