Public Order Law and Freedom of Expression

The essay opens with some background information about the period in which JS Mill wrote. The discussion revolves around the concept of blasphemy which Mill considered to be highly problematic. Tagging unpopular views as " blasphemous " amounted to abuse of governmental powers and infringed on the basic liberties of the out-of-favour speakers. The discussion on blasphemy sets the scene to the understanding of Mill's concerns, his priorities and consequently his emphasis on the widest possible liberty of expression. Section II presents the Millian principles that are pertinent to his philosophy of free speech: liberty and truth. Section III analyzes Mill's very limited boundaries to freedom of expression, asserting that the consequentialist reasoning had led Mill to ignore present tangible harm. It is argued that democracy is required to develop protective mechanisms against harm-facilitating speech. Zangwill for their sharp and constructive comments. Public Order, Private Rules:
Representations of the Crowd and Behavioural Recommendations in Italian Police Handbooks

This article aims at contributing to the debate on policing protest, focusing on police knowledge and its role in the management of public order. To this end, the article, by means of the conceptual tools provided for by critical discourse studies, examines some police handbooks. Although these textbooks allow a reader to observe only part of the whole of police knowledge and do not supply a completely realistic description of actual practices of the operators, they do show an interesting perspective on public order and its management. The police handbooks on which the article focuses express both an articulate philosophy of security and a quite clear idea of the role played by police forces in keeping public order. Moreover, they examine fieldwork procedures in depth, show detailed descriptions of crowds and their behaviours, and describe for operators the attitudes they must exhibit while performing these services. More in general, police handbooks give precious information on the discretionary power that characterizes police activities in policing protest.

This article attempts to explain why the United States is exhibiting the most liberal stand on protecting freedom of expression. It is argued that the American credo is comprised of strong belief in liberty and individuality and of strong anti-government sentiment. The First Amendment is enshrined in its culture and tradition. The protection of political speech is fundamental to the American democracy. As U.S. Constitution strongly protects political speech, it confers protection also on hate speech which is included in the broad definition of political speech. The article advocates that we take the evils of hate speech seriously. It criticizes the American ‘viewpoint-neutrality’ concept and argues that a balance needs to be struck between competing social interests. Freedom of expression is important as is the protection of vulnerable minorities.
