Notary

Notary is one of the authorities who as a public officer has task to make authentic legal documents as perfect evidences. ln today's era of globalization challenges, notaries are required to follow recent development in electronic transactions. According to ITE law, documents in electronic transactions are valid evidences. Nonetheless, electronic deed cannot be proposed as perfect evidence because it still needs additional evidences, judge considerations, etc. It is argued that the verification status of electronic documents does not make equal with the verification status of authentic legal documents; it is categorized equal merely with informal legal documents. Therefore, there is the need to make necessary laws or to amend the ITE law and Law No. 30/2004 on Notary.

Background: Notary is a public official who runs the profession based on principles of trust, honesty, thoroughly, independently, impartially, safeguarding the interests of those involved in law-drafting. As an independent profession because it is free from interference from any party, cooperation between notaries and banks by binding themselves with a cooperation agreement, not only damages the authority of an independent notary profession, but also has the potential to prioritize the interests of banks as creditors compared to the community as debtors which both require the services of a notary service in drafting authentic deeds. Research Method: This research is an empirical legal research, the research approach of this research is a sociological juridical approach, which is an approach that is done by looking at the reality that exists in practice in the field.Sources of data used in this study were taken from primary, secondary and tertiary data. Primary data used in sociological juridical research are data obtained from field research/interviews. The data used to complete the primary data are derived from literature review, the material used is through acts, books, magazines, newspapers, articles, journals, and website along with other references that support this research.Tertiary data are supporting legal materials that provide guidance and explanations for primary and secondary legal materials. Tertiary legal material in the form of information sources, namely the legal dictionary, Indonesian dictionary and encyclopedia. Data were analyzed qualitatively to get a description of the partnership agreement between the notary and the bank in drafting the deed of the bank credit agreement. Results:Partnership agreement between public notary and banking is an act that is prohibited in the notary position law and notary ethics code.The agreement makes a notary not independent, thus affecting the disruption of services provided by the public notary. Conclusions: The partnership agreement between the notary public and the bank makes the notary not independent in carry out his professional obligations because he prioritizes services to the bank instead of those who do not cooperate with notary.

У статті досліджуються проблемні питання правозастосування обов’язку нотаріуса зберігати нотаріальну таємницю. Досліджуються теоретичні, законодавчі та практично-прикладні аспекти нотаріальної таємниці та її правозастосування. Зокрема нотаріальна таємниця розглядається як базис нотаріальної діяльності та етичних правил організації нотаріальної діяльності. Робиться припущення, що у випадку практичної неможливості зберігати нотаріальну таємницю та загрози нотаріальній таємниці рівень довіри суспільства до інститут нотаріату буде знижуватися. Це в свою чергу буде призводити до більш стрімкого формування зв’язків особистісної довіри та звернення до нотаріуса не як до суб’єкта, що може надати відповідну правову допомогу та захист прав та інтересів, а як до представника інституту до якого зобов’язує звертатися закон і до якого особа не зверталась би якби того не вимагав закон.
Автором наголошується на неможливості існування інституту нотаріату в умовах неефективного законодавчого регулювання нотаріальної таємниці. Неоднозначність законодавчого регулювання стає генеруючим чинником для диференційної практики правозастосування. Так на матеріалах запитів відповідних органів та посадових осіб, в умовах необхідності зберігати нотаріальну таємницю, проводиться аналіз змісту та характеру запитуваної інформації та документів від нотаріусів. Водночас автором наголошується, що навіть максимально ідеальне законодавче регулювання нотаріальної таємниці може не витримати реалій повсякденного правозастосування і потягне за собою знову ж таки неоднозначну та диференційовану практику правозастосування. Каузальний зв'язок, який припускається автором, полягає в тому, що кожен суб’єкт правозастосування діє в умовах та правових межах, що сконструйовані нормативно-правовим базисом, що регулює його, суб’єкта, діяльність і такий нормативно-правовий базис побудований, як правило, без урахування особливостей нотаріальної діяльності. Тобто брак системності у правовій системі відтворюється у діяльності суб’єктів правозастосування, а отже і долатися він може через коригування діяльності суб’єктів правозастосування самими суб’єктами. Саме тому автор вважає, що якісне та ефективне законодавче регулювання є необхідною але не достатньою умовою вирішення проблеми практики правозастосування. Вирішення проблеми повинно бути побудоване на фундаменті якісного законодавчого регулювання та діалогу суб’єктів правозастосування, який дасть змогу кожні стороні почути позицію іншої та створити механізм реалізації конкретних норм без їх порушення та/чи зловживань у їх застосуванні. Робиться висновок про можливість застосування медіація у такій правозастосовній практиці, де суб’єкти правозастосування здатні та мають можливість домовитись про єдину інтерпретацію конкретної норми у конкретній ситуації.

The article is devoted to the problems of application of the notary’s duty to keep notarial secrecy (confidentiality). Theoretical, legislative and practical aspects of notarial secrecy and its application are investigated. In particular, notarial secrecy is considered as the basis of notarial activity and ethical rules of notariat and its organization. The assumption is made that in case of practical impossibility to keep notarial secrecy and threats to notarial secrecy, the level of public trust in the notarial institute will decrease. This, in turn, will lead to a more rapid formation of personal trust relationships and appeal to the notary not as a subject, which can provide appropriate legal assistance and protection of rights and interests, but as a representative of the institute to which the law is required to apply and to whom the person would not turn unless the law required it.
The author emphasizes the impossibility of the existence of a notary institution in the conditions of inefficient legislative regulation of notarial secrecy (confidentiality). The ambiguity of legislative regulation is a generating factor for differential law enforcement practice (application of law). Thus, on the materials of the requests of the relevant authorities and officials, in the conditions of necessity to keep notarial secret, the content and nature of the requested information and documents from notaries are analyzed. At the same time, the author emphasizes that even the most perfect legislative regulation of notarial secrecy can not withstand the realities of everyday law enforcement (application of law) and will entail again ambiguous and differentiated practice of law enforcement. The causal link assumed by the author is that every law enforcement entity operates within the conditions and legal frameworks constructed by the law governing it, the entity, its activities and such regulatory framework, as a rule, without taking into account the features of notarial activity. In other words, the lack of systematicity in the legal system is reproduced in the activities of law enforcement entities, and therefore can be overcome by adjusting the activities of law enforcement entities by the entities themselves. That is why the author believes that quality and effective legislative regulation is a necessary but not sufficient condition for solving the problem of law enforcement practice. The solution to the problem should be based on the basis of qualitative legislation and dialogue of the subjects of law enforcement, which will allow each party to hear the position of the other and create a mechanism for implementation of specific norms without violating them (infringing them) and / or abusing their application. The conclusion is made about the possibility of using mediation in a law enforcement practice (application of law practice) where law enforcement subjects are able and agree on a single interpretation of a specific law in a particular situation.

В статті розкривається сутність нотаріального процесуального представництва, класифікація його видів, а також аналізується представництво за законом, підстави його виникнення, суб'єкти та особливості його здійснення. Запропоновано ряд пропозицій щодо вдосконалення норм ЦК, а також доповнення Закону України "Про нотаріат" нормами, які регламентують інститут представництва у нотаріальному процесі.

La funzione di adeguamento del notaio (quale dovere di controllo di legalità sostanziale dell’atto e di dare alle parti una puntuale informazione sul senso e sul significato dello stesso come di tutti i suoi effetti) e la sua posizione di terzietà hanno carattere generale e rendono superflua la specifica approvazione delle clausole vessatorie ex art. 1341, cpv., c.c. indipendentemente dalla circostanza che queste siano contenute in un atto pubblico o in una scrittura privata autenticata o nei rispettivi allegati.

Negara Indonesia adalah Negara Hukum (Rechtstaats) sebagaimana yang tercantum di dalam UUD 1945 Pasal 1 ayat (3). Konsekuensi logis dari penerimaan Hukum sebagai dasar bernegara adalah mutlak dan wajib adanya jaminan kepastian hukum, ketertiban hukum, dan perlindungan hukum yang bertumpu pada dua hal yakni kebenaran dan keadilan yang tidak bisa dinegasikan lagi. Implementasi dari Indonesia sebagai negara hukum adalah setiap warga negara atau individu yang melaksanakan perbuatan hukum memerlukan kepastian hukum dan jaminan adanya perlindungan hukum oleh negara sebagaimana yang diamanatkan oleh UUD 1945. Salah satu bentuk kepastian hukum itu sendiri yaitu adanya alat bukti yang sah dan tertulis serta memiliki kekuatan hukum yang pada dasarnya hal ini merupakan suatu kebutuhan masyarakat sebagai upaya mencari perlindungan hukum1 atas perbuatan hukum individual yang dilakukannya. Keberadaan alat bukti tertulis berupa akta otentik menentukan secara jelas mengenai hak dan kewajiban seseorang dan menjamin adanya kepastian hukum, selain itu akta otentik diharapkan dapat meminimalisasi terjadinya sengketa dalam lalu lintas hukum maupun hubungan hukum antara para pihak. Dengan adanya hal ini, maka peran dan kedudukan Notaris sangat penting sebagai salah satu pejabat umum yang berwenang dalam membuat suatu akta otentik2.

Reintroduction of Notary after 1995 in the Slovenian legal area followed the principles of the Latin notary. Profession independence and freedom to practice were abolished in 1944; all powers were transferred to the courts, the Notary Chamber was also abolished.
The debate on the four-hundredth anniversary of the reintroduction of the Notary does not want to give an inventory, so others are called, it wants to shed light on an institution that many see as obsolete, unnecessarily expensive Etc. There are at least two periods in the history of Notary the  period up to and before 1855. After 1855 the Notaries were organized in the Chamber of Notaries before the Notary was considered as a trustworthy person (persona credibilia, Notarius oder Tabelio ist ein offen person ... zu wellichem man ein trewe zuflucht hat) and acted by the rules of Ars notarii.

Ponovna uvedba notariata leta 1995 v slovenski pravni prostor je sledila principom
latinskega notariata. Samostojnost in svoboda opravljanja poklica je bila ukinjena
1944. leta in vse pristojnosti prenesene na sodišča, ukinjena je bila notarska
zbornica. Predlog zakona iz leta 1992 je vključeval notarje in notarsko zbornico.
Razprava ob četrt-stoletnem jubileju ponovne uvedbe notariata ne želi dati inventure,
zato so poklicani drugi, želi osvetliti institucijo, ki jo mnogi vidijo kot zastarelo,
nepotrebno drago itd., na drugi strani pa predstaviti princip delovanja skozi
tisočletno zgodovino, ki omogoča pravice strank v civilnopravnih postopkih. V
zgodovini notariata ločimo vsaj dve obdobji, in sicer obdobje do leta 1855, ko je
bil vzpostavljen sistem organiziranega delovanja notarjev prek Notarske zbornice,
in po letu 1855, ko je notariat in predvsem notar veljal za zaupanja vredno osebo
(persona credibilia, Notarius oder Tabelio ist ein offen person ... zu wellichem
man ein trewe zuflucht hat) in je deloval skladno s pravili Ars notarii.

Notarial process of issuing of certificate of purchasing property from public auction and state registration of corporeal rights upon its baseaccording to the newest legislation, its (process) peculiarities and gaps in the law in this field are examined in this article.

History, genesis and development of notariat in the law of European countries are considered in the scope of this article. Such countries like Italy, Spain, France and Germany are subject of special attention because of their significant contribution to it.

Abstrak Dengan adanya perkembangan teknologi termasuk perkembangan teknologi dalam kegiatan Notaris, sehingga agar tidak tertinggal perkembangan jaman maka diharapkan Notaris pun mengikuti perkembangan teknologi. Cyber Notary memanfaatkan kemajuan teknologi dalam menjalankan tugas dan kewenangan Notaris. Dan salah satu contoh dari munculnya cyber notary, notaris dapat melakukan tanda tangan secara elektronik. Di dalam UUJN No. 2/2014, seorang Notaris diizinkan untuk melakukan sertifikasi pada dokumen elektronik. Dengan begitu peluang untuk menjadikan Cyber Notary tidak lagi terbentur oleh dasar hukum, karena sebelumnya belum ada dasar hukum yang mengaturnya. Sehingga, layanan pembuatan akta dituntut mampu memenuhi kebutuhan masyarakat dengan mengaplikasikannya melalui media berbasis elektronik. Dalam penulisan ini, dipergunakan pendekatan Yuridis normatif, yaitu penelitian kepustakaan yang menguraikan data sekunder yaitu bahan hukum primer berupa peraturan perundang-undangan, bahan hukum sekunder seperti buku-buku maupun karya ilmiah yang berkaitan dengan topik penelitian. Ruang lingkup dalam penelitian ini adalah pada masalah yang berhubungan keabsahan akta, dan tanda tangan elektronik dalam akta Notaris. Penelitian ini, bertujuan untuk menyelidiki, membahas, menguraikan dan menyajikan masalah yang berkaitan dengan keabsahan tanda tangan elektronik dalam akta Notaris. Abstract With the development of technology, including technological developments in the activities of notaries, so as not to be left behind by the times, it is hoped that the Notary will follow technological developments. Cyber Notary takes advantage of technological advances in carrying out the duties and authority of the Notary. And one example of the emergence of cyber notary is that notaries can sign electronically. In UUJN No. 2/2014, a Notary is allowed to certify electronic documents. That way, the opportunity to make Cyber Notary no longer collides with a legal basis, because previously there was no legal basis regulating it. Thus, deed-making services are required to be able to meet community needs by applying them through electronic-based media. In this paper, a normative juridical approach is used, namely literature research that describes secondary data, namely primary legal materials in the form of statutory regulations, secondary legal materials such as books and scientific works related to research topics. The scope of this research is on issues related to the validity of deeds and electronic signatures in notary deeds. This study aims to investigate, discuss, describe and present problems related to the validity of the electronic signature in the notary deed.

RÉSUMÉ
  Pourquoi l’institution notariale de type latin n’a pas pour destin de disparaître mais au contraire? Comment nous pouvons la projeter vers le futur? Pour répondre à ces question, il est nécessaire d’examiner les problèmes suivants ;
  Premièrement, de réfléchir sur la nécessité et l’aptitude d’un tiers intervenant dans les affaires privées; Tous les éléments sous-mentionnés exigent l’intervention d’un tiers, sa haute fiabilité et son excellente qualité juridique. (1) Les affaires privées dans la société moderne se déroule sur «le principe de liberté contractuelle», et ce principe se fonde sur quelques prémisses―«l'égalité des parties», «l'autonomie de la volonté privée» et «l'auto-responsabilité de chaque particulier». Mais cependent, ils ne sont pas toujours garantis en réalité. (2) L’on voit souvent dans les activités des parties le manque de certitude et d’assurance juridique, les documents n’ayant pas de force probante par exemple, en raison du manque des élucidations des faits et de celui des connaissances juridiques etc.. (3) Le document rédigé par les parties privées ne peut porter la force exécutive qui est le dernier bastion pour assurer l'efficacité du contrat. (4) Pour certifier la vérité et la validité d’une transaction ultérieurement, sa trançabilité doit être assurée. (5) Afin de démontrer son efficacité, un accord entre les parties doit s’adapter aux conditions requises de l’accomplissements des obligations, sous le contrôle approprié.
Deuxièmement, de confirmer la conformité du notariat aux besoins susmentionnés; Il’y a beaucoup de surnoms variés pour le notaire, i.e., «praticien du droit», «spécialiste de l'écrit», «conseiller des parties en toute indépendance et impartialité», «médiateur entre parties», «serviteur de la loi», «serviteur du droit et non pas d’une des deux parties», «pas le juriste d’un client mais d’un dossier», «juriste agissant d’une façon neutre», «instituteur de la loi», «applicateur de la loi», «créateur de la loi», «arbitre du contrat», «défenseur de la légalité et de la vérité», «magistrat de l’amiable», «pacificateur du droit» et «le gardien de la justice» etc. Ce sont des images du notaire justement comme «tiers de confiance» conservées depuis longtemps qui montre exactement sa raison d’être.
Troisièmement, de saisir les accusations contre le notaire et le notariat; Ils existe deux problèmes fondamentaux et ardus touchant au cœur. (1) L’un est l’attaque contre notre profession et institution de type latin, basée sur l’idéologie de l’ultra-libéralisme «la liberté pour la liberté». Cette vague de la dérégulation s’étend partout du monde, impliquant le Japon. (2) L’autre est l’appel sur l’anachronisme et l’inutilité du notariat de nos jours dans le développement de la technologie électronique.
Quatrièmement, de concevoir les tactiques d’affronter ces attaques et les surmonter; Quant à l’accusation (1) susmentionnée, est-ce-que ce n’est pas plutôt de bonne chance de diffuser les mérites de notre système? Il nous faut insister patiemment à faire plus des appels au monde par tous les moyens disponibles que " «Laissez-faire et restaurez après» ne s’applique jamais au notariat, puisqu’il n’est absolument pas l’activité économique mais celle publique afin de réaliser la sécurité juridique préalable. La restauration ultérieure est trop tard, plus coûteuse et beaucoup inquiétante. En un mot comme en cent, «Une once de prévention vaut une livre de guérison!»". De plus, par la démonstration de l’efficacité de nos activités en portant le plus de données réeles et concrètes recueillies non seulement par la maîtrise statistique mais aussi avec l’aide des sciences pertinentes, ces appels seront beaucoup plus utiles à révéler la supériorité de notre sysytème latin. Notre argument ne doit pas rester abstrait, mais doit s’appuyer sur des données positives. Quant à l’accusation (2), faisant face à l’atteinte emphatique d’arcahïsm et d’superfluité du notaire, il faudra établir une certification de nos talents suffisants pour s’adapter adéquatement à la numérisation, en tout entassant des progrès des nos activités professionnelles. Bien que l’essence de notre fonction soit immuable et universelle, la manière de remplir son but final doit être évoluée. De développer l’informatisation du notariat, il apporte, non seulement le bénéfice des usagers, mais aussi le bénéfice du notaire soi-même. De renforcer et d’accélérer ces mouvements, en réservant prudemment tout notre maîtrise particulièrement intellectuelle, c’est un défi encore restant pour survivre dans le futur.
  Il est clair que le notaire a continué à jouer le rôle indispensable de tout temps jusqu’à aujourd’hui. Pour le notaire, il doit agir toujours avec droiture, et juger en toute impartialité, en tant que le gardien de la justice. En même temps, il doit avoir de la compréhension profonde pour les problèmes de ses clients, et nouer les liens sympathiques avec les personnes ou les organismes demandants son aide. Ainsi donc, le notaire peut bénéficier de la confiance en soi et de la fierté de profession légal soutenu par son authenticité historique. Porter la sécurité juridique préventive pour assurer l’ordre de la société et la paix du monde, en tant que «la profession» véritable ― c’est la mission invariable du notaire.

En este trabajo presentamos la vida de Alonso Portero a través de los documentos inéditos localizados en diferentes archivos madrileños, dando a conocer su trayectoria profesional como escribano del número de la villa y escribano de cámara de Felipe IV en la Real Junta de Obras y Bosques. En paralelo, se estudia su actividad como coleccionista de pinturas y se aportan nuevos datos para precisar la cronología de cuadros que fueron realizados bajo su patronazgo, como La recogida del maná de Diego Polo, actualmente en el Museo del Prado (P-6775). Por último, se expone la estrecha relación de Portero y su mujer, Feliciana González del Corral, con el desaparecido convento de las Capuchinas de Madrid, donde ambos fueron enterrados y al que donaron importantes cantidades de dinero y obras de arte.

In this work we present the life of Alonso Portero through unpublished documents located in different archives of Madrid. These documents outline his professional career as the numerary notary of the town and chamber notary of Philip IV on the Royal Board of Works and Forests. In parallel, this work studies his activity as an art collector by presenting new data concerning the chronology of paintings that were made under his patronage, such as The Gathering of the Manna by Diego Polo (currently in the Prado Museum [P-6775]). Finally, we detail the close relationship between Alonso Portero and his wife, Feliciana González del Corral, and the now disappeared Convent of the Capuchin nuns of Madrid, where both were buried and to which they donated significant amounts of money and works of art.

Abstrak Kepemilikan bersama adalah hak kebendaan yang dimiliki oleh dua orang atau lebih, baik karena pewarisan maupun cara lain. Kepemilikan bersama atas hak atas tanah diakhiri dengan membuat Akta Pembagian Hak Bersama yang dibuat di hadapan PPAT. Pejabat Kantor Pertanahan dan Kantor Dinas Pelayanan Pajak Daerah menafsirkan bahwa pemisahan dan pembagian atas tanah warisan dianggap merupakan pemisahan hak yang mengakibatkan peralihan, sehingga menjadi obyek Bea Perolehan Hak Atas Tanah dan Bangunan (BPHTB). Hal ini menghambat pendaftaran APHB. Warisan merupakan kepemilikan bersama yang terikat, dan pemisahan dan pembagian terhadapnya tidak mengakibatkan adanya peralihan hak. Hal ini terjadi karena kekhilafan dalam pemahaman mengenai hukum waris, hukum keluarga dan hukum benda. Penelitian ini bersifat deskriptif-preskriptif yang memberikan data detil tentang gejala sosial dan ditujukan untuk mendapatkan saran-saran untuk mengatasi masalah-masalah tertentu. Abstract Co-ownership is ownership of property, which owned by two persons or more, wherefore inheritence or other means. Co-ownership could be ended by drawing Deed of Division of Co-Property (APHB) drawn before Land Deed Official. Land Official and Regional Tax Official interpret the splitting and dividing over inheritence of land title as a splitting resulting in transfer of title, thus subjected to Duty on Land and Building Title Acquisition/BPHTB. Such act obstruct registration process of APHB. Inheritence is a bound co-ownership, that splitting and division upon it, shall not result in transfer of title. This occurs because of negligence to have an understading of Inheritence Law, Family Law, and Property Law. The characteristics of this research are descriptive-prescriptive which provide detail data of social phenomenon and to obtain suggestions to resolves particular problems.
