TERMS AND CONDITIONS OF CONTRACT

(A) F'OR MANPOWER
(r ) S COPE OF WORK:-
The contractor shall be responsible for the following duties:-
Round the clock patrolling and guarding of SGTPS, Hydel Power Station, Dam, Colony area and
MPPGCL property as per instructions of Security In charge of SGTPS, Birsinghpur. The security
shall be done by the contractor's personnel and MPPGCL Security Personnel jointly.
8) STRENGTH OF SECURITY PERSONNEL:-
As per the seculity requirement total 22Nos. personnel are to be deployed by the contractor/
security agency which shall be deployed on round the clock basis in 3 shifts as directed / indicated
by security Officer, SGTPS, MPPGCL,Birsinghpur. No Overtime / extra wages will be paid by
MPPGCL. Breakup of Security Guards to be deployed is as given below:-
a)Security Guards 22
The minimum wages for the above category of security personnel shall be as per the minimum
wages Act of MP Govt. The disbursement of wages shall be done through Bank Account of
r,r orkers.
G) PERIOD OF ONTRACT:-
The period of contract shall be 15 days from the date of commencemelrt of contract. The cornpan,v
however reserve the right to increase or decrease the contract period.
c) MPPGCL SCOPE OF Y:-
(t,) ACCOMMODATION:-A suitable accommodation will be provided to the head of contractor's
person on chargeable basis. If available Barrack accommodation will be provided to the Security
Guards deployed by the contractor, which will be free of cost. However water charge/ electricity
charge will be payable by the contractor.
(b) MEDICAL FA GCL shall provide free consultation including pathological test and
admission in the Hospital. However all medicines required shall be procured by them/ contractor
(c) COMMUNICATION FACILITY:-
The contractor shall be provided with MPPGCL telephones at limited specified locations as decide,J
by SGTPS, MPPGCL, Birsinghpur.
(s) CONTRACTOR'S SCOPE OF SUPPLY:-
i. 'IRANSPORT FACILITY :-Conveyance to the Security Guards shall be providecl by the
contractors at his own cost MPPGCL shall not provided any vehicle.
ii. SUNDRY IIEMS:-The Security personnel deployed by the contraitor shall be provided with
proper uniforms, rain coats, safety shoes, gun boots, lathi, torch, torch cells, whistles etc.
iii. In case of any accident on duty to any of the personnel of contractors, resulting in fatality,
permanent disability or any injury or loss whatsoever MPPGCL will not be responsible for the same
and the compensation/ damages due to suchpersonnel under the law shall be borne by the
contractor. In other words there cannot be any claim, whatsoever on this account against MPPGCL.
ir'. Ilany litigation arise as a result of the negligent performance of the duties.of the personnel of the
contractor, the expenditure on such litigation shall be borne by the contractor.

(a) The contractor will have to obtain the license from the Govt. LabourOfficer. Shahdol/Umaria unrler.

contract from time to time.
0) The contractor shall submit license fi'om the controlling autl-rolity as laid dorvn under sectiorr .l.r;
and 1 1 of the Privatl Security Agencies (Regulations) Act - 2005.
v'. PILFERAGE, TIIEFT, LOSS:-The contractor shall be liable to compensate MPI'G('i.
management for losses, if any. ou account of theft/ pilferage i loss of material or property inclrrciing
trespass on our property due to negligence or collusion by the contractor's personnel.
The amount to compensate the loss of property shall be recovered from the subsequent bill of- thc
contractor.
vi. SECURITY DEPOSIT:-Ten percent (10%i) security amount of total contract value shall be 1r11ial
by the contractor in cash or FDR/D.D. payable in favor of Jt. Dir. (F&A) , SGTPS. MPPGCI-..
Birsinghpur within 05 davs. From the date of issue of work order for due and faithful executior.r ol-
contract.
vii. CONTRACTOR AGREEMENII .,:The contractor shall be required to enter into an agreenrcnt t()
be executed on noir judicial stamp paper worth Rs. 500/- with revenue stamp of Rs. 1/- affixcil
thereon, within 05 davs from the date of issue of work order.
viii. COMPENSATION :-Contractor is required to use his own arms. He shall have to obtain his ou,rr
arms / Ammunition and get license for the same. In case of any injuryifatality to any person chre tcr
firing by security pr:rsonnel of contractor, the MPPGCL will not be held responsible for the sanrc
and compensation /damages due to such firing under the laws of the land shall be borne b_v rlrc
contractor.
(6) PAYMENT:-
(i) fne bill shall be submitted by the contractor through to the security Officer, who in turn u,ill
certify the attendance and send the bill to this office so that payment can be arrange to thc
contractot, timely. The disbursement if wages shall be done thror.rgh Bank Account of r.r,orkcrs.
Payment will be made within 45 days after receipt of bill or as per qlreue whichever is later.
(ii)G.S.T. shall be paid Extra (@ l8% on quoted rates.
(7) E.P.F. CONTRIBUTION ilt shall be the responsibility of the contractor to rernit lll,l,'
contribution of all personnel deployed in the work together with employer share and other chargc.s
in EPF $/c. code allotted to your establishment by the E.P.F. Commissioner and submit copv o1'
Bank Challan form no. 12A and other requisite document to welfare officer, SGTPS, BirsinghpLrr'
monthly/regularly for verification. Please also submit copy of annual return in form 3A, 6,4 or lrall'
yearly return in form No. 24A to the welfare officer, SGTPS, MPPGCL, Birsinghpur.
(8) PENALTY :-Double penalty (wages + additional equal to the wages) of person less deployec'l shall
be deducted from the contractor's bill.
(e) CONDITIO
a. The contractor shall deploy Security Guards who have experienced in similar natured job in statc
armed forces/ Central Police Organization vtz, SAF/ ITBP/ Home Guards / Railway Protectiorr
fbrce / CRPF/ BSF/ Trained Personal who have obtained training from Govt. Recognized utilirlr'
Ex-serviceman.
b. However preference shall be given to Security Guards who are Ex-serviceman but in case, if tlre
contractor is not in position of deploy ex-serviceman Security Guard then he shall submit a
certificate to the effect that he has made all best efforts to secure services of ex-serviceman. l'he
contractor shall ensue that in case of non-availability of ex-serviceman despite of all efforts he slall
deploy non ex-serviceman but only from the service mentioned above.
c. The contractor shall submit a certificate that he has complied / is complying/shall comply u,,ith thc
provisionsof "The Private Security Agency (Regulation) Act 2005" and rules made there under a.rl
all other relevant law/ rulings / notifications and so on.
d. Before actually deploying the security guards, the contractor shall submit 4 photograph ol each
proposed Security Guards with complete and certified permanent home address and local adclress
one each of services copy may be for:-
i. Office Record

For submitting to the local police station, where these guards are deployed
Another photograph displaying side profile of the individudl concerned.

individual should be written on the back of all photographs. The office records should also
have identifiable permanent marks on bod y of the individual
e. It shall be mandatory for the contractor to ensure that any Guard or supervisor, when he leaves the
duty or is made to leave frorn the institution where he had been deployed, he should submit
his
identity card to the author-ities and if anv fail ure occurs on this ground, information should be glven
immediately to the local police as well as Administrative Ofhcers of the Plant /Institution
l. It shall be mandatory for the contractor that before actually deploying Guards, he should obtain.
character/ antecedent celtificate about the individual concerned frorn the police station of his
permanent residential address and from all those police station where uuder he has resided for more
than a specified period. The specified period may be from 1 to 3 years.
g. Arrned Guards should have gun license, own gun and authority to use them and not the retainer.
h. In case of non-payment of anv dues or default to make proper payment by the contractor to his
employees, MPPGCL shall be entitled to asses and deduct the amount due from the contract and
shall make payment of the same to the said employees.
i. If desired by the MPPGCL/ Company the service of any of the employees of the contractor shall be
terminated within 24 hours and without assigning notice/ reason thereof.
j TERMINATIOI'{ OF COI\TTRACT :-The contruct can be terminated by giving u clecrr notice of
30 days by the MPPGCL to the controctor.
k. The contractor has to arrange an interaction ofall the guards proposed lbr deployed before, the date
of start of contract. MPPGCL reserved right to reject/ disqualify any Guard/ Employee r,r,ithout
assigning any reason.
l. The Director of the Private Agency shall follow instruction of the local district policeof the local
power station in whose jurisdiction the place of deployment and the offrce from which the
deployment is experienced falls regarding hiring of servants and renters.
(10) Penaltv for negligence duune work:- In case if any of the personnel /rvorker deployed by the
coutractor/service provider is found not following the safety rules and regulations as per the
requirement of factory act and other labour laws, penalty as deemed fit (Not exceeding Rs. 500/-
per day) shall be imposed by the Officer-In-Charge or Chief Safety Officer of MppGCL.
(i 1) JURISDICII'ION :-Any dispute of difference arising under. out of or connection with work order
shall be subject to exclusive jurisdiction of competent courl of Umaria/ Jabalpur ONLy.
(12) DISPIITES:-in case of any dispute the decision of Chief Engineer(ben.), MppGCL, SGTPS,
Birsinghpur shall be final and binding on the contactor.
