1. Downloading of Bids: The Tender document Consisting of qualifying information, eligibility criteria,
specifications, Bill of quantities (B.O.Qs), Set of Terms & Conditions of Contract and other details can
be seen/downloaded from the Govt. website www.jktenders.gov.infrom from 11-11-2023 (06.15 PM)
2. Submission of Bids: The bidders shall deposit their bids in electronic format on the above website
from 11-11-2023 (06.30 PM) to 20-11-2023 (06.55 PM) in two covers.
3. Opening of Bids: The bids uploaded on the website up to due date and time will be opened on 21-11-
2023 (13.00 PM) in the Office of the Executive Engineer, Mechanical & Hospitals Division
Baramulla.
4. The bidders are required to submit their offers in two (02) covers.
Cover-I shall contain: Scanned copies of following documents:
Rs. 200.00 (Rupees two hundred only) in shape of e-Challan / e-receipt / online Bank
transfer acknowledgement including mPay or any other mobile banking App., to be
uploaded with the each online bid pledged to Executive Engineer Mechanical & Hospitals
Division Baramulla. Tender Id to be written also on the voucher.

5. The complete bidding process will be online.
6. The Financial bid of only qualifying bidders shall be opened online in the Office of the Executive
Engineer Mechanical & Hospitals Division Baramulla after evaluation of the technical bid.
7. Bidders are advised not to make any change in BOQ (Bill of Quantities) content. In no case they should
attempt to create similar BOQ manually. The BOQ downloaded should be used for filling the item rate
inclusive of all taxes and it should be saved with the same name as it contains.
8. The cost of tender document is non-refundable and the tender shall in no case be accepted if submitted
by any firm other than the purchaser.
9. Any tender found to have been submitted by the firm by furnishing false information to the Department
shall be cancelled and the firm shall be penalized as and when it comes to the notice of the Department
even during the currency of the contract. The tenders should be addressed to the Executive Engineer
Mechanical & Hospitals Division Baramulla.
10. The Department shall not be responsible for delay in submission of bids due to any reasons, whatsoever.
11. The Department reserves the right to reject or accept any or all bids in part or in full without assigning
any reason thereof.
12. The successful bidder has to carry out the supply based on allotment order issued by the Department at
the rates allotted under this contract (L1 rates only) from the date of issuance of Allotment Order /
L.O.I.

GENERAL TERMS & CONDITIONS
01. PRICES:
The rates quoted for different supplies shall be F.O.R Assistant Executive Engineer M&H Sub-
Division 1st Baramulla. The prices quoted shall be inclusive of all taxes, carriage etc.
02. CONSIGNEE:
The consignee against this work shall be the Executive Engineer, Mechanical Division (MED),
Baramulla.
03. NOTIFICATION OF AWARD OF CONTRACT AND SIGNING OF AGREEMENT:
The (L1) bidder who fulfills all contractual obligations shall be bestowed with Award of
Contract and intimated accordingly in writing. The (L1) bidder thereafter has to furnish
Performance Security in the shape of CDR/FDR/BG equal to 5% of the advertised cost valid
for six months. A formal deed of "Agreement", incorporating therein the terms and conditions
“which shall govern the Contract”, will be executed by the successful tenderer with the
Department within one week from the issuance of the formal 'Supply Order’. This written
“Instrument of Agreement”, governing the contract shall, in all respects, be deemed to be, and
construed to be, and shall operate as 'An Indian Contract' in conformity with laws applicable and
in vogue in the UT of Jammu & Kashmir, and shall be subject to the jurisdiction of the Courts in
the UT of Jammu & Kashmir at Srinagar/ Baramulla only.
No payment, whatsoever, against the work done, shall be released without execution / signing
of the formal agreement which becomes Contract Bond after the execution.
04. COMPLETION PERIOD:
The successful bidder shall have to complete the supply of material as per the allotment order on
approved rates within 07 days from the date of intimation from this office.
05. TERMS OF PAYMENT:
Subject to fulfillment of contractual obligations and availability of funds, the payment to the
firm shall be made 100% of the total cost of supplies allotted after the completion of supplies in
full, in time and satisfactorily to concerned AEE. The Contractors Registration / renewal of
Registration should be online available on JKPWDOMS of PWD J&K at the time of
submission of bill / payment. The Contractor / supplier has to submit irrevocable Bank
Guarantee (BG) / CDR/ FDR to the tune of 5% (five percent) of the billed amount alongwith the
bill as performance security valid for six months. The said financial instrument shall have been
drawn from any Nationalized / Scheduled Bank having branch in Srinagar / Baramulla.
Performance Security submitted against Clause “3” of the Annexure “B” shall suffice the
purpose as required in this Clause also.
06. PERFORMANCE GUARANTEE: The successful tenderer shall complete all the
work to the entire satisfaction of the Department. The tenderer shall be responsible for
satisfactory performance of the equipment for a period of six months from the date of
commissioning of system.
07. AGREEMENT: A formal deed of "Agreement", incorporating therein the terms and
conditions which shall govern the Contract, will be executed by the firm with the
Department within one week of the issuance of the formal 'Allotment Order. This
written instrument of Agreement, governing the contract shall, in all respects, be deemed
to be, and construed to be, and shall operate as 'An Indian Contract' in conformity with
laws applicable and in vogue in the UT of Jammu & Kashmir, and shall be subject to the
jurisdiction of the Courts in the UT of Jammu & Kashmir at Srinagar only.
Non-execution of formal agreement shall, in no way, make the Contract ineffective/in-
operative.
No payment, whatsoever, even against the work done, shall be released without drawl
and acceptance of the formal agreement.
08. CIVIL, SUIT/LEGALREMEDIES:
All legal proceedings in connection with the tender/contract shall be subject to the Jurisdiction
of Courts of Srinagar / Baramulla City only.
09. STANDARDS:
Unless otherwise specified all material used by the contractor / workshop holder for supply shall
comply in all respects with the requirements of relevant Indian Standards. The material/spares to
be used shall be of genuine make.
10. FORCE MAJEURE CLAUSE:
If at any time during the execution of this order either party is unable to perform in whole or in
part any obligation under this order because of war, hostility, military operation of any kind, acts
of public, enemy, civil commotion, sabotage, strikes, lockouts, go-slow, fire, floods, epidemics,
quarantine restrictions, acts of nature and acts of Government (including but not restricted to
prohibitions of exports and imports) then the date of fulfillment of any obligation shall be
postponed during the time for which such circumstances are operative. Any waiver / extension
of time in respect of the delivery of any installment or part thereof shall not be deemed to be
waived / extension of time in respect of remaining deliveries. If duration of such circumstances
exceeds six months either party shall have right to claim eventual damage. The party which is
unable to fulfill its obligations under the present contract must immediately inform the other
party on the occurrence of termination of the circumstances preventing performance of contract.
Certificate issued by the Chamber of Commerce in the country of the seller or buyer, as the case
may be, shall be sufficient proof of the existence of the above circumstances and their duration.
11. ARBITRATION:
If at any time, any dispute or difference whatsoever shall arise between the contractor and the
government in relation to or in connection with the contract, either of the parties may give each
other notice in writing of such a dispute or difference and the same shall be referred to the
Arbitration of a person to be mutually agreed upon not less than the rank of serving or retired
Chief Engineer, or failing such agreement within 30 days of such notice, of some person
appointed by the government of Jammu and Kashmir. The submission shall be deemed to be a
submission to and all rules framed there under or any statutory modifications thereof shall apply
to such proceedings. The arbitration shall be within jurisdiction of the J&K U.T only.
12. PENALTY:
In case, the successful bidder fails, declines, neglects or delays the contract or in the event of
any damage occurring or being caused by the firm or in the event of any default or failure by
the bidder in complying with any of the terms and conditions of the contract, the Government
shall without prejudice to any other remedy available to it under law in force in the state shall
besides forfeiture of Security Deposit:
a. Terminate the contract after thirty (30) days’ notice (and/or)
b. Impose a penalty up to a maximum limit of 10% (ten percent) of the value of
contract for more than ten (10) days of delay in supplies
13. All other terms and conditions are same as laid down in PWD form No. 25, 33 & GFR 2017.
